Last Will and Testament of Susan Twyman



In the name of God Amen.  

I Susan Twyman of the County of Perry State of Missouri aged Seventy Eight years being sound of mind do make and publish this my last will and Testament.

I request that my funeral expenses be conducted under the direction of Mrs. Margaret E. Powers and in a manner suitable to my means and position in life and that a Suitable stone be placed to mark the final resting place of my remains the cost of which to be considered as funeral expenses;

And I direct that my funeral charges, the cost of administering upon my Estate be paid out of my personal Estate.

I give and bequeath to Mrs. Margaret E. Powers during her life and at her death to her daughter Leona Hughey who was christened Elizabeth Matilda the home place upon which I now live described as follows: --
One acre so ground Beginning at the South East corner of a tract of land purchased by Clement Schindler from Arsan Callier and wife on the north side of the road leading from Perryville to Ste. Mary’s Seminary; Thence along the line dividing the land of the said Schindler and Elizabeth Bell North 209 feet to the road leading from Perryville to Ste. Mary’s Seminary; Thence East along said Road to the place of Beginning, situate? in Township 35 North of Range 10 East.
I bequeath to Rev. D. McCarthy now of Ste. Mary’s Seminary the Sum of One Hundred dollars.

I reserve Fifty Dollars out of my personal Estate to be expended in Masses for the repose of my soul, One High Mass immediately after my death and low Masses once a month or choice? a month of convenient.

I bequeath to Rev. Wm. Moore the sum of Fifty Dollars.

The Balance of my personal Estate I bequeath in equal shares to my relations or heirs [who] now reside in Perry County, Missouri.

I appoint Patrick Monaghan Executor of my last will and Testament.

Dated this 3rd day of August 1885.

Proof of Will

In the Vacation of the Probate Court.

Be it remembered that on the 12th day of November A. D. 1887 before me Chas. A. Weber Judge of the Probate Court held in and for the County and State aforesaid personally appeared John F. Baumann and Jules Denizet who are the subscribing witnesses to the annexed will of Susan Twyman deceased, and being by me first duly sworn depose and say that the said Susan Twyman the Testatrix subscribed the same in their presence and published and declared said will or Instrument of writing to be her last will and Testament, and that at the time of signing the same, she the said testatrix was of sound and disposing mind and more than Twenty one years of age, and that said deponents attested said will as witnesses thereto, by subscribing their names to the same in the presence of the Testatrix and of each other and at the request of the said Testatrix.

Certificate of Probate


In Vacation of the Probate Court.

I Chas. A. Weber Judge of Probate in and for the County and State aforesaid, having examined the foregoing instrument purporting to be the last will and Testament of and signed by Susan Twyman, and having heared (sic) the Testimony of John F. Baumann and Jules Denizet the subscribing witnesses thereto in relation to the Execution of the same do declare and adjudge said Instrument to be the last will and Testament of the said Susan Twyman deceased.

In Testimony whereof I have hereto subscribed my name and affixed the Seal of said Court at office in Perryville this 12th day of November A. D. 1887.

Executors Bond

In Vacation of the Probate Court.

We Patrick Monaghan as Principal; and Anton Hunt and John Hooss as Securities, are held and firmly bound unto the State of Missouri in the sum of Three thousand Dollars of the payment of which we do hereby bind ourselves, our heirs Executors and Administrators, firmly by these Presents, Sealed with our seals and dated at Perryville, Mo. this 12st (sic) day of Novbr. A. D. 1887. The condition of the above Bond is, that if the said Patrick Monaghan Executor of the last Will and Testament of Susan Twyman deceased, late of Perry County, Missouri, shall well and faithfully Execute the last will and Testament, and shall make true and faithful Inventories, returns and Settlements of accounts of the Estate of the said Testatrix according to Law, and shall, moreover, do and perform all other matters and things touching the execution of the said last will and testament, as are or shall be prescribed by Law, or enjoined on him by the order, sentence or decree of any Court having competent Jurisdiction then this obligation to be void and of no effect; otherwise to remain in full force.

Letters Testamentary

In the vacation of the Probate Court.
The State of Missouri; to all to whom these Presents shall come -- Greeting:

Know ye, that the last will and Testament of Susan Twyman deceased late of Perry County Missouri, hath in due form of law, been exhibited, proved and recorded in the office of the Judge of the Probate Court of Perry County, Missouri and in as much as it appears that Patrick Monaghan has been appointed Executor in and by said last will and Testament, to execute the same, and to the end that the property of the Testator maybe preserved for those who shall appear to have a legal right or interest therein, and that the said last will and Testament may be executed according to the request and instruction of the Testator, we do hereby authorize him the said Patrick Monaghan as such Executor to collect and secure all and singular the goods and chattels rights and credits which were of the said Susan Twyman at the time of her death, in whosoever hands or possession the same may be found, and to perform and fulfill all such duties as maybe enjoined upon him, by said last Will and Testament, so far as there shall be Property and the Law charge him; and in general to do and perform all other acts which now are or may hereafter be required of him by Law.

In Testimony where of I Chas. A. Weber Judge of the Probate Court in and for the County of Perry have hereunto signed my Name and affixed the Seal of said Court at office in Perryville this 12th day of November A. D. 1887.
