I, Sarah Winter of No. 2 Merton Villas, Central Hill, Upper Norwood in the County of Surrey, widow, declare this to be a codicil to my last Will and Testament dated the Eighth day of December One Thousand Eight Hundred and Eighty Four (1884) whereas by my said Will I have bequeathed to my eldest daughter Sarah Anne Deslandes since deceased, one sixth part of my property, now I hereby revoke such bequest and bequeath such one sixth part share of my property to my youngest daughter Harriett Decima Underwood, wife of William Elphinestone Underwood of the Madras Civil Service now residing at Mantoddy, Southern India in addition to any other share of interest she may take in my property under my said Will and in all other respects, I confirmed my said Will.  In witness whereof I have hereunto set my hand this Fifth day of November One Thousand Eight Hundred and Eighty Five (1885).

This is a Codicil to the last Will and Testament of me Sarah Winter of 2, Merton Villas, Central Hill, Norwood in the County of Surrey and now temporarily residing at Saint Helier in the Island of Jersey, widow of the late George Winter of Galle in the Island of Ceylon such Will bearing the date the Eighth day of December One Thousand Eight Hundred and Eighty Four (1884), I hereby revoke the appointment of Daniel Blythe as one of the executors and trustees of my said Will and in his place and stead I hereby nominate and appoint Edward Deslandes Bowman now living at Baddegama in the said Island of Ceylon, executor and trustee of my said Will jointly with Harriett Decima Underwood therein appointed and I hereby give unto the said Harriett Decima Underwood and Edward Deslandes Bowman, all estates, power and authority given by my said Will to the said Harriett Decima Underwood and Daniel Blythe in the same way as if the name of the said Edward Deslandes Bowman had been inserted in my Will instead of that of the said Daniel Blythe.

 

And whereas the said Harriett Decima Underwood and Edward Deslandes Bowman both reside abroad and it is expedient that I should appoint an executrix to act in England now I hereby limit the appointment of the said Harriett Decima Underwood and Edward Deslandes Bowman as executrix and executor of my Will to such property and effects as may be situated out of England at the time of my death and I hereby appoint my daughter Susannah Caroline Daly as sole executrix of my said Will so far as relates to all my property and effects as may be situated in England at the time of my death and I direct her to apply and deal with such property and effects in accordance with the bequests and directions contained and set forth in my Will and any previous Codicil thereto in regard to such property and effects and in all other respects I hereby ratify and confirm my said Will (except insofar as modified by previous codicil thereto (and I hereby ratify and confirm the said codicil).

 

In witness whereof I, the said Sarah Winter, hereunto set my hand this Fourth day of June One Thousand Eight Hundred and Eighty Six (1886).

I, Sarah Winter formerly of 2, Merton Villas, Central Hill, Norwood in the County of Surrey but presently residing at 23, The Boltons, South Kensington in the County of Middlesex, widow of the late George Winter of Galle in the Island of Ceylon, Esquire, declare this to be a third Codicil in my Will which is dated the Eighth day of December One Thousand Eight Hundred and Eighty Four (1884).

 

Whereas since the date of my said Will I have sold the furniture and household effects which were in and about my former residence No, 2, Merton Villas aforesaid and the lease of such residence has also since expired.  Now I hereby revoke the legacies of Five Hundred Rupees and One Thousand Rupees respectively bequeathed to my grand nieces Lily Taylor and Nellie Davies and in lieu thereof I bequeath to my grand daughter Sarah Cresse Winter the sum of Five Hundred Rupees and to my grand daughter Gertrude Evelyn Winter the sum of One Thousand Rupees and I declare that my Will shall according be read as if the names of Sarah Cresse Winter and Gertrude Evelyn Winter had been respectively inserted therein in lieu of those of Lily Taylor and Nellie Davies.  I revoke the bequeath to my said grand daughter Evelyn Gertrude Winter and Sarah Cresse Winter of a one sixth part of my residuary estate in lieu thereof I bequeath the same and to the intent that all the provisions of my said Will may be applicable thereto I direct that my said Will shall be read if the same had been thereby bequeathed to the trustees or trustees of my said Will upon trust in the first place to raise thereout and pay to each of my grand daughters Gertrude Evelyn Winter and Sarah Cressee Winter the sum of One Thousand Rupees and subject thereto upon trust for my grandson Alfred William Rosmale Cocq Winter for his own absolute use and benefit, in all other respects I confirm my said Will.  In witness whereof I have hereunto set my hand this Sixteenth Day of April One Thousand Eight Hundred and Eighty Nine (1889).

