I Bailey Turner of Sumner County and State of Tennessee hereby declare this my last will and Testament (viz) In the first place my will and desire is, that all my just debts shall be paid.  Secondly It is my will and desire that all my household and kitchen furniture stock of all kinds, farming utensils of every kind and other personal property excepting ten negroes and their increase shall be sold by my Ex'or hereafter named on a twelve months credit and the

money arising from said sale and all my negroes and their increase be equally divided into seven parts one equal share to my son Wm. Turner in trust for the use and benefit of my daughter Jane H. Williams and her issue, one equal share to my son John E. Turner, in trust for the use and benefit of my son Wm. Turner and his increase to be applied by the said Trustees for their use and benefit, one equal share to my daughter Martha L. Folks, one equal share to my son John E. Turner, one equal share to my daughter Caroline Joyner, one equal share to my son John E. Turner in trust for the use and benefit of my grand-children the children of my daughter Elizabeth Jones living at the time of my death, or may be born afterwards to be applied by the said Trustee to their education and support, one other equal share to my son John E. Turner in trust for the use and benefit of my grandson George T. Fulks the child of my daughter Mary F. Fulks to be applied by the said Trustee to the Education and support of the said George Fulks it is also my wish and desire that John E. Turner keep George T. Fulks property until he becomes of age it is also my wish and desire that should any of my children die without any increase that my Ex'or shall take back the property that I have devised to them and divide it among the rest of my children, it is my wish and desire that my old faithful servant Judie shall have it to her choice to live with any of my children she may like best and at anytime go and come whenever she pleases and also my will and desire that she is supported out of my estate; it is also my will and desire that none of the property that I have devised to Jane H. Williams, Wm. Turner, George T. Fulks, and the children of Elizabeth Jones, shall be moved out of the estate without the person moving the same shall give to the Chairman of the County Court good and sufficient security for his faithful performance.  Lastly:  I nominate and appoint my son John E. Turner my Executor to this my last will and Testament, revoking all former wills by me made and I also wish him to serve without giving security.  In testimony whereof I have hereunto set my hand and affixed my seal, this 23 d day of October 1833.

The last will and Testament of Bailey Turner dec'd was produced in Court and proved agreeable to Law by the oath of Saml D. Read and Jesse Garret subscribing witnesses thereto and ordered recorded it being directed in said will that no bond or security be required and thereupon John E. Turner the Executor therein named appeared in Court and took the oath of Ex'or. prescribed by Law and returned into Court an Inventory of the estate of sd. decedent which is also ordered to be recorded.
