This indenture made and concluded upon this seventh day of April one thousand and six between JOSEPH HUGHEY of the County of Buncombe and State of North Carolina of the one part and LEWIS RECTOR of the County and State aforesaid of the other part. Witnesseth: for and in consideration of the sum of one hundred dollars to him in hand paid by the aforesaid LEWIS RECTOR the receipt whereof the said JOSEPH HUGHEY doth hereby acknowledge he the said JOSEPH HUGHEY hath bargained, granted, sold, alined, confirmed and by these presents doth grant, bargain, and sell aline and confirm unto the said LEWIS RECTOR his heirs and assigns for over all that tract and parcel of land containing an hundred acres lying and being in the County of Buncombe on the west side of French Broad River that part lies on a branch sitting into Sandy Mush Creek on the west side above the Old Station beginning upon a Spanish oak on a ledge running north one hundred and twenty seven poles, thence east one hundred and twenty seven poles, thence south one hundred and twenty seven poles, thence west one hundred and twenty seven poles to the beginning containing one hundred acres it being part of a large tract of land originally granted to THOMAS DAVIDSON and MARK MITCHEL with all and singular the appurtenances whatsoever to the said lands above mentioned belonging to or in anywise appertaining and also the remainder & premises and every part thereof and the estate rights, titles and interest claims and demands whatsoever to him the said JOSEPH HUGHEY of and to the said lands and premises and every part thereof to have and to hold the said lands and tenaments and all and singular the premises above mentioned and every part and parcel thereof with the appurtenances unto the said JOSEPH HUGHEY his heirs and assigns to the only proper use and behoof of the said LEWIS RECTOR his heirs and assigns forever the said JOSEPH HUGHEY for him and his heirs and the said tenaments and premises and every part thereof against him and his heirs and assigns to all and every other person and persons whatsoever to the said LEWIS RECTOR his heirs and assigns shall and will warrent and forever defend by these presents signed, sealed and delivered in the presents of us.
