vs Decree confirming Report of C.and M as to sale of land
A.N. Johnson, et al
May 1871. upon the previous proceedings and the report of the Clerk and Master , which is as follows:
In purcuance to an order of sale in the above cause, I would report that after giving due legal notice, I offered the lands mentioned in the pleadings, in three separate tracts, according to survey and plot. exhibited at the court house door in the town of Gallatin on the 1st day of December 1870, when the same was struck off as follows: Lot No 1 containing 125 acres to William Johnson at $8.75 per acre, the said William Johnson paid in cash $269.05 and executed to me his two promissory notes due in 12 and 24 months with interest for $403.60 each with B.F. Johnson as his security. Lot No 2 containing 130 acres to B. F. Johnson at $8.00 per acre, the said B. F. Johnson has paid cash $260.30 and executed to me his two promissory notes for 290.50 with interest from date , due in 12 and 24 months with William Johnson his security. Lot No 3 to Wm Strother, at $9.50 per acre, there being 136 acres amounting to 1197.00. The Cash payment for said purchase is $300.00. which amount has not been paid into my office. The parties have executed their two notes of 444.50 each due in 12 and 24 months with int. .

Which being seen and understood by the Court and not excepted to is in all things confirmed by the Court. The Clerk after paying the costs of the cause will pay over to the administrator with the will annexed, enough of the proceeds of the sales to pay the debts of the Testator. The balance after paying all charges will be paid over to the Complts. and defendants as they are respectively entitled. The Clerk will take proof and report what amount would be a reasonable fee for the service of W.S. Munday Solicitor for Complts.
Upon the matter referred to the special Commissioner J.A. Trousdale, he submitted his report which being unexcepted to, is confirmed. Upon which the Court is pleased to decree as follows: That the purchasers of Lot No 3 were Wm. Strother and J. T. Gilbert and that they have only paid $150.00 of the cash payment of $300.00 and that there still due $150.00. It is ordered that if the said Strother and Gilbert do not within forty days after the adjournment of the Court, pay into the office of the Master said $150.00, we will after giving the usual notice , expose said land at public auction, or a sufficiency thereof to satisfy said balance of $150.00 and sell the same to the highest bidder for cash.
