Bowen, Samuel Prather, John Coombs be appointed commissioners to make division of eighty acres of land to be taken from the farm whereon the said Jacob Daily (could not decipher words), between Jacob Daily, Mahala Daily, Philip Daily, and Mary Ann Daily and that they divide the same by metes and bounds equally between said heirs agreeable to the will of said Jacob Daily and they make their report to the next term of this court.  The above order was made by the admission of David W. Daily guardian adlitem of said heirs.

Upon this date {22 Apr 1851} it was proved by two calitable witnesses that James M. Dailey, alias Meredith Dailey, who was a private in Captain Green's Company, 5th Regiment, Indiana Volunteers in the war against Mexico died in Clark Co., IN on or about the 2nd of May 1850 and that he was a pension of the U.S. at the rate of $8.00 per month and left surviving him, a widow whose name is Rachael Daily.

Dailey, Philip Dailey and Eli Dailey the Executors named in said will.  Executors of same is granted to them upon their entering into bond in the sum of $1000 with Benjamin Ferguson their security.

Koons guardian of heirs of Philip Daily decd, filed the following report accompanied by the proper ?? to wit:     State of Indiana, Clark County: In the Clark Circuit Court September term 1875.  In the matter of the guardianship of the minor children of Philip Daily decd: “To the Honorable Clark Circuit Court I Isaac M. Koons Guardian of John M. Daily, Sarah L, Daily, Jacob B. Daily and David V. Daily (the next 3 words were cut off page)

I made my last report at the June Term 1873 at at (illegible) time I was charged at to unto belonging to said heirs jointly                                                                     $1558.78

I have paid unto the joint account of said wards as per voucher No. 1 to Jr. L. Ingram Clerk          1.50     $1557.28 of said sum of $1557.28 each of said heirs is entitled to ¼ stre??? And said voucher and report being examined by the Court are allowed and approved by the Court.  And the Court Being satisfied by due prood that said Sarah L. has intermarried with Edwin Laduke as in said report stated and that said Sarah L. has married from her said guardian all her portions of said estate as appear by the receipt of hers ? and husband filed with the report said guardian is discharged from said trust ask said Sarah L.  (the rest of this is missing.  It must have been left off entry book)

New at this time upon the application of Isaac M. Koons for letten? Of guardianship in the person and estate of John M. Daily it appearing to the Court that said Daily is a person of ? ward mind, and therefore the Court doth appoint said Koons who enter upon executes and vites his bond payable to the State of Indiana in the sum of Fourteen Thousand Dollars with Fielding Coombs and David S. Koons as sureties which said bond is now approved by this Court and said guardian after having taken the usual oath prescribed by law was legally granted said guardianship.

   

Ordered that Court do now adjourn until tomorrow morning at 8 ½ o’clock

               I, Isaac M. Koons, guardian of John M. Daily, Sarah L. Daily, Jacob B. Daily and David V. Daily, present the following exhibit of my proceedings in said trust. I am chargeable with amt received for said wards from Henry J.      This Indenture made and entered into this twenty third day of March in the year of our lord one Thousand Eight hundred and forty six by and between John Overman and Susan his wife and Joseph Overman and Elizabeth his wife all of the County Clark and State of Indiana of the one fron and David Baldwin of the state and county aforesaid of the other part--Whereforth that the said John Overman and Susan his wife and Joseph Overman and Elizabeth his wife have hereby granted bargained and sold and by these presents do hereby bargain sell convey and confirm unto the said David Baldwin his heirs and assigns all their right title and interest in and to a certain tract or parcel of land for and in consideration of the sum of eighty dollars good and lawful money to them in hand paid by the said David Baldwin the receipt whereof is hereby acknowledged said tract and parcel of land situated and being in Charlestown Township, Clark County, Indiana and known designated on the map of Clark's Grant is of survey Number one hundred and ninety six (196) said tract or parcel of land containing one hundred and eighty eight acres of land, thirty six acres of which land was deeded to Joseph Overman deceased by James C. Caldwell Collector of the Revenue in and for the County of Clark and State of Indiana bearing date of the twenty fourth day of December A.D. 1827 and one hundred fifty two acres deeded by said James C. Caldwell to said Joseph Overman heirs bearing date of the second day of December A.D. 1830 now the said John Overman and Susan his wife and Joseph Overman and Elizabeth his wife for themselves, their heirs adminstrators and assigns hereby relinquish all their right title and interests in and to the above described tract of land together with all and singular the appurtenances there unto belonging or in anywise appertaining unto the said David Baldwin his heirs administrators or assigns to have and to hold for his or their only proper benefit and behalf forever.  In witness whereof we hereto set our hands and affixed our seal the day and year above written.

