Estate of Mathias Ambrose (1762-1842)
Morgan County, to-wit:
Before me, the undersigned, a Justice of the Peace, in and for said County, personally appeared E. G. Alburty, and made oath in due form that the annexed Order of Publication has been inserted in the Virginia Republican for two months successively, from the 15th of November 1843, to the 15th of January (inclusive) 1844. Given under my hand this 26th day of February, 1844.

VIRGINIA -- At Rules held in the Clerk's Office of the County Court for Morgan County on the first Monday in November 1843. David Ambrose and George Ambrose, Administrators of Mathias Ambrose, dec'd., Plaintiffs, against William Ambrose, George Rizer, Benjamin Riser, Resin Barnes and Catharine his wife, Jacob Portmess and Sophia his wife, Richard Thralls and Ann his wife, -- the said George, Benjamin, Catharine, Sophia and Ann, being heirs of Margaret Riser, dec'd., -- Henry Clauver the elder, Peter, Joshua, Jacob, Solomon, Henry, Samuel, Philip, William, Aaron, Margaret and Henry Clauver, Children and heirs of Catharine Clauver dec'd., -- and John Yost and Susan, his wife, George Aulabaugh and Mary his wife, Mathias Ambrose, William Ambrose, George Durham and Roseann his wife, John Kitchen and Hannah his wife, Henry Ambrose, Joseph B. Ambrose, Lucy Ambrose, Margaret Ambrose, heirs of Mathias Ambrose, dec'd. -- IN CHANCERY.
The defendants William Ambrose, George Rizer, Benjamin Riser, Resin Barnes and Catharine his wife, Jacob Portmess and Sophia his wife, Richard Thralls and Ana his wife, -- Peter, Joshua, Jacob, Solomon, Henry, Samuel, Philip, William, Aaron, Margaret and Henry Clauver, Children of Catharine Clauver, dec'd., and John Yost and Susan his wife, John Kitchen and Hannah his wife, Henry Ambrose, Joseph B. Ambrose, Lucy Ambrose and Henry Clauver the Elder, not having entered their appearance, and given security, according to the Act of Assembly, and the Rules of this Court, and it appearing by satisfactory evidence that they are not inhabitants of the State of Virginia; it is ordered that they do appear here on the first Monday in February next (1844) it being Rule day, and answer the bill of the Plaintiffs; and that a copy of this order be forthwith inserted in some Newspaper published in Berkeley county, for two months successively, and a like copy posted at the front door of the Court-house for said county of Morgan.

COMMISSIONER'S SALE
Pursuant to an Order of the County Court of Morgan, at its February Term 1844, in the case of Ambrose's Adm'rs Vs. Ambrose, &c., the undersigned, Special Commissioner of the Court, will offer for sale, at public auction, before the Court-house door in the town of Bath, on Monday the 25th of March -- being the first day of the Term of the Quarterly Court of the County -- a tract of land, in said county, situate on the South Fork of Sleepy Creek, of which Henry Ambrose, Sen., dec'd., died seised, and containing
142 ACRES
more or less. A more special description of the property may be obtained from Mr. David or George Ambrose, of Morgan.
TERMS: -- One-third of the purchase money in hand, the residue, in two equal instalments, at six and twelve months. A Trust Deed of the property will be required to secure the deferred payments.
