This cause was heard on Nov. 13, 1902 before Chancellor Stout, on the pleadings and proof in the cause when, it appearing that the allegations of the bill are fully met and denied by the answer and the proof submitted on the part of defendants; and that the defendants do not owe complainant anything - it is therefore ordered, adjudged and decreed that said bill be dismissed, and that defendants recover of complt. R. H. Turner, Admin. of Mary Turner, decd., and his surety on his injunction and cost bond the costs of its' cause.  And it appearing that J. J. Turner is the security on the cost bond of complainant in this cause, and that said Turner is dead, on suggestion and proof of his death in court and that D. F. Barry is his Admr. and has suggested the insolvency of his estate in the county court, it is on motion ordered, that, if said costs can not be collected out of the estate of Mrs. Mary Turner, that this judgment be filed in county court against the estate of said J. J. Turner.
