Last Will and Testament of Henry Ambrose (1755-1840)
Frederick County Will Book - March 1840, pp 436,437: In the name of God Amen. I Henry Ambrosius of Frederick County and State of Maryland being weak in body but of sound and perfect mind and memory this my last will and testament in manner and form following: It is my will my just debts and funneral expenses be paid by my Executors herein after named as soon after my decease. It is my will my Executors is to collect my outstaning (sic) debts, Notes on hand, book account, rady money to divide among my Five Doters Mary, Catherina, Christina, Susan, Elizabeth to theire heirs or assigns Equal share and share alike after my death my Doter Hannah she has received her Legacy and her heirs or assigns in full, It is my will Thomas Bittle and Jacob Johnson is to divide my moveable property among my Five doters, Mary, Catharina, Christina, Suzan, Elizabeth or there heirs or assigns. Equal share and share alike One month and a half after my death to the best of there knowledge without any right of law my Doter Hannah she has received her share her heirs or assigns in full, It is my will my six Doters to have Equal share and share alike Mary, Catherina, Christina, Hannah, Susan, Elizabeth. My Doter Catherina the wive of Peter Abert [sic] has received her Legacy one hundred and Eighty four dollars and fifty cents in part of her and his portion or Legacy no Interest thereon her and his heirs or assigns; Hannah my Doter the wive of George Stokes she received the just sum of Four hundred dollars her and his portion or Legacy I say received in full by her or his heirs or assigns of all claims, title, interest or demands of my said Estate or property there is One hundred and twenty Eight dollars in a Note on hand no interest thereon that shall be received by my Executors or Executors of George Stokes or his heirs or assigns. My Doter Christina the wive of John Runey has received her Legacy One hundred and fourty two dollars and fourty cents in part of her portion or Legacy no Interest thereon his heirs or assigns, My Doter Elizabeth the wive of Jonathan Fry has received her Legacy One hundred and fourty three dollars and ninety five cents in part of her portion or Legacy no Interest thereon her heirs or assigns; It is my will my beloved friends Jonathan Fry and George Stokes Executors of this my last will and testament, this two above named Executors or either of them Jonathan Fry and George Stokes is to sell my Tract of Land by the best advantage One year after my death. Jonathan Fry and George Stokes the above named Executors is to make a ______ and Lawfull deed for the Tract of parsel of Land above named contains Fifty acres part of Shady Grove and it is also my will that if the said Jonathan Fry or George Stokes cannot or will not be my Executors if neither of these will be my Executor then the said Thomas Bittle shall be my Executor is to sell my tract of Land by the best advantage one year after my death. Thomas Bittle the above named Executor is to make a ______ and lawfull Deed for the tract or parsel of Land above named Contains Fifty Acres part of Shady Grove. In witness wereof I have hereon to set my hand and seal the Fifth day of May in the year of our Lord One thousand Eight hundred and twenty six. On the 23rd day of March 1840, Came Jacob Johnson and Thomas Bittle and on the 26th came Jonathan Bittle, the subscribing witnesses, to the foregoing last Will and testament of Henry Ambrose, late of Frederick County, dec., and made Oath on the Holy Evangely of Almighty God That they did see the testator thereon named, sign and seal this will, that they heard him publish, pronounce and declare the same to be his last will and testament, that at the time of his so doing he was to the best of their apprehensions of a sound and disposing mind, memory and understanding, that they respectively subscribed their names as witnesses to this Will in the presence and at the request of the testator, and all in the presence of each other. George Stokes one of the Executors appointed by the last Will and testatment of Henry Ambrose, late of Frederick County deceased, do hereby decline bonding as Executor aforesaid Witness my hand this 25 day of March 1840. ~
