Daniel ELPHINSTONE did not die in Edinburgh. He was transported for life to
N.S.W. on the ship Royal Charlotte, 1825, & died in Parramatta in 1846.
He was tried & found guilty of the murder of his mother-in-law, Mary STARK

The Scotsman Wednesday 7th July 1824 - Page 6
We understand the Lord Provost yesterday morning received a reprieve, during
his majesty's pleasure, for the unfortunate young man Elphinstone, at present
under sentence of death in our jail, for the murder of his mother-in-law in the
month of February last.
The Scotsman Wednesday 7th August 1824 - Page 6
The sentence of death on Daniel Elphinstone, for killing his mother-in-law,

From 'The Scotsman' newspaper Weds. Sept 1st, 1824

hulks, previous to being sent off to their ulterior(?) destination, viz:
Daniel McKINNON, Thomas ROSS, William WOOD, Daniel GOW, James SCOTT, Daniel
ELPHINSTONE, and Benjamin Ross, for life.
From Chris Piggott:

Daniel alias Donald ELPHINSTONE; Convicted - Edinburgh Court of Justiciary;

1828 N.S.W. Census - Ref E0422. ELPHINSTONE, D., Royal Charlotte, Engineer's
Dept, Parramatta.
Granted Ticket-of-Leave to remain in the District of Parramatta, 31 Jun 1829.
Endorsement on the Ticket-of-Leave stubb (same reference as above) -
Ticket-of-Leave torn up and cancelled, 7 Nov 1831.
[The handwriting on the stubb was very hard to read, but the sense I got from
what I could read was that it became known that the T-o-L had been obtained
under the false pretence that his term was for 7 years. It remains unexplained
why it took over 2 years for this to be discovered.]
Index to Colonial Secretary's Correspondence - Letter Ref #31/8322, Shelf

[I have not seen this letter - the #31 suggests the year 1831]
N.S.W. State Library, Reel 2688, Ref #34/1213 - Renewee Ticket-of-Leave, to
remain in the District of Pennant Hills, dated 20 Jun 1834.
Endorsement on the above T-o-L stubb - C.P. Jun 1843.
Archives Office of N.S.W. Fiche 828, Ref #27/2535 - Conditional Pardon granted
1 Jun 1843, on the reccommendation of Rev H.H. ROBART, James URQUHART, Henry
HARRIS, & G.W. ELIOTT.
[Rev H. H. ROBART was Anglican Minister at Parramatta.]
If it is true that he was 45 when he died in 1846, and that his father was
Adam, then maybe he was baptized as James:
