STATE OF NORTH CAROLINA MADISON COUNTY This indenture made and entered into this 17th day of May A.D. 1897 by and between R.F. RECTOR of Madison County aforesaid party of the first part and J.J. REDMON of Madison County in said State party of the second part and J.E. RECTOR of Madison County and State aforesaid, party of the third part, Witnesseth for that whereas the said R.F. RECTOR is indebted to the said J.E. RECTOR in the sum of two hundred and twenty dollars for which the said R.F. RECTOR has executed and delivered to said J.E. RECTOR as aforesaid his hand of even date with this deed, in said sum of two hundred and twenty dollars payable on the 17th day of May 1898, with interest therefore from date until paid, at the rate of six per centum per annum payable annually on the 17th day of May, hereafter and it has been agreed that the payment of said debt shall be secured by the conveyance of the land herein after described. Now therefore, in consideration of the premises and for the purpose aforesaid and for the sum of one dollar to the party of the first part paid by the party of the second part aforesaid said R.F. RECTOR have bargained, sold, given, granted and conveyed and by these presents do bargain, sell, give, grant and convey to said J.J. REDMON his heirs and assigns, a certain tract of land lying and being in Madison County aforesaid and more particularly described and defined as follows: One tract of land containing twenty five and one half acres adjoining the lands of J.E. RECTOR, J.M. GUDGER JR., HIRAM RECTOR and heirs of JOEL RECTOR for a full description of which reference is made to a deed from J.J. GUDGER to R.F. RECTOR containing twenty five and one half acres more or less and to include all the lands now owned by the party of the first part. To have and to hold said land and premises with al the rights, priveleges and appurtnenances thereunto belonging to him said J.J. REDMON his heirs and assigns, upon the trusts and for the uses and purposes following and none other: That is to say; If the said R.F. RECTOR shall fail or neglect to pay the interest on said bond as the same may hereafter become due, or both principle and interest at the maturity of the bond or any part of either then, an application of said J.E. RECTOR assigned or other person who may be entitled to the moneys due thereon it shall be lawful for and the duty of the said J.J. REDMON to advertise in some newspaper published in said County or by posters if there be no newspaper the aforesaid land for a time not less than thirty days therein appointing a day and place of sale and at such time and place to expose said land at public sael to the highest bidder for cash to pay said debt and interest and the ccosts and expenses of sale and upon such sale to convey title to the purchase said J.J. REDMON first retaining the usual compensation received by trustees for making such sale and out of the proceeds of such sale shall apply so much of the residue as my be necessary to pay off and discharge said bond and all interest there accrued and due thereon and shall pay the surplus if any remain to said R.F. RECTOR. And it is stipulated and agreed that if the said R.F. RECTOR shall pay off said bond and interest and discharge fully the trusts herein declared this deed shall be null and void, otherwise to be in full force and virtue and the said parties of the first part covenant with the parties of the secon adn third parts hereto that they are seized in fee simple of the before described lands, that the same are free from all incubmances adn that they will forever warrant title to the same against all lawful claims. In testimony whereof the said R.F. RECTOR do hereby subscribe their respective names and affix their several seals. R.F. Let the same with this certificate be registered this 7th day of May 1897. M.H.
