4. Leominster: A LIQUOR CASE
Saturday was a "field day" in the court calendar, Mrs. "Maggie" Reed having brought a complaint against Mrs. Margaret Hart for the illegal sale of cider. There has not been the best of feeling between the two parties of late. The case has created a great deal of excitement and at the hour of trialJustice Merriam's office was crowded. John R. Thayer of Worcester appeared for Mrs. Hart, and John W. Walsh of Fitchburg for Mrs. Reed, who was the principal witness for the government. She testified to having bought cider of Mrs. Hart; was washing for her on a certain Monday; bought a glass of cider and paid her five cents, drank both glasses in her house, also bought cider there for pies. Mr. Thayer gave the witness a severe cross-examination, but she still swore to buying the cider. Other witnesses were examined for the government, but no direct testimony for conviction was gained. Mr. Hart, husband of the defendant, testified: Got the apples of Mr. Willard on halves; made cider myself; think I had two or three barrels; it was more than I wanted, so the "brick-yard hands" came up and I sold it out to them by the gallon; never sold cider to man, woman or child, to be drank on the premises. Miss Matilda Hart, daughter of the defendant, testified: [Matilda is about 19 yrs old, bks] Live near Mrs. Reed; our yards join. (Mrs. Reed made her complaint two weeks ago and the case was continued until today). Mrs. Reed called me over to her house and said: "Hope you have no hard feeling against me; I want to get out of this; will give you $5 to say I got the cider in your house, and it won't cost you anything." I told her that would be wrong and I would not do it. I won't take a false oath; she told me she had often done that and no harm came of it; saw her again, last Friday, in her yard, between 10 and 11 o'clock; she wanted me to see my father and have him settle it up; said we can go down and see Esquire Merriam and stop the case, and she would do it if he would give her $8; then they could telegraph to the lawyers not to come; was at home when Mrs. Reed washed, but saw no cider furnished her.
Croos-examined: My mother never had trouble with Mrs. Reed, only when she came over there to fight with her. Mrs. Reed was not sober yesterday. Nellie Keefe testified: Have lived with Mrs. Hart two years; last night, after coming home, had a talk with Mrs. Reed; she wished me to speak with Mrs. Hart about settling the case; she told me she got no cider there and hated to go into court and say so; wanted to borrow money to pay her counsel; never saw any one drink cider there. Edward Obeshaw testified that he went to Hart's for a gallon of cider; went once for less but was refused. Cross-examined: Couldn't tell whether it was in spring or summer when I bought it; there was no snow on the ground.
Margaret Obey testified: Mrs. Reed told me she had never got cider there. Emily Dillel testified: Live in house with Mrs. Reed; she asked me to see Mr. Hart and get him to settle; she told me she had never got cider there; she had just made a complaint against Mrs. Reed for drunkeness. Joseph Dillel testified: Heard Mrs. Reed say she had never bought cider of Mrs. Hart. Mrs. Hart, the defendant, testified that her husband had told her not to sell less than a gallon; never sold any to be drank on the premises; I had a talk yesterday in the yard with Mrs. Reed; she told me it was a shame to go to trial, said she had never bought cider of me and she could not stand up in court and say so; she told me if my husband would give her $6 or $7 she would go down to Merriam and settle up. At 7 o'clock she came and asked me if I had done anything about it; told her no; I never sold her cider; paid her $1 for washing; she gave me 20 cents back in change; when I told her I had engaged a lawyer and would not stop it, she said, "my God, what shall I do?" Mrs. Reed said: "I have no hard feelings against you; I want to kiss you." I told her she shouldn't do it.
Mrs. Reed was re-called and swore positively she bought the cider there and had not spoken one word to the witnesses for several days. They have all sworn falsely. Mr. Thayer on cross-examination was very earnest. "Do you say Mrs. Hart is a liar?" "Yes, and Miss Hart and Miss Keefe." Then Mr. Thayer pointed out all the witnesses separately, and asked the same question. Mrs. Reed responded, "Yes, they are all liars."
The case was well argued on both sides. the justice, after summing up the case, ordered the defendant discharged. (The Fitchburg Sentinel, Sept. 11, 1882, p. 3)5. Leominster March 8 - Charles E. Hart, 74, of 14 Morse place, died last night in the Leominster hospital. He had been employed as a cook in local lunch carts and restaurants. His nearest survivors are nieces and nephews. The funeral will be from the Philip E. Foster funeral home Monday morning with a high mass of requiem at 9 o'clock in St. Leo's church. Burial will be in the parish cemetery. Calling hours will be in the funeral home tonight from 7 to 9 and tomorrow from 2 to 4 and 7 to 9 o'clock. (Fitchburg Sentinel, Sat. 8 Mar. 1947, p. 8)

The funeral of Mrs. Margaret T. May was held from St. Bernard's church this morning with a high mass of requiem at 9 o'clock, celebrated by Rev. Fr. John A. Martin, who also officiated at the service in St. Bernard's cemetery. There was a large congregation present while the floral offerings were beautiful. The music was furnished by the church quartet with Miss M. G. Carey at the organ. The bearers were Joseph Alord, Charles Hart, and John M. Hart of Leominster, and John Quinn of this city.
