The Will of Thomas Ollier of Acton formerly of Cholmondeston (Dated 1819)

In The Name of God Amen I Thomas Ollier heretofore of Cholmondeston but now of Acton in the County of Chester Yeoman being of sound mind memory and understanding though weak in body do write and publish this my last Will and Testament in manner following (that is to say) First I direct that all my just debts funeral and testamentary expenses be paid and discharged as soon as convieniently may be after my decease Whereas I have advanced and paid to my son in law Thomas Major various sums of money for which he refuses to give me security and though such sums will amount to more than the share he ought to receive from my effects yet it is my will that he shall retain the whole thereof in full discharge of all claims he or his wife may conceive they have upon my property I give unto my grand daughter Frances the wife of Joseph Sumner of Burland Labourer the sum of twenty pounds to be paid to her at the end of twelve calander months next after my decease and I do direct that her receipt above not withstanding her coverture shall be a good and sufficient discharge for the same And subject as before mentioned I give and bequeath all the rest residue and remainder of my ready money monies due and owing to me chattells and personal estate of what nature soever and wheresoever unto and amongst my son Joseph Ollier my daughter Ann the wife of Thomas Hesketh of Wimboldsley and my grand daughter Ann the daughter of my late son Samuel Ollier equally share and share alike but if my said grand daughter Ann Ollier shall die before she attains the age of twenty one years and unmarried then the share of her my said grand daughter shall go to and be equally divided between my said son Joseph Ollier and my said daughter Ann Hesketh And I do direct that the receipt of my said daughter Ann Hesketh for her share of and in the residue of my said personal estate shall notwithstanding her coverture be a good and effectual discharge for the same And lastly I do hereby nominate constitute and appoint my said son Joseph Ollier and John Hockenhull of Brindley in the said County of Chester Farmer executors of this my last Will and Testament and hereby revoking all former wills do declare this to be my last Will and Testament In witness whereof I have hereunto set my hand and affixed my seal the twenty fourth day of July in the year of our Lord one thousand eight hundred and nineteen.

Codicil to the above will dated 1819
I Thomas Ollier of Acton Yeoman do hereby make and publish this as and for a codicil to my last Will and Testament I give unto Ann the wife of my son Joseph Ollier of Acton the sum of fifty six pounds and thirteen shillings being money due to me from my son in law Thomas Major and the representative of of the late Peter Statham for interest for her own sole seperate and peculiar use and benefit and to be free from the debts control or intermedling of her husband and which I give to her for the great care and attention she has shown to me and to be paid to her free and clear of a regular charge to be made for my board and maintenance In witness whereof I have hereunto set my hand and affixed my seal the thirteenth day of September in the year of our Lord one thousand eight hundred and nineteen.

The 19th day of January 1820 Joseph Ollier one of the executors in this will with a codicil named was sworn in common form before me Wm. Morgan surrogate.
The 19th day of January 1820 Joseph Ollier one of the executors in this will named was sworn in common form power being reserved to John Hockenhull the other executor therein also named to take upon him the execution of the will when he shall lawfully request the same and he further made oath that the personal estate and effects of the testator within the Diocese of Chester were under the value of £800 before me Wm. Morgan surrogate.
