Stafford, VA Legislative Petitions 1776-1781, May 24, 1779 Assembly is trying to determine exactly where to erect the court house. They decide to locate the building “on the land and within 100 yards of Col. William Garrard's house” but decide that no action be taken until “better times.” Thomas Whalebone's name is included with numerous other petitioners. Both William and James Garrard were justices.

[Note: The metes and bounds are incompatible.]

Caswell, NC Deeds M, p. 341, Nov. 6, 1802 James [X] Whalebone and Elizabeth [X] his wife to John Worsham of Pittsylvania Co., VA: $300 for 145 acres on Rutledge Creek bounded by Greenberry Voss, John Royall, and James Short, excepting 12 acres already laid off and deeded to Greenberry Voss. Witt: James Gatewood, John Cobb, Joseph Bracken. January Court 1803: The execution of this deed was duly proved by the oath of Joseph Bracken one of the subscribing witnesses thereto and on motion ordered to be recorded. [Note: Rutledge Creek headwaters in far northern Caswell Co. crossing into Pittsylvania Co., VA near the intersection of Interstate 785 and US 29, then flowing eastward thru southern parts of Danville, VA where it joins with Pumpkin Creek, eventually emptying into Dan River where River is crossed by I785. The Whalebone Branch of Pumpkin Creek appears on modern maps as well as the 1925 USGS Danville 1:62500 quadrangle map. It flows due east about 1 mile south of the NC/VA border, and is midway between US 29 and NC Route 86. It is 2 miles west of the town of Gatewood, NC.]

Caswell, NC Minutes 1801-1809, p. 100, Jan. 24, 1803 The execution of a deed from James Whalebone to John Worsham for 145 acres was duly proved in open court by the oath of Joseph Bracken one of the subscribing witnesses thereto and on motion ordered to be registered.

April Court 1804: The execution of this deed was duly proved in open court by the oaths of Thomas Gatewood and James Gatewood two of the subscribing witnesses thereto and on motion ordered to be registered. [Note: This apparently the 150 acres of Duke Whalebone's land grant, the mets and bounds unchanged from 1779. Duke was assessed for 180 acres in 1780, and was taxed in 1781 and 1782 but not for land. Thomas paid yearly Caswell taxes for 150 acres of land from 1785 until 1794.]

Beginning at a Chesnut stump Northeast 37.50 chains to a pine thence South 40 W 20 chains and 40 links to a hickory on the branch thence down the branch as it meanders thence South 68.75 W 3 chains 22 links to a white oak thence 87.5 degrees W 48 chains 22 links to a Dogwood thence West 32.50 nchains to the begnning. John W. Garrett's interest is 2/3rds and Daniel W. Swann's is 1/3rd. Witt: W. B. Swann.

Duke Whalebone (b. March 13, 1717 London, d. c1783 Caswell) mar. Elizabeth Powell, the widow of Charles Powell, on Dec. 3, 1745 in Stafford Co., VA [Overwharton Parish Records, Stafford Co., VA]. Duke was transported to VA in 1738. From 1780 to 1782 his name appears on Caswell County tax lists, in 1783 no Whalebones are listed, and in 1784 Thomas Whalebone's name appears until at least 1796. Duke's baptism was recorded on March 31, 1717 at St. Botolph Without Aldgate, London along with three brothers David on May 14, 1721, John on Oct. 16, 1715, and Thomas on Aug. 2, 1719, all children of John and Ann Whalebone. An Elizabeth Whalebone became a new church member in Sept., 1768 [Early Records of Chappawamsic Baptist Church, Stafford Co., 1799-1844; See: Virginia Genealogical Society Quarterly 27, p. 40 (Feb. 1, 1989)] Their children: Son: Thomas Whalebone (b. Sept. 4, 1746 Stafford, d. after 1820) [Overwharton Parish Records]. He signed Stafford Co., VA petitions in 1776 and 1779. On Dec. 27, 1779 Thomas and his wife (unnamed) were excluded for entering into an unlawful marriage. A Linney Whalebone had died by Sept. 9, 1785, and Thomas was excommunicated by Oct. 29, 1792 [Hartwood Baptist Church Records, Stafford Co., 1771-1791. See: Virginia Genealogical Society Quarterly 28, p. 317 (Nov. 1, 1990)]. James Whalebone of Caswell/Rockingham Cos., NC possibly his son. Dau: Nanny Whalebone (b. Oct. 5, 1749 Stafford) [Overwharton Parish Records]. [Notes: A Lydia Whalebone was listed as an 1808 member of Carmel Methodist Church located today about 5 miles southeast of what was then Sawratown on the south side of Dan River (NC Genealogical Soc.
