The Will of William Ollier of Bath Somerset (Dated 1847 & 1853)

This is the last Will and Testament of me William Ollier residing at No. 6 St. Johns Place in the City of Bath out of business first I direct that all my just debts funeral and testamentary expenses be paid and satisfied, as hereinafter mentioned I give and bequeath unto my friends Isaac Colledge of Stall Street aforesaid Tea Dealer and John Rutter also of Stall Street Baker their executors administrators and assigns all those improved leasehold ground rents arising and payable out of and from eight houses in Sydney Place in the parish of Bathwich of which about forty four years are now unexpired upon trust that the said Isaac Colledge and John Rutter and the survivor of them and their executors administrators and assigns. of such survivor do and shall permit the said improved ground rents to be received and taken by my beloved wife Anne Ollier or her assigns during her life for her and their own absolute use and benefit and from immediately after the decease of my said wife upon trust to receive and pay the said leasehold ground rents unto or permit the same to be received and taken by my daughter Sarah Ollier for and during her life but for the sole and seperate use of my said daughter during such time as she shall be under coverture to the end and so that the same may be for the sole and peculiar use and benefit of my said daughter independently and exclusively of any husband with whom she may intermarry and in nowise subject or liable to his debts control interferance or engagements All the rest residue and remainder of my personal estate and effects whatsoever (subject to the payment of my debts as before mentioned) I give devise and bequeath unto my said dear wife Anne Ollier her executors administrators and assigns for her own use and benefit and I hereby appoint her sole executrix of this my will provided always and I do hereby declare that on the death refusal or incapacity of any trustee or trustees they or the surviving or acting trustee his executors or administrators shall and may by deed or deeds in writing to be duly executed and attested from time to time appoint any persons or person to be trustees or trustee in the place of such trustees or trustee dying refusing or becoming incapable to act and when such new trustees or trustee shall be appointed as aforesaid all the trust estate shall be conveyed and assigned to such new trustees or trustee either jointly or solely as the [...?...] shall require to the use and upon the trusts hereinbefore declared or such of them as shall be capable of taking effect and the persons or person so to be appointed shall have the same powers and authorities as the trustees or trustee in whose place they or he shall be substituted and I do hereby further declare that my trustees for the time being shall only be answerable for their wilful defaults and not the one for the other of them and that they or he may reinburse themselves or themself all costs and expenses incurred in relation to the trusts of this my will and lastly revoking all former wills I declare this to be my last Will and Testament In witness whereof I have set my hand and seal this twenty second day of February one thousand eight hundred and forty seven William Ollier [signed] signed sealed and published by the said testator William Ollier as and for his last Will and Testament who at his request in his presence and in the presence of each other we have hereunto subscribed our names as witnesses Fanny Davies [signed] Elizabeth Mary Wills [signed]

 

I William Ollier formaly of No. 6 Saint Johns Place in the City of Bath but now residing at my son in laws William Veysie of No. 34 Westgate Street Bath Boot Maker do declare this to be a codicil to my will which bears date the twenty second day of February one thousand eight hundred and forty seven whereas in my said will I have given certain improved leasehold ground rents arising out of eight houses in Sydney Place Bathwich to my beloved wife for her life and afterwards to my daughter Sarah (now the wife of the said William Veysie) for her life for her sole and seperate use independant of any husband with whom she may intermarry and free from his debts control interference or engagements without having given any power to my said daughter to dispose (after her decease) of such ground rents by her last Will and Testament Now I do hereby will and direct that the said improved ground rents shall be held by the trustees for the time being of my said will upon the trusts as therein set out but with this further addition and power that my said daughter Sarah Veysie shall notwithstanding her present or any future coverture be fully empowered and authorised by her last Will and Testament or any writing in the nature of her last Will and Testament to give devise or bequeath the said improved ground rents in any manner she shall think proper so to do for all the residue and remainder then to come of such improved leasehold ground rents and I direct that it shall not be considered necessary for the trustees of my will at any time to sell the said leasehold ground rents and invest the proceeds thereof and I direct that the trustees for the time being of this my will shall subject to the previous life interests of my wife and daughter convey assign and assure the said ground rents in pursuance of such will of my said daughter and in case my said daughter shall die without having made any such will or bequests then that the said improved leasehold ground rents shall be held upon trust and be assigned and transfered unto the legal personal representative of my said daughter Sarah Veysie in every other respect I ratify and confirm my said will in witness whereof I have hereunto set my hand and seal this ninteenth day of June one thousand eight hundred and fifty three William Ollier [signed] signed and sealed and declared by the said William Ollier as and for a codicil to his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other set and subscribe our names as witnesses hereto Burt Little [...?...] [signed] Bath John A. Proved at London with a codicil 28th Nov. 1853 before the surgt. by the oath of Anne Ollier widow the relict the sole executrix to whom admon was granted having been first sworn by comon. - duly to administer.

The will was proved in 1853 to William's wife Anne.

Note: Sarah Ollier married William Veysie at Holy Trinity, Coombe Down, Somerset in 1850. Also interesting to note is the signature on William's codicil of John A Archer, John Alexander Archer is mentioned in the burial details concerning the family grave of the Locke family of Wylye Wiltshire, amongst those buried in the grave are John & Jane Locke (nee Ollier, the daughter of Joseph Ollier the Attorney of Northwich, Cheshire) John Alexander Archer was the son of John Archer & Jane Archer (nee Locke) the daughter of John Locke & Jane Locke (nee Ollier) John Alexander Archer's farther, John Archer was a witness to the will of Joseph Ollier the Surgeon of London, in 1830.
