Since writing this first story, have found much more information on Claiborne's brother William Eson Smith.

CLAIBORNE M. SMITH was born on
6 June 1828 Jackson County, Alabama
His Father was Thomas Smith
Thomas Smith's parents were probably John and Rebecca Smith
of Jackson Co. Alabama.
Claiborne's mother was Febary (Pharaby)Tackett
Febary Tackett's parents were Langston and Polly Tackett
per Henry W. Smith's Confederate Civil War Pension Records.
Henry W Smith was Claiborne Smith's brother.
NOTE:
Actually I believe the name Langston was misspelled on the papers
and should be Lewis Tackett. Polly was Mary Elizabeth Basham. Mary is
often called Polly.
The Tackett Association does not recognize Febary Tackett as being
from this family, even though she named two of her sons after the
Tackett family men (Pleasant and Martin Tackett Smith).
Her brother Martin Tackett is acknowledged as belonging to the
Tacketts.
Martin Tackett's wife and almost all his children were killed in the
Mt. Meadows Massacre. Martin was deceased before 1857 and was not in
the massacre. Will write about this incident later.
I told the Tackett Association of Henry W. Smith's Confederate War
records and that this information was listed in the 1911 Arkansas
Confederate Soldiers Census. I do not have the original copy of these
records, so did not contact them further.

Claiborne married Margaret Jane Mackey ca 1850, probably in Searcy
County,Arkansas.
1850 Searcy Co. AR. Census, Tomahawk Township, Visit 87-88.
Margaret Jane Mackey's father was
James Mackey and, as I understand it, James Mackey is in the
History of Searcy County Book.
Margaret Jane Mackey's mother is said to be Anna Bennett?
1860 Searcy County, Arkansas Census, Campbell-Calf Creek Township,
Visit 262-255.

Claiborne was a member of the Peace Society, a secret
organization, thought to be pro-Union in Searcy County, Arkansas
(Arkansas was then a Confederate State).
After November 1861 Governor Rector ordered members of this Peace
Society marched to Fayetteville in chains and accused these men of
insurrection or treason.
The men were ordered to join the Confederacy "or else".
Several refused and were later tried and released. Many fled the state
to join Union forces in Missouri.
Claiborne Smith is listed as joining Cockes CSA, Co. G. 35th Arkansas
Infantry(no date).
He apparently deserted and went back to Searcy County.

On or about 3 Jan 1863 on Buffalo Fork of the White River, Arkansas
proceedings of a General Court Martial assembled at the camp of
4th Division, First Corps Trans-Miss Army on Buffalo Fork of the
White River. Headquarters of C.S. Forces en route to Missouri.
Several men were accused of firing on Confederate Forces.
Among the cases tried were:
Jeptha McGinness, Private, Co. A, Heads (sic)Battn
M V B Hensley, Private, Venable's Co. Shoup's Division
George Carter, Private, Co. H, McRaie's Regiment
John Smith, Private Co. A, Williams Regiment, AR Infantry
(do not know if this was Claiborne's brother John Smith)
C.C.Kilgore, Private, Titsworth's Co. Armstrongs or Carroll's Reg. AR.

Claiborne Smith and
Edmund Aday, citizens of Searcy County, Arkansas.
"The court then proceeded to trial of another case.
Prisoner Claiborne Smith called.
The order convening the Court having been read the accused was asked if
he objected to any member and he having answered that he had not, the
Court was duly sworn by the Judge Advocate and the Judge Advocate was
duly sworn by the President of the Court in the presence of the
accused. The accused was then arraigned by the Judge Advocate on the
following Charge and Specification viz:
Charge & Specification preferred against Claiborne Smith a citizen of
Searcy County Arkansas States. Charge: Treason.
Specification in this that he Claiborne Smith a citizen of Searcy County,
Arkansas in the Confederate States did form one of a band unlawfully
organized to resist the execution of the laws of the Confederate States
which band did on the second day of January 1863 resist and did fire
upon a body of Confederate troops while on the proper discharge of
their duties when one Confederate soldier was shot and killed.
All this in Searcy County, Arkansas on the Boston Mountains.

