State of Tennessee vs. Sam Perry  

Came the Atty. General on behalf of the estate and moved the Court for a workhouse sentence in this case, and it appearing to the Court, that a former term of this Court the defendant was convicted of gaming and ordered into custody of the Sheriff until his fine and costs were paid or secured, and it appearing to the Court that the defendant gave John Henry Morris as security for said fine and cost, and that the said surety is and was at the time wholly insufficient and that no part of said fine and cost has or can be made by law, out of either the defendant or his said security, it is therefore considered by the Court that the said defendant be and he is hereby sentenced to the County Workhouse until said fine and costs are fully paid or secured and to this end it is ordered by the Court that a workhouse order issue to the Sheriff of the County of Sumner for said defendant.

W. Durham as security for said fine and cost, and that the said surety is and was at the time wholly insufficient and that no part of said fine and cost has or can be made by law out of either the defendant or his security, it is therefore considered by the Court that the said defendant be and he is hereby sentenced to the County Workhouse until said fine and costs are fully paid as secured and to this end it is ordered by the Court that workhouse order issued to the Sheriff of the County of Sumner for said defendant.
