LINCOLN COUNTY, GA

State of Georgia: In the name of God amen, I Henry Ware, Senr, of the county of Lincoln and state aforesaid being at present in a low and feeble state of health, but of a perfect sound mind and memory do make and constitute this my last will and testament revolting and disannuling all others by me heretofore made. First it is my will and desire that all my just debts be first paid. Secondly that all the remaining part of my estate both real and personal I give wholly and soley to my dear and well beloved wife, Winney Ware, during her life, but at her death to be equally divided among my dear and will beloved children as follows: James, John, Sally, David, Lucy, and Britton. But until the death of my dear and well beloved wife Winey Ware, it is my will and desire that she has the management and feesimple right to all my estate both real and personal and if she wishes or feels disposed at any time, to give to any of my well beloved children any part of the estate she is at liberty to do so. But it is my will and desire that it be first valued by three disinterested persons and what they say to be the value of said property to be set down aginst such child or children that received it at that much received out of their part of the estate. But no gift of this kind made to any of my children by my dear wife shall extend to in real value to more than what they are actually entitled to by an equal division of the estate. And it is further my will and desire that my dear and well beloved wife Winey Ware and my beloved son James Ware and Shadrack Mims do act and serve as my lawful executors to my estate and for my dear children. In Testemony whereas I have here unto set my hand and seal this sixteenth day of November in the year of our Lour one thousand eight hundred and seven. In Lincoln County, Georgia Will Book D, Pages 1 and 2.¹ Probate commenced in Jan 1808 at Lincoln County, Georgia; an appraisal of his estate was recorded on 4 Feb 1808. Probate on his will continued until Feb 1815. William Harper recorded the last entry in his records on 17 Jul 1816. Included in his files is record of a payment to a man "for part of the deceased wife's coffin", this payment may have been for his deceased wife Winnie's coffin; this last entry also pays the taxes on Henry's estate for the years 1814 and 1815. James Ware, his son, was Executor of Henry's will.¹

     John Mims Ware was born on 29 February 1788 at Edgefield County, South Carolina.¹ He was the son of Henry Ware Jr. and Winnifred Mims.¹ John Mims Ware married Lucy Sturdivant on 11 May 1811.¹ John Mims Ware died on 18 August 1838 at Heard County, Georgia, at age 50.¹

     Lucy Ware was born on 18 December 1791 at Edgefield County, South Carolina.¹ She was the daughter of Henry Ware Jr. and Winnifred Mims.¹ Lucy Ware married George W. Turrentine on 4 January 1821.¹ Lucy Ware died on 15 December 1831 at Pike County, Georgia, at age 39.¹

     Sarah Ware was born on 23 April 1790.¹ She was the daughter of Henry Ware Jr. and Winnifred Mims.¹

     William 'Bill' Ware married Irby Clinton Roberts, daughter of John Lindsey Roberts and Anna 'Annie' Graves Daniels.¹

     Robert Warno was born circa 1900.¹ He married Margaret Humphreys, daughter of Virgil Boswell Humphreys and Ruth Harris Fraser, circa 1950 at Memphis, Shelby County, Tennessee.²
