Richard Wade to Donald McDonnell
19 August 1837Be it Known and remembered that in this Nineteenth day of August in the year of our Lord one Thousand Eight hundred and thirty Seven,
Before me Thomas Kennedy Parish Judge and ex officio Notary Public in and for the said Parish of Livingston, Personally came and appeared Mr. Richard Wade of the Parish of Livingston who declared that for and in consideration of the sum of Three Thousand dollars, to be paid as hereinafter expressed, he does by these presents bind and obligate himself and does by these presents sell, bargain and obligate himself to make good and complete titles, as well from himself and his heirs, as from his wife and her heirs, as hereinafter conditioned unto Mr. Donell McDonell of the City of New Orleans who accepts by his agent A. W. McDonnell of the certain plantation and all the land owned by the said Richard Wade situated at the Ponchatoulas landing on the east side of the river Ponchatoula, consisting of the original half section of land obtained from the United States by donation, also a piece of land entered and purchased from the United States adjoining the former of about one hundred & seventy acres, making in the whole tract of land five hundred & twenty acres, more or less it being the tract of land on which the said R. Wade now resides, Bounded on the North by lands of Murry & Curtis, East by lands of Vinyard - South by Public lands and West by said river Ponchatoulas.
The consideration as above specified is to be paid as follows, To Wit.:
Fifteen hundred dollars in cash on the first day of October next and five hundred dollars to be paid on the first day of January next (1838) and the Balance of one thousand dollars to be paid on the first day of January (1839) Eighteen hundred and thirty Nine, the last mentioned payment to be secured by the Note of the purchaser and a Mortgage with Confession of Judgment on the property until final payment with Interest also on the last mentioned payment at the rate of ten percent per annum, from the first day of January 1838, until the first day of January 1839.
And the said vendor Richard Wade makes the following reserve, To which the purchaser does acceed [sic], To Wit,
That the said Richard Wade is to keep possession of the aforesaid plantation until the first day of January 1838 and together his crop on the place, at this time growing (But is to Cut no timber off or from the land from this day forward) and on the first day of January next (1838). In case the foregoing conditions is complied with on the part of the purchase and the two first payments as above specified is well and duly made by the said purchaser, and his Note for the last payment of one Thousand dollars and Mortgage on the premises as above specified is furnished.
Then the said Richard Wade binds & obligates himself and his heirs and assigns, That he will make full and bona fied titles to the said purchaser of the aforesaid described property with a general warrantee and also bind himself that his wife Mary Scaggs shall renounce and relinquish, to the said purchaser all her priveleges rights claims and Mortgages which she has on the above described property of whatever nature they may be.
Thus done and passed in my office in presence of Gaston. T. Raoul and Gilliam Wood, Witnesses of Lawful age and domociliated [sic] in this Parish who have signed this act with the said parties and me the said Judge & Notary this day and date above first written.

I, the Subscriber authorize August Wm. McDonell as my Lawful agent to accept Tittle [sic] of a certain piece of land purchased of Richard Wade, five hundred acres more or less.
