In the matter of the Will of M. Cochran deceased

The paper writing herewith attached purporting to be the last will and testament of M. Cochran deceased is presented to the undersigned Clerk of the Superior Court and the following proof thereof was taken by the oath and examination of N.F. Leatherman and W.C. Hamrick the subscribing witnesses thereto as follows:

N.F. Leatherman and W.C. Hamrick being duly sworn deposes and says and each for himself deposes and says, that he is a subscribing witness to the said paper writing now shown him, purporting to be the last Will and Testament of M. Cochran decd.. and that he saw the said M. Cochran sign the same or make his mark to the same, and at the time of his execution thereof that he heard him acknowledge the same to be his last Will and Testament and that the affiant attested it in the presence of and at the request of the said M. Cochran, deceased and at the time of the execution and acknowledgement thereof the said M. Cochran was of sound mind and deposing memory.

And whereupon it is considered and adjudged by the Court that the said paper writing and every part thereof is the last Will and Testament of the said M. Cochran of Swain County, North Carolina, being of sound mind and disposing memory, do hereby make do hereby make and publish this my last Will and Testament hereby revoking former Wills made by me. I Will and bequeath to A. Cochran and wife M.J. Cochran all of my property provided they take care of me my natural life.

I hereby appoint E.P. Gibson my executor to carry out this my last Will and Testament and authorize him my said executor to give out of my property at my death whatever he thinks just and proper to Ellen Herrin provided she stays with us and helps to care for me my natural life. August 5th, 1912.

Will of William Cochran:

ALOB, Vol. VIII #7, p. 87-99: "p. 71. 10 April 1841.. I, William Cochran, being very weak in body, but of perfect mind & memory. I give unto my two youngest sons Moses & Nathaniel 200 acres of land, 100 acres where we now live, the other tract adjoining Swan Cochran. I give unto my two daughters Jestin & Harriett 100 acres of land where on a trashing machine now stands called the Baseter tract to be equally divided between them. I give unto my daughter. Clara Rodgers one cow & calf. I give unto my two little grandchildren, children of E.B. Praytor a two year old cow brute a piece. I give unto my son Swan $5 and the balance of my property of stock, land, household & kitchen furniture I give unto Moses, Nathaniel, Jestin and Harriett, they are to take care of their mother and support her decently out of the same and I hereby make ordain Moses & Nathaniel Cochran executors. Wit; Thomas H. Burnett & E.B. Praytor.. Signed William X Cochran.. Proved on oath of E.B. Praytor in July Session 1841.."

D;42 JOHN REED, SENIOR, 9 July 1819, Sept. 1825. Sons: JOHN & ARCHIBALD REED plantation whereon I now live, at decease of my Negro man Ace. Daus. AGNESS FLESSON (FLESISON ?), MARTHA GUFFEY, LITTESSE COCKRAN & FANNY HOAD, $8 each & livestock. Also to FANNY HOAD large looking glass. Dau. JANE REED, horse, large trunk, small trunk, feath. Bed & furn., books. To servant Ace, my tract of land & all my farming tools, horses, cows, feather bed & furn. 1 large bed rug, 1 large pot, 1 small pot, 1 oven, 2 pot crooks, 1 set fire dogs, tongs & shovel, 1 large trunk, ½ dresser furn. during his life and at his death to be divided between my sons JOHN & ARCHIBALD REED. Will of Jane Reed:

D:111 JANE REED, 1 July 1829, Sept. Ct, 1829. Niece ELIZABETH GUFFEY all my plantation now occupied by HIRAM SMART, furn. and all other estate I die possessed of. Sisters: AGNES FLEMMING, MARTHA GUFFEY, LITITIA COCKRAN $3 each and to my Sister ELIZABETH GUFFEY, 1 cow and calf. “ I give and bequest unto free Ace ½ note I have on JAMES CHERRY when collected, 1 small cow, 1 piece shirting cloth, 10 pds. Wool, ½ bee hives, 1 demi john & 1 stone jug. Niece ELIZABETH GUFFEY bal. 1 still now in possession of WILLIAM JONES. Dau., USLEY QUEEN, mare, cattle. Extr: son EDWARD JONES. JAMES GUFFEY, son of JOHN GUFFEY $20 out of a $40 note on WILLIAM ERVIN, 1 heifer, 1 axe, 1 frow, all leather only one side. Extrs: ROBERT COCKERAN & JAMES GUFFEY, son of JOHN GUFFEY.
