Last Will and Testament of Casimir Chappuis

I, Casimir Chappuis of Perry County, Missouri, of sound and disposing mind do hereby make publish and declare the following as my last will and testament, my estate consisting of notes I hold against my sons Louis and Arsan Chappuis in the total sum of Five thousand eight hundred and forty-five dollars ($5845.00) secured by deed of trust on real estate which I recently conveyed to them by deed duly executed and recorded, together with such other personal property as I may own at my death, I dispose of as follows:

1st, I desire and direct that all my just debts, obligations and proper funeral expenses, including a grave-stone be fully paid by my Executor.

2. I hereby give, will and bequeath to my son Jule Chappuis the sum of nine hundred dollars,

3rd. To my son Leon Chappuis I give, devise and bequeath the sum of Eight Hundred dollars,

4. To my son Victor Chappuis, I give, devise and bequeath the sum of fifteen hundred dollars,

5th, To my grand children Henry and Henrietta Klump, children of my deceased daughter Mary, wife of Andrew Klump, deceased, I give and bequeath the sum of three Hundred dollars, each.

6th. It is my will that on advancements made by me in my lifetime to any ----? of my children shall be taken into account in the distribution of my estate.

Lastly, I do hereby nominate and appoint my son Jule Chappuis as the sole executor of this my will; that he take charge of my estate after my death and convert all personal property I may own, outside of notes, into money, and apply the same to the payment of costs, expenses and legacies.

Second, that he collect from my sons Louis and Arsan Chappuis on their indebtedness to me, in equal parts, such sum or sums of money as are necessary to enable my executor to pay off and settlein full all my obligations, debts, legal costs and all legacies and bequests as herein before stated, and to do so within two years after my death,

Third, It is my will and I hereby direct my executor that as soon as he has executed this will by paying all bequests and all legal costs and expenses; that he cancel the notes of my two sons Louis and Arsan Chappuis, satisfy the deed of -----? on record and return the papers to my said sons Louis and Arsan Chappuis and not collect any more than is necessary to carry out the promises. of this my last will,

Fourth, it is my will that my executor be not required to enter into bond as such, but it is my will that he file a full and final statement of his transactions with the Probate Court, which statement or final exhibit when approved by the Court shall entitle him to a full and discharge from the trust herein imposed,

In witness whereof, I do hereby sign my name and affix my seal in the presence of witnesses, to this my will on this Seventh day of May A. D. 1904.

The above and foregoing will was by Casimir Chappuis the testator, signed in our presence and by him published and declared as his Last Will and we the undersigned have, at his request and in his presence and in the presence of each other signed our names as witnesses hereto on the day and year last above written.

Proof of Will
In the Probate Court in vacation Feb. 26,1909.

Be it remembered that on this 26th day of February 1909 before me Judge of Probate and ex officio Clerk of the Probate Court in vacation thereof held and for the County of Perry and State of Missouri, personally appeared Adolph D. Pecaut and Wm. G. Blechle who being duly sworn upon their oaths depose and say that they were present and saw Casimir Chappius sign the foregoing instrument of date May the 7th, 1904 purporting to be the Last Will and Testament of him the said Casimir Chappuis and heard him publish and declare the same to be he Last Will and Testament and that at the time of signing the same the said Casimir Chappuis was of sound and disposing mind and these deponents subscribed their names thereto as witnesses to the same in the presence of the Testator and of each other, and at the request of the said testator who was ---- an 21 years of age at the date of so declaring and signing said instrument and said deponents further state that the said Casimir Chappuis died on the 23rd day of February 1909, at the County and State aforesaid,

Certificate of Probate

In the vacation of the Probate Court this 26th day of February 1909, I Jnos. Baumann, Judge of Probate and exofficio clerk of the Probate Court of Perry County, Missouri, having examined the foregoing instrument purporting to be the Last Will and Testament of Casimir Chappuis deceased, late of Perry County, Missouri, and having heard the testimony of Adolph D. Pecaut and Wm. M. Blechle subscribing witnesses thereto, in relation the execution of the same do declare and adjudge said instrument of writing to be the Last Will and Testament of said Casimir Chappuis deceased and the same is therefore admitted to Probate.

In Testimony whereof I have set my hand and affixed the seal of said Court at office this 26th day of February 1909.
