This Indenture made this 25th day of February in the year of our Lord, one Thousand Eight Hundred and Eighty seven between William G. Northam Charles H. Carr & wife Maggie A. Carr and Margaret Northam of Richmond County and State of North Carolina of the first part and Thomas S. Cole of the county of Richmond and State of North Carolina, of the Second part: Witnesseth, That the said parties of the first part for and in consideration of the sum of Three hundred Dollars in hand paid by the said party of the second part the receipt whereof is hereby acknowledged, have Bargained and sold, conveyed and confirmed, and by these presents do Bargain, sell, convey and confirm unto the said party of the second part his heirs and assigns, forever, all the following described piece or parcel of land, lying and being in the State and county aforesaid Rockingham Township and known and designated as follows, viz: Beginning at a lightwood stake in a line of George W. Northam's land and runs South 19 deg* E 25.30 chains crossing a branch to the line branch between the land of J. F. Hamer? and the land here in conveyed thence down the various courses of said branch as/at? said Hamers line to its junction with the

Steeles branch then up the various courses of said Steeley branch twenty eight chains to said G. W. Northam's corner thence along his line North 70 East 34.25 chains to the beginning and containing seventy five and one tenth acres more or less being the tract of land on which the said parties of the first part now reside and conveyed this day to said W. G. Northam and M. A. Carr by J. H. Covington Executor of Geo. Northam. To Have And To Hold The same, Together with all the hereditaments and appurtenances thereunto in anywise appertaining to him. the said Thomas S. Cole his heirs and assigns forever, And the said William G. Northam C. H. Carr & Maggie A. Carr his wife and Margaret Northam parties of the first part do covenant with the said party of the second part his heirs and assigns, as follows: First. that they are the owners and lawfully seized of said premises. Second. That they have good right to convey the same, Third. That the same is free from all encumbrances whatever. And Fourth. That the party of the second part, his heirs and assigns, shall quietly enjoy and possess the same, and that they will warrant and defend the title to the same against all lawful claims. Provided, nevertheless. That if the said W. G. Northam C. H. Carr & wife M. A. Carr and Margaret Northam parties of the first part, their heirs, executors and administrators, shall well and truly pay, or cause to be paid to the said Thomas S. Cole party of the second part his heirs, executors, administrators, or assigns. the sum of three Hundred Dollars, according to the condition of a certain Bond of even date herewith. payable 25th day of February 1888 with 8 per cent interest from date, Then this Deed to be

null and void: otherwise to be in full force and effect. But if default shall be made in the payment of the said sum of money, or the interest. or any part thereof, at the time hereinbefore specified for the payment thereof, the said parties of the first part in such case do hereby authorize and fully empower the said party of the second part his heirs, executors, administrators and assigns, to sell the said hereby granted premises at public outcry at the court House door in Rockinham after first advertising the same for thirty days at three public places and convey the [*] to the purchaser in fee simple, and out of the moneys arising from such sale, to retain the principal and interest which shall then be due on the said bond together with all costs and charges, and pay the surplus (if any) to the said parties of the first part their heirs, executors, administrators or assigns.

Carr his wife, personally appeared before me this day, and acknowledged the due execution of the annexed deed of mortgage; and the said Maggie A. Carr being by me privately examined, separate and apart from her said husband touching her voluntary execution of the same, doth state that she signed

the same freely and voluntarily, without fear or compulsion of her said husband, or any other person, and that she doth still voluntarily assent thereto, Witness my hand and private seal this 25th day of February 1887.