I, Sarah Winter, widow of the late George Winter of Galle in the Island of Ceylon declare this to be a fourth Codicil to my Will which is dated the Eighth day of December One Thousand Eight Hundred and Eighty Four (1884).  I give my grandson Alfred William Rosmale Cocq Winter the share of Baddegama estate which I acquired from his father Octavius Winter.  I revoke the gift to the children of my deceased daughter Lydia Septima Bowman of one sixth part of my residuary estate and in lieu thereof I bequeath the same (and to the extent that all the provisions of my said Will may be applicable thereof), direct my said Will shall be read as if the same had been bequeathed to the trustees or trustee of my said Will upon trust in the first place thereout to pay to each of my grandchildren Caroline Bowman and Lydia Daisy Bowman the sum of One Thousand Rupees and subject thereto upon trust for my grandson Edward Deslandes Bowman in consideration of his past and present exertions for the general benefit of the Baddegama Estate in all other respects I confirm my said Will and the three previous Codicils.  In witness whereof I have hereunto set my hand the Seventh day of December One Thousand Eight Hundred and Eighty Nine (1889).

This is a Codicil to the last Will and Testament of me, Sarah Winter, presently of Galle in the Island of Ceylon.

 

1. I give, bequeath and devise all that estate called and known as Bopa situated at Wataraka and Bopa within the four gravets (?) of Galle consisting of eight allotments of land on the banks of the Keppo Ela as per survey figure dated 27th January 1849 made by C. H. Speldewinde, Surveyor and containing in extent A..38 H.O.P. 32.43 if the same shall remain unsold at the time of my demise to my beloved grand daughter Gertrude Evelyn Winter for her sole and absolute use.

 

2. I revoke all dispositions of the aforesaid estate heretofore made either by my last Will or by my Codicil attached thereto hereby ratifying and confirming in all other respects the provisions of my said Will.

I, Edwin Rowland Anthonisz of Galle Notary Public do hereby certify and attest that the foregoing instrument having been duly read over by Mrs Sarah Winter presently of Galle (who is known to me) in the presence of Charles Arnold Anthonisz and Solomon Wickramatunga both of Galle subscribing witnesses thereto (who are also known to me) the same was declared by the said Mrs Sarah Winter to be a Codicil to her last Will and Testament and was signed by the said executrix as well as by the said witnesses and by be the said notary in the presence of one another all being present at the same time and place at Galle on this 10th day of January One Thousand Eight Hundred and Ninety One (1891).

In 1917 Ally managed to buy out the shares of some of the shareholders of Baddegama to purchase Pillagoda and the Deeds give very detailed information about the family.

Susannah Caroline Rosmale Cocq who married Robert Charles Rosemale Cocq sold her one twentieth share to her brother Edward James Winter who became entitled to two undivided twentieth part of shares or one undivided tenth part and died intestate leaving his heir, his mother Sarah Winter and his nine brothers and sisters namely:

Letters of Administratrix were issued to his mother Sarah Winter on 18.11.1862 in Testamentary Action No. 1850 in Galle.

 

The one undivided tenth share of Baddegama estate was sold to the firm Winter and Sons as appeared in the final account dated 16.10.1873 filed in the above Testamentary case.

Sarah Winter was entitled to one half share and each of the others to a one sixteenth share therein, the one tenth share became vested in the partners in the proportion of one twentieth share to Sarah Winter and one undivided one hundred and sixtieth share in each of the others.

 

Henry Frank Winter was entitled to one undivided twentieth share under the Will of George Winter and one undivided one hundred and sixtieth share by right of purchase from the administratix of the estate of Edward James Winter, together equal to nine undivided one hundred and sixtieth share in Baddegama estate which he sold to Robert Charles Rosmale Cocq by a deed dated 9.12.1864 attested by Hillary Donald Jansz of Galle, Notary Public.

