Last Will and Testament of Mark Manning

In the name of God Amen, I Mark Manning of the County of Perry in the State of Missouri being weak in body, but of sound and perfect mind and memory blessed be almighty God of t he same; do make and publish this my last will and Testament, in manner form following to wit;--

First I will and desire, that all my Just debts shall be paid;

Next I give and bequeath unto my wife Margareth during her natural life only; all the rest of my property real personal and mixed, consisting of my plantation slaves, stock household and Kitchen Furniture, farming utensils and crop and all other necessaries; She is to pay unto my two daughters Clare and Matilda, each when they leave her, a horse creature, a cow, a bed and such necessaries as the other children has generally been helped to when they left us.

Next, I give and bequeath unto my youngest son, John and to his heirs and assigns for ever after the death of his mother, my land, the plantation where on I now live, next after the death of my wife, I will and direct that my Slaves and the increase of any Shall be sold to the highest bidder among my heirs only; and the rest of the perishable property sold to the best advantage; and the proceeds of all the sales equally divided among all my children.

I hereby appoint my two sons, Alexius and Cornelius Executors of this my last will and Testament ; hereby revoking all former Wills by me made.

In Testimony whereof I hereunto set my hand and seal this Sixth day of September in the year of our Lord, one thousand eight hundred and thirty six.

Proof of Will

Be it remembered, that on the 15th day of October in the year of our Lord, 1836, ten came Isidore Moore and Larkin Abernathy, the subscribing witnesses, to the foregoing last will and Testament of Mark Manning, late of Perry County deceased and made oath on the Holy Evangely of the Almighty God, that they did see the Testator therein named, sign and Seal this Will by making his mark, thereto, that they heard him publish, pronounce & declare the same to be his last will and Testament, that at the Time of his so doing he was to the best of their apprehension of sound and disposing mind memory and understanding, and that they subscribed their names as witnesses to this will in the presence of, and at the request of the said Mark Manning the Testator and in the presence of each other.

Certificate of Probate

In the Probate Court

Know all men by these presents, That we Alexius Manning as principal and James I. Moore & Charles C. Ellis as Securities of the County of Perry and State of Missouri, are held and firmly bound to the State of Missouri in the Sum of three Thousand Dollars of lawful money, for payment whereof, will and truly to be made and done, we bind ourselves, our heirs Executors and administrators, jointly and severally, firmly by these presents, Sealed with our Seals this 14th day of June A. D. one thousand eight hundred and fifty-five. The condition of the above obligation is s uch that if Alexius Manning Executor of the Last will and Testament of Mark Manning Deceased Shall faithfully administer said Estate, account for pay, and deliver all money and property of said Estate, and faithfully execute the Last will and testament of Said deceased pay the debts and legacies as for the assets will Extend, and the law direct render just accounts and faithfully perform all other things touching said executorship required by or the order or decree of any court having jurisdiction where the above bond to be void and of no effect otherwise to remain in full force.

Letters of Testamentary

Know Ye that the Last will and Testament of Mark Manning deceased hath in just form of law been exhibited proven and recorded in the office of the Clerk of the County Court for Perry County a copy of which is hereto annexed, and in as much as it appears that Alexius Manning have been appointed executor in and by the last will and testament of Mark Manning Decd. to execute the same and to the end that the property of the testator may be preserved for those who Shall appear to have a legal right or interest therein and that the said last will may be executed according to the request of the testator we the County Court of Perry County in the State of Missouri do hereby authorize him the said Alexius Manning as such Executor to collect and secure all and singular the good & Chattles, rights and credits which were of the said Mark Manning at the time of his death in whomsoever hands or possession the same may be found and to perform and fulfill all such duties as may enjoined on him by said will so far as there shall be property and the law charge him and in general to do and perform all other acts which are or hereafter may be required of him.

In testimony where of I Henry J. Burns Clerk of the County Court in and for the County of Perry hereto sign my name and affix the Seal of said Court at office this 14th day of June A. D. 1855.

The Rankin Family History Project began in 1997 with a simple 3 generation family chart.   Inspiration came from our grandmother who has shared a lot of great stories and really got us going when she loaned us her copy of Maryland Catholics on the Frontier by Timothy O'Rourke;   and also from Alex Haley, whom we had the pleasure of meeting shortly before Roots was published.   This site is dedicated to our great-grandparents.   Without them, we would not be here.
