A Peculiar Will Case Monday Very Rev. John R. Din- nen, executor of the will of Sarah Beg- ley, filed a petition asking for its con- sruction. P. F. Roche, the St. Joseph oprhan asylum. Sisters of St. Francis and other organizations are made de- fendants. Father Dinnen has all the funds of the estate in his possession and is ready to make distribution as soon as so ordered. Mrs. Begley was an in- mate of St. Elizabeth hospital for some time and bequeathed something to that institution. In her will she provides for two requiem funded masses and gives $1000 for the purpose, the masses to be celebrated in St. Mary's as long as that church exists. It is a rule of the church that a requiem mass, celebrated as long as the church exists, shall cost $500. Father Dinnen has found that there is not enough money in the estate to pay all bequests and asks the court to decide how it shall be pro rated. The ???? of the church says that any reduc- tions ??? the $1,000 will annul the be- quest for masses. The executor seeks to learn whether the Indiana law sanc- tions bequests for requieum masses. If the court holds that the bequest for masses can not be enforced the money will then be divided among the other heirs. It is a nice law point for Judge DeHart to decide.