 

Robert Charles Rosmale Cocq being entitled to nine undivided one hundred and sixtieth shares in Baddegama estate died at Glan-y-Mor, Torquay, Devon, England on 25.12.1866 having made his Will dated 17.5.1861, appointed his widow administratrix, which was proved on 12.2.1867 in the High Court of Justice in England.

 

Susannah Caroline Rosmale Cocq later intermarried with Major General J. Thornhill Bushby and thereafter became his widow.  She appointed Edward Deslandes Bowman as attorney on 4.11.1905 to administer the property in Ceylon in Testamentary Case 2535 of 9.8.1906 in District Court, Colombo.

 

The nine undivided one hundred and sixtieth share held by R. C. R. Cocq was sold by E D. Bowman to Amelia Hopfengartner for six thousand rupees (Rs. 6,000).

 

Amelia Hopfengartner was entitled to one undivided twentieth share held in community with her husband Carl Hopfengartner under the Will of George Winter and one undivided one hundred and sixtieth share by purchase from the estate of Edward James Winter, together equal to nine undivided one hundred and sixtieth share in Baddegama Estate, died intestate on 9.4.1869 leaving her husband entitled to one half of nine undivided one hundred and sixtieth shares, that is, nine undivided three hundred and twentieth shares.  She also left as heirs her two children Anne Hopfengartner and Herman Hopfengartner who became entitled to the remaining one half of nine undivided one hundred and sixtieth shares, that is, each of them became entitled to nine undivided six hundred and fortieth share in Baddegama estate.

 

Charles Deslandes Church Winter married Alice Jane Lee and by indenture made on 26.7.1873 with himself on the one part, Alice Jane Lee on the second part and Reverend George William Burrow-Wills and Haverstock Hodsell Bowman of the third part, created a trust of his interest in Baddegama for the survivor.  Haverstock Hodsell Bowman died on 24.8.1880, Charles Deslandes Church Winter died on 8.4.1881 and George William Burrow-Wills on 7.1.1886.  Alice Jane Lee (formerly Winter) married George Maxwell Reilly.  By an indenture dated 23.12.1886 she appointed Thomas Warren Saxby, John Billingsley Richardson and Paul Quick Karkeek to be trustees.  By a Deed No. 557 dated 27.1.1905 attested by D. G. Gunawardne of Galle, the Trustees conveyed the nine undivided one hundred and sixtieth shares of Baddegama estate to Edward Deslandes Bowman.

 

Lydia Septima Bowman nee Winter married Haverstock Hodsell Bowman on 6.1.1858 and entered into a marriage settlement on 6.1.1858 No. 1572 enabling her to dispose of her interest as if she had remained a "femme sole".  Whereas she was entitled to one undivided twentieth share of Baddegama estate under the Will of her father George Winter and one undivided one hundred and sixtieth share by right of purchase from the estate of Edward James Winter together equal to nine undivided one hundred and sixtieth shares.  She died in September 1863 leaving as her heirs Haverstock Hodsell Bowman and her four children Annie Curtis nee Bowman, wife of Steuart Binny Curtis, Caroline Harriett Bowman, Edward Deslandes Bowman and Lydia Margaret Bowman.  By her Will dated 16.9.1863 she left to her husband the above shares for the education and support of her children until the youngest attained the age of 21 years and thereafter for the benefit of her husband until his death when they were bequeathed to her children.  Her last Will was proved in the District Court, Galle in Testamentary Action No. 2264 on 17.3.1879.  Her husband Haverstock Hodsell Bowman died on 2.4.8.1880.  Lydia Septima Bowman's children became entitled to nine undivided one hundred and sixtieth shares equally, that is, each of them Annie Curtis nee Bowman, Caroline Harriett Bowman, Edward Deslandes Bowman and Lydia Margaret Bowman, nine undivided six hundred and fortieth shares in Baddegama estate.

