BIOGRAPHY
Orphaned at an early age, Colonel McKinstry made his way to Mobile where he had relatives and found employment, at fourteen, in a drug store where for several years he remained. He later read law in the office of Hon. John A. Campbell who subsequently became a U. S. supreme court judge, and at once showed a marked aptitude for the legal profession. He was admitted to the bar in 1845 and the following year formed a partnership with William. G. Jones.

During these first years of his public career he filled the offices of alderman of Mobile, notary public, commissioner of revenue of Mobile County, of which board he was president, and commissioner of roads of the county. He was elected colonel of the 48th Alabama infantry regiment, 9th brigade, 4th division State militia in 1847, but resigned this office in 1850. During that year he was elected judge of the city of Mobile, re-elected in 1856, and resigned in 1860 to resume his practice in partnership with Daniel Chandler. Although strongly opposed to the Secession movement he surrendered his judgment to the will of the people and on April 29, 1862, was commissioned colonel 32nd Alabama infantry regiment under special order; September 21, 1862, he was assigned to the command of the post of Chattanooga and the troops between Hiawassa and Bridgeport.

On April 6, 1864, he was commissioned colonel of cavalry, attached to Maj. Gen. N. B. Forrest, and was later assigned to the duty of provost marshal general of the Army of Tennessee, the State of Alabama and North Georgia under Gen. Braxton Bragg. He was president of the military court attached to Gen. N. B. Forrest’s command from the spring of 1864 until the close of the war.

He returned to Mobile and resumed the practice of law, in the State, U. S. courts, and before the U. S. supreme court. In the fall of 1865 he was elected to the Alabama legislature from Mobile County and was made chairman of the judiciary committee, and a member on the committee on the revision of the code which was adopted in 1867. In 1869 he was again elected to the legislature and in 1872 was elected lieutenant governor of the state. He was an Episcopalian. Parents: Alexander MCKINSTRY and Elizabeth THOMPSON.

Death of a Former Winnebago Boy. (From the Stamford Conn. Daily Advocate of July 22, 1921): Arthur P. McKinstry, lawyer and senior partner of the firm of McKinstry, Taylor & Patterson, who died early Thursday morning at St. Luke's hospital, New York City, after an operation on Tuesday, was born in Winnebago City, Minnesota, on Dec. 22, 1881, the son of the late Henry McKinstry and Alice Packer McKinstry, of Worcester, Mass. After graduating from Yale college in 1905 and Yale law school in 1907, Mr. McKinstry entered the law office of Strong & Cadwalder of New York where he was associated until the fall of 1911, when he formed the firm of Parks & McKinstry. In Aug. 1912, he was appointed associate counsel to the agency of the United States in the matter of the arbitration of claims of nationals of the United States against Great Britain and vice versa; and served in that capacity until the outbreak of the World War, in Aug. 1914, when the prosecution of these claims was indefinitely postponed. During the period of the United States engagement in the war, Mr. McKinstry served as a captain in the army, in the Division of Military Intelligence. Among the philanthropic interests represented by Mr. McKinstry as council were the post graduate hospital and the Heckscher Foundation for children, of which he was a trustee. He was a member of the Bar Association of the city of New York, the Racquet and Tennis, Piping Rock, Yale University, Metropolitan and City Midway Clubs, and of the Society of Phi Beta Kappa. On March 15, 1913, Mr. McKinstry married Margaret Sterling Barkley of Stamford, who died on April 13, 1914. He is survived by his sister Miss Helen McKinstry of New York, and his aunt, Mrs. Helen P. Evens of this city.

(The photograph was taken in front of their home in Winnebago, Wisconsin.) Azro MCKINSTRY was born on 30 July 1844 in Bethel, Vermont. His parents were Paul and Harriet Lilly McKinstry who operated the farm which Azro's great granfather established in the 1780s after moving his family from Tolland, Connecticut to Bethel. After completing school in 1860, Azro apprenticed himself to E. C. Stocker, a harness maker, to serve three years at the trade for the sum of $30, $40, and $50 for each of the three years. In 1862 he received permission from Mr. Stocker to enlist in the Union Army, agreeing to serve out the apprenticeship contract after the war should he be alive.

Azro was mustered in on 6 August 1862, and served in Company H of the 10th Vermont Volunteer Infantry Regiment. His unit saw service as part of the 6th Army Corps under the command of Major General John Sedgwick. His regiment participated in the Battles of the Wilderness and Spotsylvania Court House; incurred heavy losses in the 12-day's of operations at Cold Harbor; participated in the 1864 fall campaign that included battles at Winchester, Fisher's Hill, and Cedar Creek; and was among the first troops to enter the city of Petersburg, Virginia, on April 3, 1865, the day of its capture. Azro was wounded at Cold Harbor on 1 Jun 1864 and spent six months recovering from his wounds in a hospital.

Probably the most important contribution of his regiment was to protect Washington, D.C. against attack at the Battle of Monocacy, near Frederick, Maryland on July 9, 1864. In a bold attempt to relieve pressure on the Confederate Army at Petersburg, General Robert E. Lee sent Confederate forces under the command of General Jubal Early up the Shenandoah Valley to attack Washington DC from the west. The move was successful in the sense that it removed Union troops, including Azro's regiment, as part of General Rickett's 3rd Division, from Petersburg. Ricketts positioned his troops along side those of General Lew Wallace at Monocacy Junction to protect the nation's capitol. The Battle of Monocacy, which pitted the 15,000 troops of Early against half that number of Union troops, was technically a loss for the Union Army. It left nearly 1,300 Union dead and wounded in the retreat that day. However, by delaying for a single day the movement of Early's troops, Washington DC was saved from occupation.

