May 1924 - April 1932
I, Mallie Kelly of Fountain Head, Sumner County, Tennessee, do hereby make, publish and declare this to be my last will and testament.
I order and direct that all my just debts and funeral expenses be paid as soon after my decease as conveniently may be.
After the payment of such funeral expenses and debts, I give, devise and bequeath unto my brothers and sisters Joe Hudson, Bobie Hudson, Irvin Hudson and Mrs. Lena Brown, all my estate, real, personal, or mixed, of every description and wherever situated, said property is to be divided equally between them.
In witness whereof, I have hereunto subscribed my name, this 12th, day of May, 1926.
Signed, published and declared by the said testator, Mrs. Mallie Kelly, to be her last will, in the presence of us, who, at her request, have subscribed our names thereto as witnesses, in her presence, and in the presence of each other.
G. D. Moore
O. M. Moore
Be it remembered that, on this 2nd, day of May, 1932, before the Honorable, W. R. Brown, Chairman of the County Court of Sumner County, Tennessee, Irvin Hudson, one of the beneficiaries named therein produced in open Court a type written paper purporting to be the last will and testament of Mrs. Mallie Kelly, lately deceased, and bearing date May 12th, 1926, having the name of Mallie Kelly signed thereto and being subscribed by G. D. Moore and O. M. Moore as attesting witnesses, and moved the Court that the same be admitted to probate and record as the last will and testament of the said Mallie Kelly, deceased, and it appearing to the Court from the testimony of O. M. Moore one of the subscribing witnesses thereto, that said typewritten paper was written in the lifetime of the said Mallie Kelly and signed by her and subscribed in her presence and at her request by the said G. D. Moore and O. M. Moore as attesting witnesses, and that said instrument was executed by the said Mrs. Mallie Kelly on the day it bears date as and for her last will and testament, and that she was at the time of sound mind and disposing memory and was more than twenty-one years of age and it further appearing that the said Mrs. Mallie Kelly lately died in Sumner County, Tennessee, and that her home and usual place of residence at the time of her death was in said County, it is so adjudged; and it is adjudged and declared by the Court that said instrument is the true, whole and last will and testament of the said Mrs. Mallie Kelly, deceased, and the same is hereby admitted to probate as such, and the Clerk is directed to file and record the same.
A true copy.