 

George Walter Winter being entitled to one undivided twentieth share under the Will of his father George Winter and one undivided one hundred and sixtieth share by right of purchase from the estate of his brother Edward James Winter together equal nine undivided one hundred and sixtieth shares in Baddegama Estate, died intestate at Baddegama on 1.4.1875 leaving his widow Harriett Isabel Winter nee Leighton who became entitled to one half share of the nine undivided one hundred and sixtieth shares, that is, nine undivided three hundred and twentieth shares and his four children, namely Walter Henry Trinnell Winter, Mary de Sevigne Winter, Alice Beatrice Deslandes Winter and Harriett Rochford Shortland nee Winter each of whom became entitled to one fourth of one half of the nine undivided one hundred and sixtieth shares, that is, nine undivided one thousand two hundred and eightieth parts.

 

Alfred Octavius Winter being entitled to one undivided twentieth share under the Will of his father George Winter and one undivided one hundred and sixtieth share by right of purchase under the estate of his brother Edward James Winter, together each to nine undivided one hundred and sixtieth shares in Baddegama estate, sold and conveyed to his mother Sarah Winter by Deed No. 5t1 dated 7..11.1881, attested by Edwin Rowland Anthonisz, of Galle, Notary Public.

 

Sarah Anne Deslandes being entitled to nine undivided one hundred and sixtieth share under the Will of her father George Winter and by purchase from the estate of her brother Edward James Winter died intestate in Jersey on 8.6.1885 leaving as her heirs her husband Jos. Deslandes who became entitled to one half of the nine undivided one hundred and sixtieth shares and her mother Sarah Winter who became entitled to one fourth of the nine undivided one hundred and sixtieth shares equivalent to nine undivided six hundred and fortieth shares, her sisters Susannah Caroline Rosmale Cocq (then Susannah Caroline Daly and afterwards Susannah Caroline Bushby) and Harriett Decima Underwood and her brother Henry Frank Winter each became entitled to one eighth of one fourth of the nine undivided one hundred and sixtieth shares, that is, to nine undivided five thousand one hundred and twentieth shares of Baddegama estate.

 

Walter Henry Trinnell Winter, Mary de Sevigne Winter, Alice Beatrice Deslandes Winter and Harriett Ethel Rochford Shortland nee Winter, wife of Talbot Shortland being the children of her deceased brother George Walter Winter, each became entitled to one fourth of one eighth of one fourth of the nine undivided one hundred and sixtieth share, that is to nine undivided twenty thousand four hundred and eightieth share of Baddegama Estate.

 

Annie Hopfengarter and Herman Hopfengartner being the children of her deceased sister Amelia Hopfengartner each became entitled to one half of on eighth of one fourth of the nine undivided one hundred and sixtieth shares, that is, nine undivided ten thousand two hundred and fortieth share of Baddegama Estate.

 

Annie Curtis nee Bowman, Caroline Harriett Bowman, Edward Deslandes Bowman and Lydia Margaret Bowman being the children of her deceased sister Lydia Septima Bowman, each became entitled to one fourth of the one eighth of the one fourth of the nine undivided one hundred and sixtieth shares, that is, nine undivided twenty thousand four hundred and eightieth share of Baddegama Estate.

 

Evelyn Gertrude Winter afterwards Evelyn Gertrude Bowman, Charles Henry Winter, Sarah Cresse Winter, afterwards Sarah Cresse Chesshyre, William Sextus Daly Winter, Edmund Winter, George Edward Winter and Alfred William Winter being the children of her deceased brother Alfred Octavius Winter each became entitled to one seventh of one eighth of one fourth of the nine undivided one hundred and sixtieth share, that is, nine undivided thirty five thousand eight hundred and fortieth share.

 

Percy Gibson Deslandes Winter, Charles Bertram Lee Winter and Hilda Beatrice Winter being the children of her deceased brother Charles Deslandes Church Winter each became entitled to one third of one fourth of the nine undivided one hundred and sixtieth share, that is nine undivided fifteen thousand three hundred and sixtieth share of Baddegama Estate.

