Now comes the parties, and the Defendant waives notice to Plaintiffs demand in open Court, and this cause coming as to be heard is submitted to the Court for Trial by Jury. And the Court having heard the evidence doth find for the Plaintiff in the sum of nineteen and 60/100 dollars on an account.

It is therefore adjudged by the Court that the Plaintiff recover of the Defendant said sum and his costs, to be levied of the property of said deceased in, or which shall hereafter come to the hands of the administrator to be administered.

And it is ordered that said claim be assigned to and paid as of the fifth class.

Order of Publication

      William F. Cox, Administrator of the Estate of Thomas McCabe, deceased, presents to the Court his petition, praying for an order for the sale of so much of the real estate of said deceased as will pay and justify the remaining debts due by said estate, and yet unpaid for want of insufficient assets, accompanied by the accounts, lists, and inventories required by law in such case, on examination whereof it is ordered that all persons in... in the Estate of said deceased be notified that application as aforesaid has been made, and that unless the contrary be shown on or before the first day of the next term of this Court, to be held on the Third Monday of April next, and order will be made for the sale of the whole, or so much of the real Estate of the deceased as will be sufficient for the payment of said debts; and it is further ordered that this notice be published in some newspaper in this state, for four weeks, before the next term of this Court.

Cox, Administrator of the Estate of Thomas McCabe, deceased, and presents to the Court that the ... of publication made... at the January Term of 1877, thereof, has been published, according to the law and ... for the order of sale, pursuant to said petition and ... to hear the testimony ... , and to examine the parties who appear ... of said administrator for the sale of real Estate in the said publication ..., and it being proven to the Court that there was no personal effects and appears of said deceased charged with the payment of debts, and ... administrator to pay the debts due by said Estate, it is ordered that the said William F. Cox, Administrator, do sell either at public or private sale, and if at public sale, there that he the said administrator, do on a day to be fixed by him, at the front door of the court house of the County of Ste. Genevieve, and during the session of the county court or of the Circuit Court of said county, between the hours of three o’clock in the afternoon and five o’clock in the afternoon of that day, export the sale at public ... or writing, the following real Estate in the petition of said administration, described as follows, to wit: “Part of ... U. S. survey 1862” ...

Order Confirming Sale

Now comes William F. Cox, Administrator of the Estate of Thomas McCabe, deceased, and submits to the Court his report of sale, by which --- he did, on this 17th day of July, 1877, as obedience to the order of this Court made at the May Term 1877, --- at public --- to Thomas T. McCabe for the sum of Four Hundred and Twenty-two dollars, the real Estate is said --- described , to wit: “Part of U. S. survey 1862, Begin at a stone ...corner of Jules Rozier ... owned by Thos. F. McCabe, thence, along the north east ... of said ... along the southwestern line of ...line of Thomas McCabe’s house thence to ...approved and confirmed, and the said ... deliver to said Thomas F. McCabe a deed in ... form of law, assigning to the said Thomas McCabe all the right, title and interest which the deceased had in the same at the time of his death.

The administrator submits his final settlement for a approval showing a balance of $95.10 due the estate by the administrator and files proof of publication of notice of final settlement, which is done and recorded as amongst the last day’s proceedings of this term and it is ordered said balance of $95.10 be distributed to the proper persons interested in said and the administrator filing receipts showing said distribution has been made, he is by the Court discharged.
