Cartwright to Calliham Deed 1847

STATE OF TEXAS                    }
SAN AUGUSTINE COUNTY   }
Know all men by these presents that I Matthew Cartwright of the aforesaid State and county have for and in consideration of the Sum of Four hundred and sixty Dollars to me in hand paid by Nicholas M. Calliham of Polk County and the aforesaid State the receipt of which is hereby fully acknowledged have and do by these presents bargain sell, convey and deliver unto the said Nicholas M. Calliham his heirs and assigns forever a certain tract or parcel of land lying and being situated in Polk County in this State on the waters of Kickapoo Creek containing Five Hundred acres being a part of a league of land the head right of Thomas Cartwright which said league of land is bounded on the west by lands of S. D. Thomas and on all other sides by unknown claims or public lands, the said tract or parcel of land herein sold, and conveyed by me the said Cartwright to the said Calliham to be designated and set apart from the above described league of land by the following lines and boundarys to wit:  Commencing at the South East corner of Said League running from thence along the line Joining the Eastern boundary across the Road leading to Patrick’s Ferry to the North side or edge of a prairie from thence on a line parallel to the line of the Southern boundary of said league to a sufficient distance so that a line drawn or Surveyed running parallel to the line of the Eastern boundary until it Strikes the line of the Southern boundary so as to embrace the quantity of Five Hundred acres herein conveyed and from thence along the line of said Southern boundary to the starting Point or South East corner to have and to hold the above described tract or parcel of land unto the said Nicholas M. Calliham his heirs and assigns together with all and singular the rights thus profits and emoluments arising from the same unto the said Calliham his heirs and assigns forever and I the said Matthew Cartwright for myself my heirs and assigns do and will (   ) and defend the right title and claim of in and to the said tract or parcel of land unto the said Calliham his heirs and assigns forever not only against myself my heirs and assigns but the claims of all persons whomsoever.  In testimony whereof I the Matthew Cartwright hath herein set my hand and  (   ) for seal on this sixteenth day of July in the year one thousand eight hundred and forty seven.

Before me Charles Eppes Clerk of the County Court in and for the aforesaid personally appeared M. Cartwright the grantee in the within and foregoing Deed and acknowledged that he signed sealed and delivered the same for the consideration and purposes therein Stated.  Given under my hand and imprints of my official seal the 16th day of July A. D. 1847.

I John A. Wooten Clerk of the County Court of Polk County and State aforesaid do hereby certify that I have duly recorded the foregoing deed as the Clerks Certificate thereon from San Augustine County in Book C, Pages 153 & 154 in testimony I have hereunto set my hand and private seal for want of public seal Done in the Town of Livingston this 14th day of October A. D. 1847.
