This indenture made and entered into this fourth day of September 1858 by and between Peter Kline and Elizabeth his wife of the first part and James McCabe of the second part.

Witnesseth that the said parties of the first part for and in consideration of the sum of one thousand dollars do therein ... the party of the second part, the receipt whereof they do hereby acknowledge, have granted bargained and sold and by these presents do grant bargain and sell unto the party of the second part his land and heirs and assigns forever the following described tract of land lying and being in the County of Ste. Genevieve and State of Missouri, to wit:
Beginning at a limestone, set at the North Western corner of a tract of land sold by Miles A. Gilbert to Thomas McCabe, said limestone is about 24 inches long and 4 inches thick from which a B. Oak 8 in. in dia. bears N 65oEast distant 84 links and a B. Oak 9 in. dia., bears South 11oW. distant 21 links, thence South 43oW. 22 chains & 22 links to a limestone 14 in. long, 8 in. wide, from which a B. Oak 4 in. dia., bears North 82oE. distant 19 links, and a B. Oak 8 in. bears South 76o E distant 10 links, thence S. 47 E, 26 chains to James Morris line, to a sandstone, seventeen inches long 8 in. wide and 4 in. thick for which a Black Oak 8 in. dia. bears N 49oW. distant 19 links and a B. Oak 11 in. dia. bears N. 19o E. distant 14 links to a B. Oak 8 in. dia. bears N. 88o W. distant 40 links, thence bounding on said Morris line North 43o E. 22 chains and 22 links to a sandstone 10 in. long, 8 in. wide and 3 in. thick set on Thomas McCabe's line, from which a B. Oak 10 in. dia., bears S. 19o E. distant 35 links and a B. Oak, 4 in. dia. bears N. 32o E. distant 17 links, thence N. 47o West bounding on said McCabe line, 36 chains to the place of beginning containing 80 acres, it being the same tract of land conveyed by Miles A. Gilbert and wife to Peter Kline by deed dated 30 day of November 1857.

To have and to hold the above described premises unto the said party of the second part, his heirs and assigns forever, and the said party of the first part truly agreeing to ... and forever ... the same unto the said James McCabe, his heirs and assigns forever.

Be it remembered that on the 4th day of September 1858 before me the undersigned Justice of the Peace of the within State and County aforesaid this day came Peter Kline and Elizabeth his wife who are personally known to me as the persons whose names signed to the foregoing deed as having executed the same and they acknowledged that they signed sealed and delivered said deed freely and voluntarily for the use and purposes therein mentioned the said Elizabeth wife of the said Peter Kline being by me made acquainted with the contents and effect of said deed and by me examined separate and apart from her said husband she acknowledged that she executed this deed and relinquished her right of dower in the premises therein described and set forth freely and voluntarily and without the compulsion of her said husband.

Given under my hand and seal the day and year the first above written.

28 July 1862

This indenture made the twenty-eighth day of July eighteen hundred and sixty-two between James McCabe of the County of Ste. Genevieve and State of Missouri of the first part and Per[r]y C. Evans of Perry County and State of Missouri of the second part.

Witnesseth that the said party of the first part in consideration of the sum of ninety-eight 85/100 dollars lawful money of the United States to him duly paid, has sold and by these presents does grant and convey to the said party of the second part his heirs and assigns all that certain piece or parcel of land situate and lying in the County of Ste. Genevieve and State of Missouri being part of the James Maxwell survey 1862 being the same track sold by Miles A. Gilbert to Peter Kline by Deed dated November the thirtieth Eighteen hundred fifty-seven, filed for record August the 10th one thousand eight hundred and fifty-eight and sold by Peter Kline to James McCabe by deed dated September fourth eighteen hundred and fifty-eight filed for record September the Seventh 1858 eighteen hundred and fifty-eight with the appurtenances and all the estate title and interest of the said party of the first part therein.

This grant is intended as a security for the payment of ninety-eight 25/100 dollars with interest at the rate of ten per cent per anum from date until paid, which note is of even date with this instrument which payments if duly made will render this conveyance mull and of default shall be made in the payment of the principal or interest above mentioned the said party of the second part and his assigns are hereby authorized to sell the premises above granted or so much thereof as will be necessary to satisfy the amount then due with the costs and expenses allowed by law provided that sixty day’s notice be given before the day of sale.

In Witness whereof the parties of the first part to these presents have set their hands and seals the day and year first above written.

Be it remembered that James McCabe and Sarah Ann his wife who are personally known to the undersigned a Justice of the Peace within and for the said County to be the persons whose names are subscribed to the within or foregoing deed as parties thereto this day appeared before me and acknowledged that the executed and delivered the same as their voluntary act and ... for the uses and purposes therein contained and the said Sarah Ann being by me made acquainted with the contents of said deed acknowledged on an examination apart from her said husband that the executed the same and relinquishes her dower in the real estate, therein mentioned freely and without compulsion or undue influence of her said husband.

Given under my hand this 28th July 1862.

This deed of Mortgage made and entered into this 8th day of April A. D. 1864 by and between James McCabe and Sarah Ann McCabe his wife of Ste. Genevieve County, as of the first part and R. M. Brewer of Perry County of the second part. Witnesseth that the said parties of the first part in consideration of the better security ... of the money specified in the promissory note hereinafter ... in consideration of the sum of one dollar as on hand paid by said R. M. Brewer, the receipt whereof is hereby acknowledged, do by these presents bargain, sell, convey and confirm unto the said party of the second part his heirs and assigns forever.

The following described real estate, lying and being in Ste. Genevieve County, Missouri and described as follows, to wit:

For a certain piece or parcel of land, situate lying and being in the County of Ste. Genevieve in the State of Missouri, the St. Mary, or Marshall tract in survey Number 1862 and know and described as follows to wit:

Beginning at a limestone, set at the North Western corner of a tract of land sold by Miles A. Gilbert to Thomas McCabe, said limestone is about 24 inches long and 4 inches thick from which a B. Oak 8 in. in dia. bears N 65oEast distant 84 links and a B.