 

Henry Frank Winter during his lifetime sold the undivided twentieth share to which he was entitled under the Will of his father George Winter and the one undivided one hundred and sixtieth share which he became entitled by purchase from the estate of Edward James Winter and was at the time of his death only entitled to nine undivided five thousand one hundred and twentieth share as one of the heirs of Sarah Deslandes.  He died intestate and unmarried at Jersey on 10.4.1891 leaving in Ceylon property below the value of Rs.1,000 and as his heirs, his mother Sarah Winter who became entitled to one half of the nine undivided five thousand one hundred and twentieth shares, his two sisters Susannah Caroline Bushby and Harriett Decima Underwood became entitled to one seventh of one half of the nine undivided five thousand one hundred and twentieth share, that is to nine undivided sevnty one thousand six hundred and eightieth part.

 

Walter Henry Trinnell Winter, Mary de Sevigne Perry nee Winter wife of Arthur Perry, Alice Beatrice Deslandes Winter and Harriett Ethel Rochford Shortland nee Winter being the children of his deceased brother George Walter Winter each became entitled to one fourth of one seventh of the nine undivided five thousand one hundred and twentieth share, that is, nine undivided two hundred and eighty six thousand seven hundred and twentieth share of Baddegama Estate.

 

Annie Hopfengartner and Herman Hopfengartner being the children of his deceased sister Amelia Hopfengartner each became entitled to one half of one seventh of one half of the nine undivided five thousand one hundred and twentieth share, that is, to nine undivided one hundred and forty three thousand three hundred and sixtieth share of Baddegama Estate.

 

Caroline Harriett Bowman, Edward Deslandes Bowman and Lydia Margaret Bowman, Muriel Annie Curtis, Eleanor Margaret Curtis and Lilian Mary Curtis being the children of the said Annie Curtis deceased each became entitled to one fourth of one seventh of one half of the nine undivided five thousand one hundred and twentieth share, that is, to nine undivided two hundred and eighty six thousand seven hundred and twentieth share of Baddegama Estate

 

Muriel Annie Curtis, Eleanor Margaret Curtis and Lilian Mary Curtis became entitled to one fourth of one seventh of one half of the nine undivided five thousand six hundred and twentieth share of nine undivided two hundred and eighty six thousand seven hundred and twentieth share of Baddegama Estate.

 

Evelyn Gertrude Bowman nee Winter, Charles Henry Winter, Sarah Cresse Chesshyre nee Winter, William Sextus Daly Winter, Edmund Winter, George Edward Winter and Alfred William Winter being the children of his deceased brother Alfred Octavius Winter each became entitled to one seventh of one seventh of one half of the said nine undivided five hundred and one thousand seven hundred and sixtieth share of Baddegama Estate.

 

Percy Gibson Deslandes Winter, Charles Bertram Lee Winter and Hilda Beatrice Winter being the children of his deceased brother Charles Deslandes Church Winter became entitled to one third of one seventh of one half of the nine undivided five thousand one hundred and twentieth share, that is, to nine undivided two hundred and fifteen thousand and fortieth share of Baddegama estate.

 

Sarah Winter being entitled to:

 

(a) an undivided half share of Baddegama Estate under the Will of her husband George Winter.

 

(b) to one twentieth share by right of purchase from the estate of her son Edward James Winter.

 

(c) to nine undivided one hundred and sixtieth share purchased from her son Alfred Octavius Winter.

 

(d) to nine undivided six hundred and fortieth share as one of the heirs of her daughter Sarah Deslandes.

 

(e) to nine undivided ten thousand two hundred and fortieth share as one of the heirs of her son Henry Frank Winter.

 

died at Baddegama on 5.1.1892 leaving a Will and Testament dated 8.12.1884 and five codicils dated respectively 5.11.1885, 4.6.1886, 1.6.4.1889, 7.12.1889. and 20.2.1891 where inter alia she appointed Harriett Decima Underwood and Edward Deslandes Bowman to be executors and gave her grandson Alfred William Winter the share which she acquired from his father Alfred Octavius Winter, to wit, nine undivided one hundred and sixtieth share of Baddegama Estate.

 

The remaining shares amounting to one thousand one hundred and fify seven undivided two thousand and forty eighth share she left as follows:

 

One sixth thereof to her daughter-in-law Harriett Isabel Winter.

One sixth to her daughter Susannah Caroline Bushby.

One sixth to her grandson Edward Deslandes Bowman.

