From the office of Earl S. Keim II, Register of Wills and Clerk of the Orphan's Court of Westmoreland County, Pennsylvania, the 26 day of Feb. 1997 copies of the wills of Thomas and Mary Hamilton were obtained. Thomas's will contents is as
follows:
No. 89 of 1886 | I, Thomas Hamilton in the County of Westmoreland and
| State of Pennsylvania being of sound mind memory and
Thomas Hamilton | understanding do make and publish this my last will and
Deceased | testament hereby revoking and making void all former wills by me at anytime heretofore made.
And I direct that my body be decently intered in the Cemetery at Poke Run Church according to the rites of the Presbyterian Church and that my funeral be conducted in a manner corresponding with my estate and condition in life.
As to such estate as it has pleased God to intrust in me. I dispose of as follows. Item:
I give and bequeath to my beloved wife Mary Hamilton in lieu of Dower if she so elect The Plantation in which we now reside containing one hundred and eighty acres more or less, together with all the live stock, horses, cattle, sheep, swine or by me now owned and kept thereon and all the household furniture and other items not particularly named or otherwise disposed of in my will to have and to hold the said messnage and appundinanus and the said goats and chattels for and during her natural life if she remains my widow and at the death or remarriage of my said wife all the Property hereby bequeathed to her aforesaid or so much thereof as then remains I give and divide as follows. Item:
I give and bequeath to my two sons Adam and Thomas their heirs heirs and assign forever all of my Plantation on which I now reside containing one hundred and eighty acres more or less to be equally divided between them share and share alike.
Item: all of my personal property that remains after the death of my wife, and all of my debts are paid to be divided between my two sons Adam and Thomas Hamilton share and share alike.
Item : I give and bequeath to my daughter Mary Ann McCutcheon Four Hundred Dollars to be paid to her by my sons Adam and Thomas Hamilton in four equal annual payments without interest the first payment to be made one year from the date of my decease.
Item: I devise and bequeath to my daughter Isabel Fry three hundred dollars to be paid to her by my sons Adam and Thomas Hamilton in three equal annual payments without interest the first payment to be made one year from my decease.,br>
Item: I give and bequeath to my daughter
Elizabeth Beard three hundred dollars to be paid to her by my two sons share and share alike in three equal annual payments without interest the first payment to be made in one year from the date of my decease.
Item: I give and devise to my Grand daughter Sarah Alsworth fifty dollars to be paid to her by my two sons Adam and Thomas Hamilton share and share alike to be paid to her within one year from the date of my decease.
Item: I devise and bequeath to my Grand children William, George, Thomas, Matthew & Mary Hamilton-children of my son John Hamilton Deceased. Four Hundred Dollars to be divided equably among them share and share alike to be paid to them in four equal annual payments without interest by my two sons Adam and Thomas Hamilton. The first payment to be made in four years from the date of my decease.
Item: my Household furniture after the decease of my wife I give and devise to my daughters Elizabeth, Mary Anne and Isabel to be divided among them share and share alike and lastly I hereby constitute and appoint Jas. C. Ferguson to be executor of this my last will and testament. In witness whereof I Thomas Hamilton Sr. the testator have to this my last will written on one sheet of paper set my hand and seal this sixth day of February AD 1882
