Last Will and Testament of Evarestus Riney

I, Evarestus Riney of the County of Perry and State of Missouri do hereby make and publish this my last will and testament as follows, to wit:

First, I resine [sic] my body to the dust and my soul to God, Amen.

Second, I desire that my funeral expenses and all my debts be paid, then,

Third, I give and bequeath unto my son William Riney one dollar to be paid him by my Exectuer [sic], and

Fourth, I give and bequeath unto my beloved wife the farm that I now live upon during her natural life, and property sufficient for the raising and suport [sic] of the rest of the children, in addition to her dower, and case of her death before the children arves [sic] at the age of twenty-one, the I will and bequeath that all the property to be sold and divided among them excepting William Riney who has never lived with me not asisted [sic] with acumulating [sic] the property.

Fifth, I desire that the land that I now live upon if it cannot be divided in kind, I want it to be sold and partition to be made of the same amongst the following heirs, to wit:

Emily Riney, Francis M. Riney, Lousia [sic] Riney, Anarpa Riney, and in case that I should have any other children which would be born in wedlock with my beloved wife, Ann Riney, my desire that they by what name soever they may have, I want them to share alike with those that are mentioned as above.

I do hereby publish and declare that this is my last will and testament, revoking all former wills heretofore executed by me, in testimony whereof I have hereunto set my hand and seal, this 19th day of February A. D. 1853.

Proof of Will

In vacation, September 22nd 1853. Be it remembered that Thomas S. Stewart, and Henry L. McArthur, the subscribing witnesses to the within last will and testament, this day personally appeared before me, and being duly sworn deposeth and sayeth that they saw the within named Testator sign the within instrument of writing which he published as his last will and Testament, that at the time of so doing he was of sound mind and over the age of twenty-one years, and that deponents attested said will as witnesses thereto, by subscribing thier [sic] names to the same in the presence of said Testator, and in the presence of each other which proof is by me deemed sufficient to establish said will.

Sworn to and subscribed before me the undersigned Clerk of the County Court of said County of Perry, this 22nd day of September A. D. 1853. In testimony whereof I hereunto set my hand and affix my official seal at office in Perryville the day and year last aforesaid.

Bond of Simon Riney, Admr with will annexed of the
Estate which was of Evarestus Riney, deceased

Know all men by these presents that we Simon Riney, as principal and Peter Dean and Severius Riney as securities of the county of Perry and State of Missouri, are held and firmly bound to the State of Missouri in the sum of sixteen hundred dollars of lawful money, for payment whereof, well and truly to be made and done, we bind ourselves, our heirs, executors and administrators, jointly and severally, firmly by these presents, sealed with our seals this 22nd day of September A. D. one thousand eight hundred and fifty three.

The condition of the above obligation is such, that if Simon Riney administrator with the will annexed of the estate of Evarestus Riney deceased, shall faithfully administer said estate, account for, pay and deliver all money and property of said estate; and faithfully execute the last will and testament of said deceased, pay the debts and legacies and faithfully perform all other things touching said administration required by law or the order or decree of any Court having jurisdiction, then the above bond to be void and of no effect, otherwise to remain in full force.

To all persons to whom these presents shall come, - Greeting:

Know Ye, that the last will and testament of Evarestus Riney, deceased hath in due form of law been exhibited proved and recorded in the office of the Clerk of the county Court for Perry County, a copy of which is herein unto annexed, and inasmuch as it appears that Simon Riney has been appointed administrator to execute the same, and to the end that the property of the testator may be preserved for those who shall appear to have a legal right or interest therein, and that the said last will may be executed according to the request of the testator, I henry L. Caldwell Clerk of the County Court within and for the county of Perry aforesaid in vacation of said court, do hereby authorize and appoint the said Simon Riney, administrator, with the will annexed, to collect and secure all and singular the goods and chattles, rights and credits which were of the said Evarestus Riney, dec’d at the time of his death, in whosoever hand or possession the same may be found, and to perform and fulfill all such duties as may be enjoined on him by said will so far as there shall be property and the law charge him, and in general to do and perform all other acts which now are or hereafter may be required of him by law.

In testimony whereof I Henry L. Caldwell sign my name and affix the seal of said Court at office this twenty-second day of September A.D. 1853.