From over two thousand regiments of the Union armies, three hundred were selected as the "fighting regiments" which lost from 134 to 224 men each, killed and died of wounds. Of this number Vermont furnished nine, including the 10th Regiment with 149 losses. [Fox, William F. "Regimental Losses in the American Civil War" (Morningside Bookshop, 1974).] Azro was discharged 1 July 1865 in Burlington, VT.

When mustered out of the army on 22 June 1865, Azro returned and completed his apprenticeship to Mr. Stocker in 1867. He married Lauribel Rogers, the daughter of Oliver P. Rogers that same year. Azro and Lauribel moved to nearby Northfield for two years, then moved to a farm in Bradford. In 1870 they followed Azro's parents in a move to Winnebago, Minnesota. Along with his father, Azro established the Woodlawn Creamry and engaging in general farming and dairying. He represented the State of Minnesota in the New Orleans Centennial Exposition, winning the Grand Sweepstake prize for butter for his State. At the World's Fair in Chicago, he represented the National Dairy Union in its fight against "oleomargarine colored in semblance of butter."

On 12 Sep 1900 Azro was killed when he was thrown from a sulky plow. Azro and Lauribel had two sons and two daughters. Parents: Paul MCKINSTRY II and Harriet LILLY.

bullet Elizabeth MCKINSTRY(476) was born in 1736 in Ellington, CT. She died in 1763. She was buried in McKinstry Cemetery, Ellington, CT. A grisly story surrounds the death of Elizabeth. Betsy was visiting her brother William and rose early in the morning to attend an ordination in a neighboring town. She was heating a flat iron by the fire and bent over the table for a minute when a slave of the family took the iron and hit her over the head. He hid her body under the stairs and fled. When he was arrested, he confessed, explaining that he had been told that if he killed someone and ran away, he would be free. The misguided slave was executed. Parents: Rev. John MCKINSTRY and Elizabeth FAIRFIELD.

OBITUARY
Winnebago Pioneer Dies in the East (Winnebago publication not specified): Because the name Winship is entirely familiar to Winnebago people and to the country side from pioneer days, it will be of interest to our readers to learn of the passing of Mrs. Ellen McKinstry Winship, in Worcester, Mass., where she had made her home since February.

Mrs. Ellen McKinstry Winship, who was born July 6, 1846, passed away July 10 at the age of 88 at a Worcester hospital; death being caused from injuries and a broken hip which were incurred when she fell from a rocking chair when asleep.

Mrs. Winship was the wife of the late Josiah F. Winship. She came to Winnebago with her parents, Paul and Harriet McKinstry in 1870, where she remained until 1900, since which time she has made her home in the East and South. She is the last of a large family of McKinstry children. Interment was made in West Newbury, Vermont, her birthplace.

Mrs. Winship has always belonged to and been a hard worker in the Methodist Episcopal church, Woman’s Foreign Missionary society and W. C. T. U activities. She was preceded in death by her husband, Josiah Winship and one son Louis. She is survived by two step-children, six grandchildren, two great-grandchildren and nephews and nieces.

Frances M. Hunt of Worcester, writes: “The death of Mrs. Winship seems to close up a chapter of Winnebago life so well known to me and to her associates of an earlier time. To say that an affectionate feeling still clings to us who have wondered far is to speak with some restraint for nothing of later contact can replace the old associations.”

Since closing her Winnebago life, Mrs. Winship had resided in Florida until her son Louis was firmly established as and engineer on the Boston and Main railroad. He was situated so he could locate her in Concord and Cambridge, Mass., which were more convenient to his work and he was able to visit her often.

bullet Ezekiel MCKINSTRY was born on 17 Aug 1753 in Ellington, CT. He died on 23 Nov 1803 in Ellington, CT. He was buried in McKinstry Cemetery, Ellington, CT.
Ezekiel was an Ensign in the 7th Continental trainband in the 19th Regiment when in May of 1778, he answered the Lexington Alarm from East Windsor. He was also called Captain.

Ezekiel inherited half of his grandfather’s parsonage and land from his father and received the other half as a gift from his uncle, John. In 1791 Ezekiel sold the parsonage with its barn, cider mill, and most of its land to Moses Thrall. In 1805 Moses’ son Reuben sold the property to Elihu Wolcott who in 1810 sold it to John Hall. After that, nothing is known for certain about the ownership and whereabouts of the parsonage.

In 1900 Mrs. Harriet Delano Fowler of Holyoke, Massachusetts, the granddaughter of John Hall, published an accounting of old Ellington homes. She described the parsonage as large and square and stated that it disappeared before 1825 when her grandfather erected a school on the site. She also claimed that Mrs. Charity Dow’s house once stood on the land purchased by John Hall in “1807” and was removed to its present site on Maple Street. According to a deed in 1804, John Hall purchased 50 acres with a house on the corner of what is now Frog Hollow Road and Pinney Street. About 1809 he erected the house currently [1987] occupied by Emil and Leona DeBortoli. The town tax records for 1786-1819 have disappeared, taking with them information about the parsonage. In 1850 the library received a sketch drawn by the Reverend Mr. George Wood that was supposed to be of the parsonage. This too, has disappeared.
