The State of Minnesota, to all to whom these Presents shall come or may concern, and especially to Fred L. Probart of the County of Faribault and State of Minnesota Greeting:
Whereas, an application in due form of law has been made to the Probate Court, to have you, the said Fred L. Probart appointed the Guardian of the persons and estate of Floyd Probart, Ethel Probart, Earl Probart and Ray Probart minors, residing in Easton of the age of Eight, Sex, Four, and Two respectively.
And Whereas, You have agreed and consented to become such Guardian, and have duly executed and delivered a bond, pursuant to law, conditioned for the faithful performance of your duties as such Guardian; and the Court being satisfied of the sufficiency of the bond, and that you are a good and reputable person, and are in every respect competent to have the custody of the persons and estate of said minors, does by these presents allow, constitute and appoint you, the said Fred L. Probart the Guardian of the persons and estate of said minors during their minority, with full power to demand, sue for, and take possession of all money and estate belonging to said minors; hereby requiring you, the said Guardian, to safely keep the real and personal estate of said minors which shall hereafter come to your custody, and not suffer any waste, sale, or destruction of the same, but to keep up and sustain their lands, tenements and hereditaments, by and with the rents, issues and profits thereof, or with such other moneys belonging to them as shall come to your possession, and to deliver the same to each when they respectively become of age, or to such other Guardian as may be hereafter appointed, in as good order and condition as you received the same, and also to render a just and true account of all moneys and property secured by you, and the application thereof, and of your Guardianship in all respects, to any court having cognizance thereof, when thereunto required, and in general to do all acts which appertain to you in said capacity, and as the law shall charge you.

I Fred L. Probart, Your petitioner respectfully represents and shows to the court:
First, - That he is the duly appointed guardian of said Floyd Probart, Ethel Probart, Earl Probart and Ray Probart above named; that said Ethel Probart has arrived at the lawful age.
Second, - That heretofore and on May 1st, 1912, said Ray Probart and Earl Probart filed a petition in said court wherein and whereby the said Ray Probart and Earl Probart set forth that they are both above the age of fourteen years and that in and by said petition they nominate and appoint John A. Bachtle as their guardian; that your petitioner was appointed guardian of the above named minors on September 7th, 1899, and ever since the said date has been the duly qualified and acting guardian of said minors; that as such guardian there has come into his hands the sum of One Thousand Dollars ($1000.00) which said sum your petitioner invested in the following described real estate situate in the County of Beadle and State of South Dakota: The Southwest quarter of Section Five (5), Township One Hundred Nine (109) North, of Range Fifty-none (59)l that as the time of the investment of said sum in said above described premises a warranty deed to said premises was duly executed wherein and whereby the premises in question were conveyed to said Floyd Probart, Ethel Probart, Ray Probart and Earl Probart; that said investment has been a good and profitable investment, the land in question now being worth a considerable sum more than the amount paid therefor.
Wherefore, Your petitioner prays this court that the above statement be allowed as the final settlement and final account in said guardianship and that your petitioner be discharged as guardian of said Floyd Probart, Ethel Probart, Earl Probart and Ray Probart above named.

Cory, William Quimby, Ethel Borris, Floyd Probart, Earl Probart and Ray Probart are owners in common of the real estate and premises hereinafter described.
And whereas, John A. Bachtle is the duly appointed, acting and qualified guardian of the persons and estate of Earl Probart and Ray Probart, minors.
And whereas said parties have now agreed to make partition of said lands and premises between them as hereinafter mentioned; so that their respective portion may henceforth be held in severalty.
Now therefore, The said parties for themselves and their respective heirs, executors and administrators do hereby mutually agree to make partition of said land and premises between them and hereby do make such partition of said premises as hereinafter set forth.
And it is further agreed by and between the parties hereto that they will severaly execute and deliver mutual conveyance to each other their heirs and assigns, of such part of said premises as are by this agreement allotted to them respectively, and that after the making of this agreement and the execution and delivery of said conveyances, the premises so allotted and set apart to each of said parties shall be held and enjoyed by them respectively in severalty; that the following is a description of the lands and premises and the share and allotment going to the respective parties, to-wit: …
To Ethel Borris, Floyd Probart, Earl Probart and Ray Probart the following described lands and premises situate in the County of Faribault and State of Minnesota, to-wit: The South-east quarter of the North-east quarter of Section Nine and the West Three quarters of the North-west quarter and the North-west quarter of the South-west quarter of Section Ten all in Township One Hundred Four North, of Range Twenty-six West.
And it mutually agreed by and between the parties hereto that all of the terms and conditions of this agreement shall be binding upon the heirs, executors and administrators of the respective parties hereto.

