In the name of God Amen I William Ollier of Wymbodsly in the County of Chester yeoman lying under an indispofition of body butt of Sound and pfect mind and memory thanks bee to God for the same doe make this my laft will and teftament in writinge And firft I comitt my Soule into the hands of the Allmighty God my Creator Trufteinge onely in the Merritts of my lord and Saviour Jefus Christ for pardon of my Sinns and Salvation of my Soule and my body to the Grave to bee decently buried att the pish Church of Over And as for that worldly estate wherewith itt pleafed God to blefs mee I give A devife the same in the manner and forme followinge Ffirst I give and bequeath all my land and reall estate which I have lyeinge and beeinge in Wharton in the pish of Davenham with [..?..] unto my Sonne John Ollier and the heires of his body lawfully begotton or to bee begotton And for default of such isfue then I give and devife the same unto my Sonne Thomas Ollier and the heires of his body lawfully begotton or to bee begotton And for default of such isfue then then I give and devife the same unto my Sonne Joseph Ollier and the heires of his body lawfully begotton or to bee begotton And for default of such isfue I give and devife the same unto my sonne Richard and the heires of his body lawfully enfueinge And for default of such isfue I give and devife the same unto my sonne Charles and the heires of his body lawfully enfueing And for default of such isfue I give and devife the same unto my daughter Elizabeth wife of John Hoole and the heires of her body lawfully enfueing And for default of such isfue then I give and devise the same to my right heires forever Provide that my said sonne John or such pfon or pfons to whom my lands shall come by virtue of this devife shall within the terme of foure yeares to comence next after my decease pay or caufe to bee paid to such pfon or pfons such manner and forme as is hereafter mentioned the sume of ffifty pownds of lawful money of England the same to bee paid yearly by twelve pounds tenn shillings a year until the said sume of ffifty pownds bee run up and paid and in default of payment then my Exors hereafter named to stand seized thereof for the raifing and payeing ye same accordingly And as for that houfe in Wharton wherein my sonne John now lives with the buildeings and appertennces thereto belongeinge my mind and will is that my sonne John and the heires of his body and for default of such isfue my heires respectively above named accordeing as they shall bee in seniority of Age and priority of birth shall hold and enjoy the said mesfuage or houfe with the appertennces as fully as my right and tythe thereto will admitt or [..?..] if any of my [..?..] held or enjoyed or could or might hold or enjoy ye same And wereas I am posfesfed of a houfe and parcell of grounds called Dudfin Mofs in Wharton aforesaid beeing the inheritance of my lease Buckley under whom I hold under a small rent as tennant att will I give and devife the same and all my tennant right and tythe presents unto my said sonne Joseph Ollier and his heires and as for and concerning the above mentioned ffifty pownds and all the rest residue and rem. of my pfonall estate of what nature whatsoever I give and devife the same as follows Firft I give and devife unto my said daughter Elizabeth Hoole the sume of ffiftyeone pownds of lawfull money of England to bee paid her within the Spase of twelve months next after my deceafe then I give and bequeath unto my grandfonne Holland Hoole sonne of my said daughter Elizabeth the sume of tenn pownds of like lawful money the same to bee putt out at interest by my said Exors und till my grandfonne attains the age of sixteen yeares then my mind and will is that the said sume of tenn pounds principal and all interest that shall or may bee rayfed thereby shall bee given to my said grandfonne att his attainment to the age of sixteen yeares if hee happen soe long to live and if hee dye before hee attains ye age then my mind and will is that the same shall bee equally distributed amongst such child or children as my said daughter shall have living att such time as my said grandfonne should (had hee bee liveing) have received ye same as aforesaid And as for all the reft and refidue of my said ye personal estate as allfoe the said ffifty pownds I give and devife the same unto my said Sonnes Thomas Joseph Richard and Charles to bee equally divided amongst you Share and Share alike My debts legacys and funerall expenses beeng first thereout paid and discharged And I doe hereby revoake all former wills by mee made and doe make this my laft will and Teftament in writing And doe conftitute and appoint my sonne in law John Hoole and my kinfman Peter Buckley of Sandbach Executors of this my will nott doubteing of procure to see The same pformed accordeing to the true intent and meaning hereof to whom I give and bequeath tenn shillings apiece forthwith And upon a further to my sd Exors and [..?..] wtns the standing ye legacy given my said sonne Thomas as aforesaid my mind and will is that one Moiety of what shall come to his share of my said pfonall estate shall bee putt outt att intereft and paid and employed by my said executors for the ufe of my grandfonne Thomas Ollier sonne of Thomas in such a manner forme as the legacy given to my said grandfonne Holland Hoole by mee hereby appointed and directed in witness whereof I have herewith putt my hand and seale this 29th day of Aprill in the third yeare of the raigne of our Soveraigne Lady Queene over England et Anno Dm 1704
