This indenture made the 12th day of June A.D. 1858 between MICAJAH RECTOR of the first part, J.J. GUDGER of the second part, and B.I. SMITH and A.E. BAIRD of the third part, Witnesseth that whereas the said MICAJAH RECTOR is justly indebted to the said SMITH & BAIRD the sum of ninety one dollars and eight six cents dated 1st May 1838, and an unsettled balance on another note and accounts, about fifty dollars, us on reference to a certain note or notes will more fully appear, and being desirous to pay said debts or accounts, this indenture witnesseth, that for and in consideration of the premises with the further sum of one dollar to the said MICAJAH RECTOR in hand paid by the said J.J. GUDGER the receipt whereof is hereby acknowledged, hath hereby granted, bargained and sold to the said J.J. GUDGER his heirs and assigns forever the following tract of land in the County of Buncobme bounded as follows viz.: Beginning at a stake, the south east corner of fifty acres granted to W. LUNSFORD, and runs west along the south end line of the before mentioned tract of fifty acres, fifty poles to a stake near the branch REDMOND did live on, on the line of the old W. LUNSFORD or THOS. HARRISON grant tract, then south with that line on the NETTLETON line eighty poles to a stake on the line of old tract NETHERTON lives on, originally granted to THOS. FREEMAN, then east and with that line ninety poles to a stake near the SILAS JONES line and on the top of a ridge dividing Turkey Creek and Sandy Mush, then northward and along the meanders of said ridge one hundred and ten poles to a stake on the top of said ridge, then west forty poles to a stake on the line of the first fifty acre tract, then with that line twenty poles to the beginning. Also, one gray horse, and two cows and calves. To have and to hold said land and property with every appurtenance thereunto to be longing or appertaining forever. In special tract, however, that the said J.J. GUDGER, will keep and apply said land and property to the following and no other purposes viz: to pay the said debt with interest by the 12th day of June 1859. If this be not done and he be instructed by said SMITH & BAIRD he shall advertise the same thirty days at the Courthouse in Asheville and three other public places and then sell said land and property to the highest bidder for cash, retain from the proceeds his own necessary cents, and apply the balance to the payment of said debt, and if any surplus remain, to pay it over to said M. RECTOR his heirs or assigns. Witness our hands and seals, day and date first above written. Signed, sealed and delivered in the presence of ELIHU RECTOR.
