Act of Sale
from William Wells, Tutor to H. T. Neal
26 April 1849
Be it Known and Remembered that on this, Twenty Sixth day of April in the year of our Lord, One thousand Eight hundred and forty nine, and in the year of the Independence of the United States of America the Seventy Third.
Before me Henry W. Warrell, Recorder of said Parish and duly authorised by law to exercise the powers of Notary Public therein, personally came and appeared Mr. William Wells, Tutor the minor Heirs of Elihu T. and Delilah Murray, deceased, and for the use of said heirs who did declare and say, that for the consideration hereinafter expressed, he does by these presents, grant, bargain, sell, convey, transfer, assign, and set over, with a full guarantee against all troubles debts, mortgages, claims, evictions, donations, alienations, or other incumbrances whatsoever unto Henry T. Neal, here present accepting and purchasing for himself, his heirs and assigns, and acknowledge delivery and possession thereof,A certain peice [sic] or parcel of Land lying and being situate in the Parish of Livingston on the waters of Ponchatoula - containing two hundred and fourteen acres more or less and known as the Murray Tract - Bounded on the South by lands of Richard Wade on the west by Ponchatoula River on he North by lands of William Durbin and on the East by Lands of William Wells, Together with all the buildings and improvements rights of ways and servitude thereunto belonging or in any wise appertaining.
To have and to hold the said property unto the said purchaser, his heirs and assigns, to their proper use and behoof forever; and the said vendor for himself in his said capacity said property to said purchaser and all right said heirs may have, their heirs & assigns to him or his heirs and assigns, shall and will warrant and forever defend against the lawful claims of all persons whomsoever by these presents; the said vendor moreover subrogating the said purchaser to all the rights and actions of warranty which he has or may have against his own vendor or the vendors of his vendor hereby authorising the said purchaser to exercise the said rights and actions in the same manner as he might or could have done.
This sale is made for and in consideration of the sum of Three hundred and thirty five dollars, one hundred and seven dollars cash, the Balance of said purchase price the purchaser has furnished his promisary note for the sum of two hundred and twenty eight dollars of even date with this instrument and paraphed by me notary in order to Identify it with this said instrument and payable then days after date to draw eight per cent interest from date an in order more fully to Identify said note and to secure the payment of said note the purchaser hereby specially mortgages and hypothicates said land to said Tutor in his said capacity and for the use of said before mentioned heirs and binds himself and his heirs not to alienate, deteriorate or otherwise encumber said land to the prejudice of said Mortgagers. The certificate of the Recorder of Mortgages is waived by the Parties.
Thus done and passed in the Parish of Livingston the day, month and year first above written, in the presence of Alexander Green and William Kirk, witnesses of lawful age and domiciliated in this Parish, who have hereunto signed their names, together with appearers, and me, said Recorder.