     This Indenture made and entered into this fourth day of June in the year of our Lord one thousand eight hundred and forty seven by and between John Overman and Susan his wife all of the County of Clark and State of Indiana of the one part and Joseph Overman of the state and county aforesaid of the other part.  Witnesseth that the said John Overman and Susan his wife have hereby granted bargained and sold and by these presents do thereby bargain sell convey and confirm unto the said Joseph Overman his heirs and assigned all their rights title and interest in and to a certain tract or parcel of land for and in consideration of the sum of Forty Dollars good and lawful money to them in hand have by the said Joseph Overman the receipt wherefore hereby acknowledged said tract and parcel of land situate and being in Charlestown Township Clark County Indiana and knows and designated on the map or plat of the Illinois Grant U.S. of Survey and Number one hundred and ninety six (196) said tract or parcel of land containing one hundred and eighty eight acres of said land be the same more or less, thirty six acres of which land was deeded to Joseph Overman Deceased by James C. Caldwell Collector of Revenue in and for the County of Clark and State of Indiana bearing date of twenty fourth day of December A.D. 1827, and one hundred fifty two acres deeded by said James C. Caldwell to said Joseph Overman heirs bearing date of second day of December A.D. 1840 now the said John Overman and Susan his wife for themselves their heirs administrators and assigns hereby relinquish all their right title and interest in and to the above described tract of land together with all and singular the apptune names thereunto belonging or in anywise appertaining unto the said Joseph Overman his heirs administrators and assigns to have and to hold for his only proper benefit and behalf forever.   In witness whereof we have hereto let our hands and affix our seals this day and year first above.

Overman in consideration of the sum of one dollar in hand paid by John Tibbetts do hereby remise, release and forever quit claim unto the said John Tibbetts his heirs and assigns forever all our title interest and estate legal and equitable in the following premises with the appurtenances situate in and bounded and described as follows:  A tract of parcel of land in the Illinois Grant in Clark County State of Indiana being part of Survey No. (196) and part of the land owned by Joseph Overman Deced.  Beginning at 2 poplar stumps in the Jacksonville road and the west corner of gohilipys (?) land in said No. thence North 40 West along said Road 86 to poles to a stake thence South 50 West 55 poles is the Beginning to contain twenty nine and three fourths of acres of land (29 3/4) of land.  In testimony whereof we have hereunto set our hand and seals this 30 day of November A.D. 1848.

Daily and Rachell his wife all of the County of Clark and State of Indiana of the one part and David Baldwin of the State and County aforesaid of the other part.  witnesseth that the said Levi Amick and Sarah his wife and Thomas Daily and Rachell his wife have hereby granted bargained and sold and by these presents do hereby bargain sell convey and confirm unto the said David Baldwin his heirs and assigns.  All their right title and interest in and to a certain tract or parcel of land for and in consideration of the sum of eighty dollars good and lawful money to them in hand paid, by the said David Baldwin, the receipt whereof is hereby acknowledged said tract and parcel of land situate and being in the County of Clark and State of Indiana and known as designated on the map of Clark grants as a Survey number one hundred and ninety six (196) said tract or parcel of land containing one hundred and eighty eight acres of land.  thirty six acres of which land was deeded to Joseph Overman Decd.  By James C. Caldwell Collector of the State and County Revenue of Clark County bearing date of the twenty fourth day of December A.D. 1827 and one hundred and fifty two acres deeded by said James C. Athon, his heirs and assigns forever.  All our rights, title, interest and estate legal and equitable in and to the following premises with the appurtenances situate in the Illinois Grant in Clark County and State of Indiana and bonded as follows, a tract or parcel of land being a part of Survey Number One hundred and ninety six (196) and that part owned by the said Joseph Overman Sr. deced. and where he lived and died and where his widow now lives and has a lifetime estate, said tract containing two hundred and sixty eight acres be the same more or less.  To have and to hold the said premises to his only proper use benefit and behalf forever.  In testimony where we the said John Daily and Mary M. Daily his wife have hereunto at their hands and seals this twenty second day of September A.D. 1852.

Personally appeared before me Joseph Boyer, Recorder in and for the county and state aforesaid John Daily and Mary Daily his wife the grantors in the ____indenture and acknowledge the same to be their voluntary act and deed for the uses and purposes therein expressed.  The said Mary being examined by me privately separate and apart from and without the hearing of her husband after the portents and purpose of said deed was fully made known and explained to her she ____ that she ____ the same of her own free will and without coercion compulsion from her husband.  Witness my hand and official seal this 24 day of September A.D. 1852.