First, That all of my just debts and funeral expenses shall be paid out of my estate and I hereby direct that if I have sufficient property left that an adequate family tomb-stone be put on our family lot and markers at the head of those buried therein, if not done before my death; and I wish to be buried in the same lot at Rochester.
Second, After these provisions are carried out, I direct that all the rest and residue of my property, whether real, personal or mixed be given and I hereby devise the same to Dr. Seth Scott Bishop of Chicago, Illinois, and I also give him my personal property hereby authorizing and empowering him to sell and convey my real estate as he thinks best, as executor. I refer to my nephew above named.
To have and to Hold the same to himself, his heirs and assigns forever.
I hereby constitute and appoint said Dr. Seth Scott Bishop executor of this my will and relieve him from giving bonds.

In the matter of the guardianship of Ray Probart and Earl Probart, minors.
It appearing to the court from the petition of Ray Probart and Earl Probart that they desire to have Fred L. Probart, their present guardian, removed and that they and each of them have nominatied John A. Bachtle, of Easton, Faribault County, Minnesota, to be appointed in place of said Fred L. Probart. And it appearing that said petitioners have an estate in this county and state; that the said Ray Probart and Earl Probart and each of them have attained the age of fourteen years and that the said John A. Bachtle so nominated is a proper and suitable person to be guardian of said minors; that the personal property of said minors does not exceed the sum of Five Thousand Dollars in value; that said minors are seized of certain real estate lying in the County of Faribault and State of Minnesota, the annual profits and rental value of which is about Two Hundred Fifty Dollars.
It is ordered that said Fred L. Probart, guardian as aforesaid, be removed and that Letters of Guardianship issued to him as such guardian on the 7th day of September A.D. 1899, be, and the same are hereby, revoked, and the said John A. Bachtle be, and he is hereby, approved as guardian for said minors and that said John A. Bachtle give a bond to the Judge of Probate of Faribault County, Minnesota, in the sum of Five Thousand Dollars, with sufficient sureties, conditioned as required by law, and that upon the filing and approval of such bond by the Court, John A. Bachtle be appointed and Letters be to him issued as guardian of the person and estate of said minors.

Bachtle, guardian of the persons and estate of Ray Probart and Earl Probart, minors, do hereby certify and report that by virtue and in pursuance of the order of license made by this court on the 17th day of January, 1914, licensing me as guardian as aforesaid, to sell part of the real estate of said minors at private sale... that thereupon I offered the real estate described in said order of license for sale at private sale, which said real estate is in the County of Norman and State of Minnesota, and described as follows, to-wit: An undivided one-thirtieth interest in the following land to-wit: The North half, the North half of the South West Quarter, the South East Quarter o the South West Quarter and the South East Quarter of Section Five (5); the South half of the North East Quarter and the South East Quarter of Section Seven (7) all in Township One Hundred Forty-five (145) North of Range Forty-four (44) West of the Fifth Principal Meridian; and the North East Quarter and the North East Quarter of the South East Quarter of Section Thirty-one (31) in Township one Hundred Forty-six (146) North of Range Forty-four (44) West of the Fifth Principal Meridian; and that at the Village of Easton in said County on the 21st day of January, 1914, I sold the same to Charles Macbeth, of the County of Blue Earth, Minnesota, for the sum of Five Hundred Nineteen Dollars and Thirty Cents ($519.30) to be paid in cash; ...

