Last Will and Testament of Charles Graff

Last Will and Testament. I, Charles S. Graff of Saline Township in Perry County and State of Missouri, being of sound mind and Memory and considering the uncertainty of this frail and transitory life, do therefore make and ordain, publish and declare this to be my last will and Testament.

First. I order and direct that my Executrix herein after named pay all my just debts and funeral Expenses as soon after my decease as conveniently may be.

Second. after the payment of such funeral Expenses and debts I give devise and bequeath to Ellenia R. Graff my wife all my real Estate consisting of acres of land, being in Saline Township and in the County of Perry and State of Missouri, also all of my personal Property, Notes and accounts that may be due me. Now at the death of Ellenia R. Graff my wife, then this Estate shall belong to my heirs herein after named:

Emma E. Blandford,
Mable L. Graff,
Mary Lottie Graff,
John Carl Graff,
Charles C. Graff,
Irine Graff,
Samuel B. Graff.

Lastly, I constitute and appoint Ellenia R. Graff my wife to be Executrix of this my last Will and Testament hereby revoking all former wills by me made;

In witness whereof I have hereunto subscribed my Name and affixed my seal this day of the Month and year, May 17th Nineteen Hundred and One.

This instrument was on the day and date thereof signed published and declared by the Testator Charles S. Graff to be his last Will and Testament in the presence of us who at his request subscribed our Names thereto as Witnesses in his presence & of each other.

Proof of Will

In the Vacation of the Probate Court.

On this 10th day of July A. D. 1901, before me Judge of the Probate Court within and for the County and State aforesaid, personally came Charles W. Zahner and Samuel Rankin, who being by me duly Sworn on their oaths say that they were present and saw Charles S. Graff sign the foregoing instrument purporting to be his last will and testament and heard him publish and declare the same to be his last will and Testament, and that at the time of signing and publishing the same the said Chas. S. Graff was of sound and disposing mind and that these deponents subscribed their Names thereto as witnesses to the same in the presence and at the request of the testator and in the presence of each other, and that the said Charles S. Graff departed this life at and in the county of Perry and State of Missouri on the 2nd day of July 1901.

Certificate of Probate

In the Vacation of the Court. I, Chas. A. Weber Judge of the Probate Court within and for the County and State aforesaid, having examined the foregoing instrument purporting to be the last will and testament of Charles S. Graff and signed by the said Charles S. Graff and having heard the Testimony of Charles W. Zahner and Samuel Rankin the subscribing witnesses thereto in relation to the Execution of the same, do declare and adjudge said instrument to be the last will and Testament of the said Chas. S. Graff deceased on the second day of July A . D. 1901 late of Perry County, Missouri:

In Testimony whereof, I have hereunto set my hand and affixed the seal of said Court at office in Perryville this 10th day of July A. D. 1901.

Executors Bond

We Helena R. Graff as Principal and Samuel Rankin, John C. Graff and Samuel E. Rankin as Securities are held and firmly bound unto the State of Missouri in the sum of One Thousand dollars for the payment of which we do hereby bind ourselves, our heirs, Executors and Administrators firmly by their Presents. Sealed with our own Seals and dates at Perryville Mo. this 10th day of July A. D. 1901. - The condition of the above Bond is that of this said Helena R. Graff Executrix of the last will and Testament of Charles S. Graff deceased, late of Perry County, Missouri, shall well and faithfully execute the said last will and Testament and shall make ---- and faithful Inventories, returns and Settlements of accounts of the Estate of the said Testator according to Law, and shall moreover, do and perform all other matters and things touching the Execution of the said last will and Testament as are or shall be prescribed by law or enjoined on her by the order, sentence or decree of any Court having competent Jurisdiction there this obligation to be void and of no effect, otherwise to remain in full force.

To all whom these presets shall come, Greeting:

Know ye that the Last will of Charles S. Graff deceased, hath in due form of law, been exhibited, proved and recorded, a copy of which is hereunto annexed, and in as much as it appears that Helena R. Graff has been appointed Executor in and by said last will to execute the same, and to the end that the Property of the Testator may be preserved for those who shall appear to have a legal right or interest therein and that the said last will may be Executed according to the request of the Testator we do hereby authorize her the said Helena R. Graff as said Executrix to collect and secure all and singular the goods and chattels, rights and credits, which were of the said Chas. S. Graff at the time of his death in whosoever possession the same may be found and to perform and fulfill all such duties as may be enjoined upon him by said will, so far as there shall be property and the law charges her, and in general to do and perform all other thing which now are or hereafter may be required of her by law.

Testimony whereof I, Chas. A. Weber Judge of the Probate Court in and for said County of Perry, have hereunto signed my Name and affixed the seal of said Court, at office this 10th day of July A. D. 1901.
