I, Babe Wims, of Sumner County, Tennessee, being of sound mind and disposing memory, do hereby make and publish this my last will and testament, hereby revolking all other wills by me at any time heretofore made.
FIRST: I desire and direct that my funeral expenses and all my just debts be first paid out of any funds left by me at my death, and in the event sufficient funds are not left by me for the payment of same, I authorize and empower my executrix, hereinafter named, to sell such of my personal property or real estates necessary to pay the same.
SECOND: In the event I predecease my sister, Nora Wims, I hereby will, devise and bequeath all of my property, both real estate and personal property, regardless of the nature or kind, and wheresoever situated, and all the interest that I have in any property to my sister, Nora Wims for and during her natural life, and at her death, I will, devise and bequeath all of the property that I own at my death, both real and personal, regardless of the nature or kind, and wheresoever situated to my two nieces, namely Dovie Briggance, wife of Maynard Briggance, and Rubby Denning, in fee simple forever, as tenants in common, subject only to the conditions set forth in paragraph Four of this will.
THIRD: In the event my sister, Nora Wims should predecease me, then
I hereby will, devise and bequeath all of the property that I die seized
and possessed of, both real and personal property, regardless of the nature
or kind, and wheresoever situated unto my nieces, Dovie
Briggance and Ruby Denning, in fee simple, absolute, as tenants in common, subject only to the conditions set forth in paragraph Four of this will.
FOURTH: In the event either of my nieces, Ruby Denning or Dovie Briggance shall, during the lifetime of either myself or my sister, Nora Wims, advance or pay to either of us any sum or sums of money, or to anyone else for us, for doctors bills, medical bills, hospital bills, drug bills or for any of the necessities of life for either of us, or shall take care of, wait on, or attend to either of us, in our home or either of their homes, at any time hereafter, or nurse and otherwise care for either of us during any sickness, or otherwise render us any services, the niece that pays for any of the above mentioned bills, or advances anything to either of us for the necessities of life or otherwise, shall have a charge against the other nieces part of all my property, and in the event either niece should care for either or both of us, my sister and I, or wait on, attend to, nurse or otherwise render services to us then the niece who renders such services, in our home or their home shall have a charge against the other nieces part of all my property for such services rendered to either of us or both of us, and said niece shall be allowed the customary charges for any service or services rendered, regardless of the nature or kind.
FIFTH: I hereby nominate and appoint my niece Dovie Briggance the executrix of this my last will and testament, and she shall not be required to execute any bond to any court for the faithful performance of her duties as my executrix.
IN TESTIMONY WHEREOF I have hereunto set my signature, this the 9th day of April, 1953.
Signed by the said Babe Wims as and for his last will and testament, in the presence of us, the undersigned, who, at his request and in his sight and presence, and in the presence of each other, have subscribed our names as attesting witnesses, the day and date above written.

PROBATE OF LAST WILL AND TESTAMENT OF BABE WIMS, DECEASED
BE IT REMEMBERED, that on May 21, 1958, before the Honorable S. W. Dismukes, Chairman of the County Court of Sumner County, Tennessee, Dovie Briggance produced in open court a typewritten paper purporting to be the last will and testament of Babe Wims, lately deceased, bearing date April 9, 1953, having the name of Babe Wims signed thereto and being subscribed by R. C. Ray and A. L. Lynd, and in presence of each other as attesting witnesses and that said instrument was executed by Babe Wims, on the day it bears date as and for his last will and testament and that he was at the time of sound mind and disposing memory and was more than twenty-one years of age; and it further appearing that the said Babe Wims lately died in Sumner County, Tennessee, and that his usual place of residence at the time of his death was in said county it is so adjudged.
And it further adjudged and declared by the court that said instrument is the true, whole and last will and testament of the said Babe Wims, deceased, and the same is hereby admitted to probate as such; and the Clerk is directed to file and record the same and the said Dovie Briggance named as executrix of said will appeared in open court and accepted said appointment and being excused under the terms of said will from giving bond was duly qualified as such executrix as the law directs and letters testamentary order issued to her by the Clerk of the court.