One sixth to her grandson Alfred William Winter and

One third to Harriett Decima Underwood.

 

Harriett Isabel Winter being entitled to:

 

(a) a half of nine undivided one hundred and sixtieth share by marriage (b) to one sixth of one thousand one hundred and fifty seven undivided two thousand and forty eighth share under the Will of Sarah Winter amounting in aggregate to seven thousand five hundred and thirteen undivided six one thousand four hundred and fortieth share, died at the Stalls, Worcester, England on 29.2.1895, leaving a last Will and testament dated 18.12.1855 attested by Trutland Frederick Morgan of Galle, Notary Public whereby she appointed George Walter Winter sole heir and after his death equally amongst her children Walter Henry Trinnell Winter, Mary de Sevigné Perry nee Winter, Alice Beatrice Deslandes Winter and Harriett Ethel Rochford Shortland nee Winter.

 

As George Walter Winter and Haverstock Hodsell Bowman had predeceased her Mary de Sevigné Perry nee Winter as one of the heirs of Harriett Isabel Winter proved the Will in the Principal Probate Registry of her Late Majesty's High Court of Justice in England and Letters of Administration under the seal of the Court were granted her on 22.11.1895.

 

Mary de Sevigné Perry nee Winter being entitled to inter alia one fourth of seven thousand five hundred and thirteen undivided sixty one thousand four hundred and fortieth share died at No. 524, Barking Road, Essex, England on 5.8.1900 leaving a last Will dated 26.9.1899 appointed her friend Eliza Bathurst of No. 31, Palace Garden Terrace Kensington, London her sole executrix.

 

Probate was granted to Eliza Bathurst of 31, Palace Garden Terrace in the High Court of Justice on 16.10.1900 who appointed Edward Deslandes Bowman to be her attorney and apply for Letters of Administration concerning her property in Ceylon which was granted on 10.11.1905 by the District Court of Colombo in Testamentary Action No. 2433.

 

Walter Henry Trinnell Winter, Alice Beatrice Deslandes Winter, Harriett Ethel Rochford Shortland and Talbot Shortland and the said Eliza Bathurst as executrix of the Will of Mary de Sevigné Perry nee Winter a Power of Attorney dated 17th and 18th May 1905 appointed Edward Deslandes Bowman to apply for Letters of Administration.

 

Edward Deslandes Bowman by Deed No. 724 dated 22.87.1906 transferred to:

 

(a) Walter Henry Trinnell Winter and undivided one fourth share.

 

(b) to Edward Deslandes Bowman as administrator of the estate of Mary de Sevigné Perry an undivided one fourth share.

 

(c) to Alice Beatrice Deslandes Winter an undivided one fourth share.

 

(d) to Harriett Ethel Rochford Shortland an undivided one fourth share of the said seven thousand five hundred and thirteen undivided sixty one thousand four hundred and fortieth share of Baddegama estate to which Harriett Isabel Winter was entitled.

 

Edward Deslandes Bowman as administrator of the Will of Mary de Sevigné Perry was entitled to the following shares:

 

(a) nine undivided one thousand two hundred and eightieth share being the share to which Mary de Sevigné Perry became entitled under the Will of her father George Walter Winter.

 

(b) to nine undivided twenty thousand four hundred and eightieth share being the share to which Mary de Sevigné Perry became entitled as one of the heirs of Sarah Anne Deslandes.

 

(c) to nine undivided two hundred and eighty six thousand seven hundred and twentieth share being the share to which Mary de Sevigné Perry became entitled as one of the heirs of Henry Frank Winter and

 

(d) to seven thousand five hundred and thirteen undivided two hundred and forty five thousand seven hundred and sixtieth share to which Mary de Sevigné Perry became entitled under the Will of her mother Harriett Isabel Winter which shares amounted in aggregate to sixty five thousand four hundred and ninety seven undivided one million seven hundred and sixteen thousand three hundred and twentieth share in Baddegama estate.

 

Mary de Sevigné Perry nee Winter in her Will bequeathed to Eliza Bathurst all her real and personal property and to dispose of it as she will.  Edward Deslandes Bowman as administrator of the property in Ceylon of Mary de Sevigné Perry transferred to Eliza Bathurst her heir, the sixty five thousand four hundred and ninety seven undivided nine million seven hundred and twenty thousand three hundred and twentieth share in Baddegama estate.

