Last Will and Testament of Johannes Weller (1716-1792)


Frederick County Wills, Liber G.M. #2, Folio 434:

IN THE NAME OF GOD, AMEN.  I, Johannes Weller of Frederick County, in the State of Maryland, Yeoman, being well in body and of perfect mind and memory, blessed be to God, but calling to mind the mortality of my body and knowing that it is appointed for all men once to die, do this day make and ordain this my last Will and Testament in manner following. Principally and first of all I give and recommend my soul into the hands of God that gave it and my body to the Earth to be buried in a decent Christian burial, nothing doubting but at the General Resurrection I shall receive the same again by the mighty Power of God, and as touching such worldly estate it has pleased God to bless me in this this life, I give, devise and dispose of the same in the following manner, Imprimis I will and ordain that after my decease all my just debts be paid and then I give and bequeath to my dear wife Catharine the sum of one hundred pounds lawfull money the sum remaining after her decease, if there should be any, to be divided among my children, share and share alike.

  1. I do give And bequeath unto my daughter Catherine the sum of twenty-four pounds sixteen shillings and ten pence lawfull money.


  2. I give to my son John the sum of Fifty-eight pounds sixteen shillings and ten pence.

  3. I give to my daughter, Magdalena twenty-four pounds sixteen shillings and ten pence.

  4. I have already given and devised unto my son Jacob a certain tract of land called Bickshorn, wherein his legacy is included, and also I give unto him the sum of four pounds, sixteen shillings and ten pence.

  5. I give unto my son Philip the sum of Fifty-eight pounds, sixteen shillings and ten pence.

  6. I give unto my daughter Barbara the sum of Twenty-four pounds, sixteen shillings and ten pence.

  7. I give unto my daughter Margaretta the sum of thirty pounds eight shillings and ten pence.

  8. I give unto my son Frederick the sum of Fifty-eight pounds, sixteen shillings and ten pence.

  9. To my son, Daniel I have given, devised and already conveyed to him and his heirs and assigns forever that Plantation and tract of land with all the appurtenances whereon I now do live known by the name of Part of Arnolds Delight. I also give and bequeath unto him and have given him possession already of my whole stock of cattle and all the implements of husbandry, provided nevertheless that this my son Daniel, his heirs, Executors or Administrators shall pay or cause to be paid into the hands of my Executors, after my decease, if not paid already before the sum of Three hundred and fifty pounds lawfull money in manner following, Via: Thirty pounds every year, until the whole sum is wholy and fully discharged. Also I give unto him the sum of four pounds sixteen shillings and ten pence.

  10. I give unto my son Matthias, the sum of Fifty-eight pounds sixteen shillings and ten pence. It is to be remarked that the greatest part of the aforementioned my children have already in my lifetime received part of their legacy which I have noted down on a particular sheet, where my Executors or Administrators after my decease will be informed by, what will be the remaining sum to be paid to each of my children and act accordingly. LASTLY, as to my movable goods and chattles and household furniture, I will and ordain that after my decease, my beloved wife shall be and remain in full and peaceable possession of the whole, during her lifetime, and after her decease, I will and ordain that the whole be sold at public vendue, and the amount thence arising be equally divided among my heretofore named children, and I do constitute and appoint my beloved son John Weller and Conrad Matthes, Executors of this my last Will and Testament, and I do hereby utterly disallow, revoke and disannul, all and every former Testaments and Wills, legacies and Executors by me in any ways before mentioned named, willed And bequeathed. Ratifying and confirming this and no other to be my last Will and Testament in witness whereof I have hereunto set my hand and seal this tenth day of January in the year of our Lord One Thousand Seven hundred (sic) and Ninety-two.
