I, Mrs. Elizabeth Rodes, being of sound mind but failing health, do make and publish as my last will and testament, hereby expressly revoking all former wills and testaments by me at any time made.

1st;  I direct that all my just debts and funeral expenses be paid by my executrix of the first monies which may come into her hands in such office.

2nd;  I will, give, devise and bequeath all of my property, real, personal and mixed, wheresoever situated, of which I am the owner in whole or in part, to my good friend, Mrs. Prudie Persons, of Gallatin, Tennessee, in fee-simple and unconditionally.

3rd;  I nominate and appoint Mrs. Prudie Persons, as executrix of this my last will and testament and expressly waive her making bond to serve said office.

In witness whereof, I have hereto signed my name on this 8th, day of January, 1938.

The foregoing instrument was signed and published by the testatrix, Elizabeth Rodes, as her last will and testament, in our presence, and we in her presence and at her request and in the presence of each other, have subscribed our names hereto as attesting witnesses, on this 8th day of January 1928.

BE IT REMEMBERED that on this the 26th, day of February, 1938, before the Honorable J. W. McCormack, Chairman of the County Court of Sumner County, Tennessee, Mrs. Prudie Persons, the Executrix named therein, produced in open court a type-written paper purporting to be the last will and testament of Elizabeth Rodes, deceased, bearing date of January 8th, 1938, having the name of Elizabeth Rodes signed thereto and being subscribed by Suzanna Flynn and J. A. Elliott as attesting witnesses, and moved the Court that the same be admitted to probate and record as the last will and testament of the said Elizabeth Rodes, deceased.

And it appearing from the testimony of the said Suzanna Flynn and J. A. Elliott, the attesting witnesses thereto that said paper writing was written in the life time of the said Elizabeth Rodes and signed by her and subscribed in her presence and at her request by the said Susanna Flynn and J. A. Elliott as attesting witnesses and that said instrument was executed by the said

Elizabeth Rodes on the day it bears date as and for her last will and testament and that she was at the time of sound mind and disposing memory and was more than twenty one years of age.

And it further appearing to the Court that the said Elizabeth Rodes lately died in Nashville, Tennessee, where she had been temporarily carried on account of illness, but that her home and usual place of residence at the time of her death was in Sumner County, it is so adjudged.

And it is adjudged and declared by the Court that said instrument is the true, whole and last will and testament of the said Elizabeth Rodes, deceased, and the same is hereby admitted to probate as such and the Clerk is directed to file and record the same.

And the said Mrs. Prudie Persons being named in said will as the Executrix thereof and being excused from executing bond under said will, appeared in open Court and accepted said trust, when she was duly qualified and letters testamentary ordered issued to her.
