Last Will and Testament of Barbara Sutterer

Know all men by these presents that I, Barbara Sutterer of the county of Perry in the State of Missouri, of sound and disposing mind do make publish and declare the following as my last will and Testament in form following, to wit:

First, It is my will and desire that all of my debts be paid by my hereinafter named Executor without classification by anyone having probate jurisdiction.

Second, I do hereby bequeath and give to my children or to their heirs and legal representatives the following sums of money, to wit:

To my daughter Juliane Streiler, wife of Stephen Streiler, the sum of one dollar;

To my son Anton Sutterer, the sum of one dollar;

To my son John Sutterer, the sum of one dollar;

To my son Ferdinand Sutterer, the sum of one dollar;

To my daughter Teresa, wife of George Naegale, the sum of one dollar; and

To heirs of my son Remick Sutterer, the sum of one dollar;

To my son Xavier Sutterer, one bed and bedding and the sum of Three hundred dollars;

To my daughter Mary Sutterer, one bed and bedding, and the sum of one hundred and fifty dollars; and

To my son Frederick Sutterer, I hereby give and bequeath all the rest, residue and remainder of my estate, real, personal and mixed of whatsoever nature or kind, to have and to hold the same unto the said Frederick Sutterer and to his heirs and assigns forever; and

I further will that my hereinafter named Executor pay the hereinafter specified legacies to my children named herein at their age of maturity, with six percent interest from the sale of my death; and to those heirs who receive the sum of one dollar immediately after my decease, and I further will and ordain that my daughter Mary and son Xavier shall have, hold and enjoy a home with their brother Frederick as long as they may be minors and whose duty it shall be to provide for them in health and on sickness, and they in return for such -----? shall faithfully work for an obey the orders of their said brother Frederick.

Lastly, I hereby appoint my said son, Frederick as sole Executor of this my last Will and Testament, who shall not be compelled to give Bone or render annual settlements of his Executorship to any court have Probate jurisdiction, it being my will and wish to have my estate settled up and divided among my children with a little expense as ----- possible, hereby revoking all former wills by me made.

In testimony whereof I have hereunto subscribed my name and affixed my seal this 5th day of June A. D. 1872.

We attest the above and foregoing last Will and testament of Barbara Sutterer by subscribing our names hereto as witnesses to the same, at the request and in the presence of the testator and in the presence of each other this 5th day of June A. D. 1872.

In the Probate Court of Perry County Missouri

In the matter of proving the last Will and Testament of Barbara Sutterer, late of Perry County deceased.

On this 5th day of December, 1876, before me W. H. Bennett, Judge of the Probate Court of Perry County, Missouri, personally came Charles A. Weber and John J. Seibel, who being by me duly sworn on their oaths say that they were present and saw the said Barbara Sutterer sign the foregoing instrument purporting to be the last Will and Testament of herself and heard her publish and declare the same to be her last Will and Testament, and at the time of publishing and signing the same the said Barbara Sutterer was of sound and disposing mind and that these deponents subscribed their names thereto as witnesses to the same and in the presence and at the request of the Testator and in the presence of each other.

Certificate of Probate

In the Probate Court of Perry County, Missouri, I, W. H. Bennett, Judge of the Probate of Perry County, Missouri, having examined the foregoing instrument purporting to be the last Will and testament of Barbara Sutterer deceased, late of Perry County, Missouri, and having heard the testimony of Charles A. Weber and John J. Seibel, subscribing witnesses thereto, in relation to the execution of the same, do declare and adjudge said instrument to be the last Will and testament of the said Barbara Sutterer deceased, and the same is therein admitted to Probate.

In testimony whereof, I have hereunto set my hand and affixed the seal of said court at office this 5th day of December, 1876.
