State of Tennessee, Sumner County Sept. Term 1807
Isaac Walton and Shadrack Nye being sworn on the Holy Evangelist of Almighty God depose and say to the best of their knowledge and belief, they the said Walton and Nye was present and the subscribing witnesses to the will and testament of Thomas Perry deceased, which will was deposited in the hands of the said Isaac Walton and at present not to be found, but the contents thereof, they believe to be in substance as follows, viz:
Firstly. He gave and bequeathed to his wife Catharine Perry the use of his plantation or tract of land whereon he at that time resided, with appurtenancey, household furniture and farming utensils excepting the stills; also a negro man by the name of Lanter and a negro woman by the name of Moll; also one fourth part of his stock of every kind during her natural life.
2nd. He gave and bequeathed to his son John Perry, his heirs and assigns forever, at the death of his said wife Catharine the whole of the aforesaid plantation or tract of land, with the household furniture, farming utensils and stock that his said wife Catharine might die possessed of, and should he the said John arrive at the age of twenty one years before the death of his said wife Catharine, in that case the said John should have the use of two thirds of the aforesaid plantation or tract of land, also two cows and calves, two sows and pigs and two ewes and lambs. He also bequeathed to his said son John, his heirs and assigns forever, a negro girl by the name of Esther, one by the name of Minny, one negro boy by the name of Ben, one boy by the name of Isaac and one by the name of Moses.
3rdly. He gave and bequeathed to William Rainy McAdams his heirs and assigns forever, a good serviceable horse or mare, two cows & calves, two ewes and lambs and two sows and pigs.
4thly. He gave and bequeathed to his five granddaughters a negro man by the name of Wyatt to be sold
at a credit of twelve months, and the money equally divided between Nancy Smith, Celia Thompson, Betsey Cartwright, Polly Powell and Sarah Powell, their heirs and assigns forever.
5thly. He gave and bequeathed to his son George Perry and his grandson Thomas Powell, and his five granddaughters before named, their heirs and assigns forever, after the death of his wife Catharine a negro man by the name of Lanter and a negro woman by the name of Moll, also all the remainder of his estate not otherwise deposed of at his the said testator's decease, to be sold at a credit of twelve months; and one half of the money arising from said sale to go to George Perry and the other half to be equally divided between the said Thomas Powell, and his five granddaughters before named.
6thly. And lastly he nominated and appointed his son George Perry Executor, and his wife Catharine Executrix of his last will and testament, revoking all other and former wills. And further deponents say not. Isaac Walton, Shadrack Nye
The foregoing was sworn to in open Court by Isaac Walton and Shadrack Nye, the deponents on 25th day of September 1807.
