Last Will and Testament of Cornelius Horrell

Know all men by these Presents, that I, Cornelius Horrell of the County of Perry and State of Missouri, being in ill health but of sound and disposing mind and memory do make and publish this my last will and testament, hereby revoking all former wills by me at anytime heretofore made, and as to my worldly estate and all the property real personal or mixed of which I shall die seized and possessed or to which I shall be entitled at the time of my decease, I devise bequeath and dispose thereof in the Manner following to wit:

1st, All my just debts and funeral expenses shall first by my Executor hereinafter named be paid out of my Estate as soon after my decease as shall be him be found convenient.

2nd, I give devise and bequeath to my beloved wife Susannah Horrell all my household furniture and all my personal property, horses, wagons, and farm machinery and implements and all money on hand and notes, to have and to hold the same to her and her Executors Administrators and assigns forever. I also give to her the use, improvement and income of my dwelling house, land and its appurtenances situated in the County of Perry and State of Missouri aforesaid, being the South West quarter of the North East quarter and the South East quarter of the North West quarter, also six acres on the south side of the North West quarter of the South East quarter all in Section Sixteen Township 34 Range 11 East containing in all 87 acres to have and to hold the same to her for and during the term of her natural life. -- At the death of my wife Susannah Horrell it is my will that the land be divided in the following manner, to wit:

3rd. I give devise and bequeath to my son John V. Horrell and daughter Mary Eugenia Horrell, the South East quarter of the North West quarter of Section 16 in Township 34 Range 11 East containing 40 acres to be divided equally between them.

4th, I give and bequeath to my son James J. Horrell and Joseph Horrell and daughter Mary T. Sutton the South West quarter of the North East quarter and six acres off the South side of the North West quarter of the South East quarter all of Section 16 in Township 34 Range 11 East containing 46 acres to be divided equally amond them.

5th and lastly I do nominate and appoint said son John V. Horrell to be the Executor of this my last will and Testament.

In Testimony whereof I the said Cornelius Horrell have to this my last will and testament contained on one sheet oflegal cap Paper subscribed my name and affixed my seal this the 14th day of November in the year of our Lord one thousand eight hundred and ninety-one.

Signed, sealed, published, and declared by the said Cornelius Horrell as and for his last will and Testament in the presence of us who at his request and in his presence and in the presence of each other have subscribed our names as witnesses thereto.

Proof of Will

In vacation of the Probate Court. On this 31st day of December A. D. 1891 before me Judge of Probate within and for the County and State aforesaid personally came Jesse G. Crow and William F. Walker, who being by me duly sworn on their oath say that they were present and saw Cornelius Horrell sign the foregoing instrument purporting to be his last will and Testament by making his mark thereto and heard him publish and declare the same to be his last will and Testament and that at the time of signing and publishing the same the said Cornelius Horrell was of Sound and disposing mind, and that these deponents subscribed their names thereto as witnesses to the same in the presence and at the request of the Testator and in the presence of each other.

Certificate of Probate

In the vacation of the Probate Court. I, Charles A. Weber, Judge of Probate within and for the County and State aforesaid, having examined the foregoing instrument purporting to be the last Will of and signed by Cornelius Horrell, who, it is said departed this life on the 18th day of December A. D. 1891, and having heard the Testimony of Jesse G. Crow and William F. Walker the subscribing witnesses thereto in relation to the Execution of the same, do declare and adjudge said instrument to be the last will and Testament.

In Testimony, whereof I have hereunto set my hand and affixed the seal of the Probate Court of Perry County, Mo. at office in Perryville this 31st day of December A. D. 1891.