Tryphena was born in Nauvoo, 1845. About a month before she was born, her father died. She was the seventh child.
As an infant, she left Nauvoo in 1846 with her mother, three brothers, a sister and her grandparents. At Winter Quarters her grandmother died.
In 1847, they arrived in the Salt Lake Valley. She with the rest of her family, endured many hardships after they reached Utah. At one time they had not tasted bread for six weeks, living on nettles, roots and fish. They had to kill their only ox to survive.
Their first home was an earthen dugout. After the first winter they moved into the "Old Fort." Then at the time of Johnston's Army they lived at West Jordan with her stepfather, Archibald Gardner and his eight wives.
Tryphena and her two brothers were very close to each other. They were all three married on the same day in the Endowment House and moved to Spanish Fork.
Tryphena was a devoted wife and mother. She had a cheerful disposition. The Relief Society was scheduled on April 15, 1873 to be held in her home. She stepped outside, picked up her baby, began hemorrhaging and they carried her to her bed and sent for her husband who was working in the field. Tryphena passed away at the age of twenty-eight leaving four small children.

Eliza Ann Pectol was born in Indiana in 1832, the daughter of George and Sarah Pectol, the third child of the family of nine. She was baptized into the Church of Jesus Christ of Latter-day Saints in 1848. The LDS people were emigrating to Utah as fast as they could prepare to leave.
In the Summer of 1849, when seventeen, Eliza had a chance to go to Utah with a family of Saints as a hired girl, so her parents preparing to come later, consented to her going.
She left her family, July 4, 1849, with the Richard's company and started her journey. It was Eliza's job to take care of one team of a horse and an oxen which she drove during the day hitched to a wagon. This was pay for the freight of her trunk and her passage to Utah.
They had difficulties crossing the Plains and it was a tiresome journey traveling over all kinds of roads, crossing streams without bridges, and through all kinds of weather. The night they camped on Big Mountain, there came a terrible snow storm. In the morning it was snowing so hard they decided to break camp and start on their way at once fearing the snow would delay their progress. Before they left, it had snowed two feet deep. They later learned the snow had fallen five feet deep on the mountain. They were thankful they had left early before their breakfast. After four months, they reached the Salt Lake Valley on October 29, 1849.
Eliza and Shepherd were in the same company so they became well acquainted. On January 1, 1850, Shepherd and his first wife, went with Eliza to President Brigham Young's office, and here Eliza Ann and Shepherd were married. They lived in an adobe house in Salt Lake City and in the spring of 1855 they went to Carson Valley, Nevada.
Eliza moved to Manti, to be near her parents. She had three children and her fourth was born the following October. Mail was very slow, but Eliza would receive letters during the summer from Shepherd. He sent her a small gold coin, a twenty-five cent piece, which she valued and kept as long as she lived.
Shepherd returned to Manti on November 18, 1855, expecting to take his family back to Nevada the next spring. Instead, they left Manti in April, 1856, for Salt Lake City expecting to sell their property there. Being unable to do so, they waited. They lived in Centerville. During the grasshopper problems, they went without bread for three weeks and could not buy flour at any price. They ate mostly greens, dried corn, dried beans and squash.
The family moved south with the Johnston's Army scare and settled in Springville, bought a home and got along fairly well. Ill health plagued Shepherd and soon he was unable to work. He built a loom for her so she knew how to weave. She made cloth for her family's clothes and to sell. She made brooms, baskets, candles, hats and rugs. The older children hellped as much as they could. They moved south to Springville in 1877, cleared the land, and had a farm. Her children married, and some lived close by.
In July, 1895, Shepherd died leaving Eliza with one son and her two youngest daughters unmarried.
Eliza lived a good life. At all times she tried to live the true gospel. Although she lived alone for years, she never once forgot to ask the blessing on the food and to kneel by her bed each night to pray and give thanks.
Her youngest son eventually took over the old home and Eliza lived in part of the house until her death. She was stricken with creeping paralysis in 1911, and died three days later, October 25, 1911, one month short of being seventy-nine years old. She was the mother of fifteen children, nine of whom survived her.