The accused was then asked by the Judge Advocate to make his plea to
which the accused pleas as follows:
To the Specification "Not Guilty" To the Charge. "Not Guilty" witness
William Smith called and duly sworn.
Question by the Judge Advocate:
What do you know of the accused Claiborn Smith?
Answer: I know but little of him lately-didn't know he was with Taylor's
band. Didn't see him when taken prisoner by Confederate troops. But
when the militia of Searcy County were called out last year I knew he
was searched for and could not be found, and the general report was
that he was in Secret bands which was organized in the County to rob
and murder and was then concealed.
When he lived near me he was a Unionist and still goes with that
character.
The witness was here dismissed and the prisoner having no witnesses
for his defence made the following statement:
"I was with Taylor's band but had no arms and didn't drill with them.
I ran when we were pursued by the Confederate States troops. I walked
from home 7 miles away to see Taylor's men but had no idea of joining
them".
Prisoner was here dismissed and the Court being closed after mature
deliberation finds Claiborne Smith by a two-thirds vote of the
Specification "Guilty" of the Charge "Guilty" and the Court did
thereupon sentence Claiborne Smith a citizen of Searcy County Arkansas
to be shot to death.

Claiborne Smith somehow escaped and fled to Missouri
and joined Co. H, First Arkansas Cavalry (Union Army)
on 27 August 1863 in Berry County, Missouri. He was a bugler.

Found the Claiborne Smith family on the 1870 Christian County, Missouri
census.
They apparently went back to Searcy County about 1878.

Claiborne's brother Henry W. Smith was in Confederate Army during
Civil War and by sending for Henry's pension record, found out the
parents names. Henry filled out that 1911 Confederate Questionnaire.
Henry W Smith was great-great grandfather of Evelyn Flood's children

married Mary F. Millican about 1878 in Searcy County, Arkansas.
No children. Nothing further known.

(2) Esau "Old Ece" Smith
born 11 July 1852
married Nancy Jane Smith Flood in 1887 in Newton County, Arkansas
Nancy was widow of William Flood( Nathan and Mary Polly Jones family).

i: Rose Ann Smith who married (1)Joseph Flood and
(2)Grover Cleveland "Cleve" Pierce.
ii: Rosco "Ross" Argus Smith who married Anna Lee Nichols

Three infant children who are buried in Smith Cemetery, Newton County
Arkansas
Many descendants still live in Newton County.
Esau died 3 April 1914 and is buried in Smith Cemetery, Newton County,
Arkansas.

born 27 Jan 1854 in Searcy County, Arkansas
married Martha L TUCKER ca 1878 in Searcy County, Arkansas.
Henderson's children were:

married Joseph C Smith (first cousin), son of James Calvin,
brother of Claiborne Smith). They moved to Oklahoma.

William J Cole was the son of Dennis Cole and his first wife
Martha HICKS.
Dennis Cole had been Newton County, Arkansas Court Clerk from
1860-1864 and 1872-1874.
After wife Martha's death, Dennis married (2) Malinda Young
and (3) Susan Ellen Stepp.
Dennis Cole was born in 1828 in Benton County, Tennessee
He was son of William and Ann Cole
Dennis Cole was the father of:

Ferby Ann Smith Cole died 9 July 1916 at McCurtain, Oklahoma.
It is thought that William J Cole died on 28 February 1916 in Osage
County, Oklahoma and is buried in Big Heart, Oklahoma. William was
a doctor. He drank carbolic acid poison and died. He and Ferby Ann
were separated and lived apart.

(9) Diansa Smith
born May 1870 in Missouri.
Nothing further known. Apparently died as an infant.

Do not know if Margaret Jane Mackey Smith died or if they were divorced.
It is said they divorced in 1888?

Claiborne Smith married Sarah "Sally" Atkinson Bolin on 22 June 1899
in Newton County, Arkansas. Sarah was divorced from John Bolin in 1885.

1900 Newton County, Arkansas finds Claiborne living with son Esau(Eson)
"Old Ece"Smith in White Township, Visit 216-229.

Claiborne M Smith died 8 August 1901 with burial in Smith Cemetery in
Newton County, Arkansas.
His widow Sarah Atkinson Bolin Smith drew his
Civil War Pension until her death in 1928. She is buried in Yardell
Cemetery, Newton County,Arkansas.