 

But Eliza Bathurst by Deed No. 779 dated 30.12.1907 attested by W. A. S de Vos of Colombo, Notary Public conveyed by way of gift to Harriett Ethel Rochford Shortland and Alice Beatrice Deslandes Winter the said shares in equal proportion, that is, to each of them five thousand four hundred and ninety seven undivided three million four hundred and forty thousand six hundred and fortieth shares.

 

Harriett Decima Underwood was entitled to the following share:

 

(a) One twentieth share under the Will of her father George Winter.

 

(b) to one undivided one hundred and sixtieth share by right of purchase from the estate of Edward James Winter.

 

(c) to nine undivided five thousand one hundred and twentieth share as one of the heirs of Sarah Anne Deslandes.

 

(d) to nine undivided seventy one thousand six hundred and eightieth share as one of the heirs of Henry Frank Winter.

 

(e) to one third of one thousand one hundred and fifty seven undivided two thousand and forty eighth share under the Will of Sarah Winter which totalled to thirteen thousand two hundred and forty nine undivided fifty three thousand seven hundred and sixtieth share of Baddegama estate.

 

Harriett Decima Underwood and William Elphinestone Underwood being married, the above share was held by them in common, that is, each of them held one half of the shares.

 

William Elphinestone Underwood died intestate at the Queen's Jubilee Hospital, Richmond Road, Earl's Court, Middlesex, England on 4.8.1906 leaving four children namely Robert Charles Elphinestone Underwood, William Elphinestone Underwood, Sarah Jessie Eyre nee Underwood and Arthur Cresse Underwood.

 

Sarah Jessie Eyre as one of the heirs by a Power of Attorney dated 15.4.1907 nominated Edward Deslandes Bowman to be her attorney in Ceylon and apply for Letters of Administration who by Deed No. 971 dated 15.7.1907 attested by W. A. S. de Vos of Colombo, Notary Public, conveyed the said thirteen thousand two hundred and forty nine undivided fifty three thousand seven hundred and sixtieth share to the above children in equal shares, that is, to each thirteen thousand two hundred and forty nine undivided two hundred and fifteen thousand and fortieth share in Baddegama Estate.

 

Susannah Caroline Bushby was at the time of her death entitled to:

 

(a) nine undivided five thousand one hundred and twentieth share as one of the heirs of Sarah Anne Deslandes.

 

(b) to nine undivided seventy one thousand six hundred and eightieth share as one of the heirs of Henry Frank Winter.

 

(c) to one sixth of on thousand one hundred and fifty seven undivided two thousand and forty eighth share of one thousand one hundred and fifty seven undivided twelve thousand two hundred and eighty eighth share under the Will of her mother Sarah Winter which share totalled to eight thousand two hundred and sixty one undivided eighty six thousand and sixteenth share in Baddegama estate,

 

She died at "Glan-y-Mor", Torquay, Devon, England on 12.3.1907 leaving a last Will and Testament dated 7.3.1907 whereby she appointed her nephew Edward Deslandes Bowman to be executor so far as her property in Ceylon was concerned and therein inter alia, bequeathed to her nephew Alfred William Winter also known as Alfred William Rosemale Cocq Winter all her share and interest in Pillagoda estate.

 

The said Pillagoda estate is comprised of four contiguous allotments of land called Mapalawatte Pillagokande, Pilagodawewa and Thimbillekande forming a defined portion of Baddegama Estate.

 

The Will was proved on 18.4.1907 in his late Majesty's High Court of Justice in England and probate given to Edward Deslandes Bowman on 22.8.1907 in the District Court of Colombo and under the terms of the Will of Susannah Caroline Bushby, Alfred William Winter became entitled to her entire share to wit, eight thousand two hundred and sixty one undivided eighty sixty thousand and sixteen shares of and in Pillagoda estate which was conveyed by Edward Deslandes Bowman as executor by Deed No. 1289 dated 19.11.1909 attested by W. A. S. de Vos of Colombo, NotaryPublic.
