Last Will and Testament of August Klump

I August Klump, of the County of Perry, State of Missouri, being of Sound mind and disposing memory, do make, publish and declare this my last will and testament.

1. I direct that all my Just debts, my funeral expenses and the expenses of my last illness be first paid, and if possible out of my funeral estate.

2. It is my will, and I hereby direct my hereinafter named Executor to sell all of my personal property at public sale and in the same manner and upon the usual terms as such property is usually sold under its Administration Laws of the State of Missouri.

3. It is further my will and I hereby direct my said Executor to sell all my real estate at public sale at the East front Door of the Court-House in the City of Perryville, Perry County Mo. at such time as my hereinafter named executor shall think best first having given due notice of the time, terms and place of sale and of the property to be sold for four weeks in some newspaper printed and published in Perry County, Missouri, requiring ten per cent of the purchase money to be paid in cash on the day of sale drawing interest from date of sale until paid at the rate of six per cent per annum the purchaser giving note with good and sufficient securities for the remainder of said purchase price. Upon full compliance with the terms of sale, my said Executor shall make to said purchase or purchases a good and sufficient deed for the premises bought by them.

4. After all of my real and personal property has been sold by my said Executor as above directed and all my money & notes and accounts, and the proceeds of the above mentioned sales by my said Executor have been collected in, and after all the disbursements as directed in the first paragraph here of have been made out of the moneys thus collected in by my said Executor, Then it is my will and I hereby direct that the remainder thereof be divided among my children and grand-children in the following manner, to wit:

To my daughter Theresia May, wife of Wm. L. May, one Seventh thereof;

To my son John Klump, one seventh thereof;

To my son Emil Klump, one seventh thereof;

To my daughter Annie Maddock of George Maddock, one seventh thereof;

To my son, Frank Klump, one seventh thereof;

To my Mary McCauley, wife of James M. McCauley, one seventh thereof;

To my grand- children son Cletis Klump, son of Leo Klump deceased, one fourteenth thereof, and to my grandson Jerome Klump son of said Leo Klump deceased one fourteenth thereof,

5. I do hereby appoint Peter Hoffman executor of this my last Will and Testament, hereby revoking any and all former wills by me made,

Signed, published and declared by the above named August Klump to be his last will and testament in the presence of us, who at his request and in his presence, and in the presence of each other her hereunto subscribed our names as witnesses thereto.

Proof of Will

In the matter of proving the last Will and Testament of August Klump, late of Perry County Missouri, on this 18th day of June 1907 before me John F. Baumann Judge of the Probate Court, within and for the said County personally came Louis Doerr and J. J. Mayfield who being by me duly sworn on their oaths say:

That they were present and saw August Klump sign the forgoing instrument purporting to be his last will and testament and heard him publish and declare the same to be his last will and testament, and that at the time of signing and publishing the same, the said August Klump was of sound and disposing mind and that these deponents subscribed their names thereto as witnesses to the same in the presence and at the request of the testator and in the presence of each other.

Certificate of Probate

In the Probate Court of Perry County Missouri,

I, John F. Baumann Judge of the Probate Court, of Perry County, having examined the foregoing instrument purporting to be the last will and testament of August Klump, and having heard the testimony of Louis Doerr and J. J. Mayfield the subscribing witnesses thereto in relation to the execution of the same, do declare and adjudge said instrument to be the last will and testament of August Klump late of Perry County deceased.

In Testimony whereof I have hereunto set my hand affixed the seal of the Probate Court of Perry County Mo., this 18th day of June 1907.

Executors Bond and Oath

Know all men by these presents, that we, Peter Hoffman as Principal, and John P. Clark, Thos. L. Phillips & Chas. G. McBride as securities are held and firmly bound unto the State of Missouri in the sum of Ten Thousand Dollars, for the payment of which we bind ourselves, our heirs, executors and Administrations, sealed with our own Seals of Perryville Missouri, this 19th day of June 1907.

The condition of the above Bond is That if Peter Hoffman the Executor of the last Will and Testament of August Klump deceased shall make a perfect inventory of the Estate and faithfully execute the last will of the said Testator, pay the debts and legacies as far as the assets will extend and the law direct, render Just accounts, pay and deliver all money and property of said estate and perform all other things touching the execution of said last will and testament required by law or the order or decree of any Court having Jurisdiction then the above bond to be void otherwise to remain in full force.

I hereby certify that the within bond was signed and executed in my presence and approved by the Court this 19th day of June 1907.

Letters Testamentary

The State of Missouri, to all persons to whom these presents shall come Greeting:

Know Ye that the last Will of August Klump deceased hath in due form of law been exhibited, proved and recorded and a copy of such is hereto annexed; and inasmuch as it appears that Peter Hoffman has been appointed Executor in and by said last Will to execute the same, and to the end that the property of the Testator may be preserved for those who shall appear to have a legal right or interest therein, and that the said last Will may be executed according to the request of the testator, we do hereby authorize him the said Peter Hoffman as such Executor to collect and secure all and singular the goods and chattels, rights and credits which were of the said August Klump at the time of his death in whosesoever possession the same may be found, and to perform and fulfill all such duties as may be required upon him by said Will so far as there shall be property and the law charges him fully therewith; and in general to do and perform all other things which now are & hereafter may be required of him by law.

In testimony whereof I, John F. Baumann, Judge of the Probate Court in and for said County of Perry have here unto signed my name and affixed the seal of said Court at office this 19th day of June 1907.