Sarah "Sally" Smith was born, February 26, 1794, in New Jersey. Her mother was Amy Smith who later married John Cox. Nothing is known about her childhood.
Sally married Elias Hutchings on December 29, 1816, in Avery, Huron County, Ohio, by a Justice of the Peace. They began their married life fifteen miles south of Huron at Norwalk. Their first four children were born there.
They moved to Mayfield into the township, and then back down the river. When their son, Shepherd, was just eight years old, he began working and earned five cents a day which helped support the family.
Sarah's husband was destitute most of the time and was continually having his property seized and sold because of non-payment. Many others experienced these same things, and some found themselves jailed, and others were hiding from the officers at various times.
Times were very hard for all of them as they lived along the banks of the Chargrin River. They again moved a few miles further south along the same river.
Sally and Elias were baptized into the Church of Jesus Christ of Latter-day Saints on November 17, 1830, by Caleb Baldwin and confirmed by Elder John Murdock.
The Church was "taking root" in Kirtland, Ohio a few miles from their home. Falsehoods were spread that the Mormons were trying to possess the lands of the area. Nearly the whole county prepared to fight, and were told they would be barred from the county if they refused to fight. Buildings were destroyed, homes were plundered, and the Saints were beaten and driven into Clay County. This was frightening for Sally.
Zion's Camp was organized and Elias joined and left her family. The boys helped support the family. They chopped and cleared land, fenced and dug wells. Sally and Elias finally left their home for the state of Missouri and stopped in Illinois. In May 1840 they left for Iowa.
Shepherd wrote, "It seems like all hell has broken her bounds. The Saints have been driven, robbed, plundered, their property has been destroyed, and they have been caused to go through great trials and tribulations and unnumbered persecutions."
Sally and her family moved to Iowa. The family became ill with fever and ague. Sally's three youngest daughters died with canker. In 1845, Elias met an untimelydeath when they were living in Nauvoo. This left Sally a widow at the age of fifty-one. Just five of their children grew to adulthood. Sally survived because of her love for her children, her strength, integrity, hard work and her great love for the gospel.
She crossed the Plains in 1849, with a wagon company. Her three living sons built her a house in the Salt Lake Valley, where she spent the remaining days of her life.
Sally is among the faithful members of the Church, she met her obligations with courage and paid an honest tithing by knitting stockings and mittens. She died in 1863, in Salt Lake City and is buried in the city cemetery. She had been a widow for eighteen years.

Sarah was the daughter of a Baptist minister who performed her marriage to George Pectol on November 2, 1828. For the first five years of marriage Sarah and George lived in Indiana and then moved to Madison County, Missouri where George ran a store.
It was here that they received a Book of Mormon and became interested in Mormonism. In 1846, they traveled to Nauvoo, Illinois to learn more about the gospel, and were baptized in the Mississippi River on March 29, 1846.
They endured much persecution in Missouri and Illinois and moved with the Saints to Council Bluffs, Iowa where they remained until June 2, 1850, when they started for Utah. Sarah gave birth to her ninth child while they were crossing the Plains at Pottawattamie County, Iowa.
They arrived in the Salt Lake Valley on August 26, 1850. Four days after arriving in Utah they left with a few other families for Sanpete County, arriving there September 6, 1850. The first winter in Manti they lived in a dugout and were bothered with snakes in the spring. In May, 1851, they completed a comfortable home.
Sarah was an industrious and ambitions woman. She was a successful homemaker. Many of her descendants filled missions for the Church of Jesus Christ of latter-day Saints.
Sarah passed away at Manti, Utah on January 1, 1861. After her death, George moved to Washington Utah and married a second wife, Mrs. Blazzard, with whom he lived until his death on September 28, 1869.

He was baptized Feb. 5, 1885, by James E. Hall and confirmed the same day by Benjamin T. Blanchard; was ordained an Elder, Dec. 22, 1885, by Nephi Packard and married in the Logan Temple Jan. 6, 1886, to Tilitha E. Kerswell (daughter of William Kerswell and Sarah Garlick), who was born July 21, 1864, at Springville, Utah. She bore her husband six children, namely, Geneva May, Talitha Grace, Reba, Erma Ann, Leo Stephen and Ersal Luzell. Brother Hutchings was ordained a Seventy Dec. 8, 1889, by Franklin P. Whitmore and labored as a Ward teacher for twenty-one years. In 1913 he labored as a missionary in Springville and vicinity. He moved to Victor, Teton county, Idaho, in 1914, arriving there on the 2nd of May. He was ordained a High Priest Dec. 26, 1915, by William R. Durrant and set apart as second counselor to Bishop Joseph A. Johnson, which position he held until May 21, 1916, when he was ordained a Bishop by Apostle Joseph F. Smith, jun. and set apart to preside over the Victor Ward, which position he still holds.
