An Agreement Made Between Thomas Cholmondeley Esq. & Thomas Slaughter Esq.

An agreement made the Fifth of January in the year of our Lord 1758 and in the Thirty First year of the Reign of our Sovereign Lord George the Second King over Great Brtitain and do forth between Thomas Cholmondeley of Vale Royal in the County of Chester Esq. of the one part and Thomas Slaughter of the City of Chester Esq. of the other part Whereas the said Thomas Cholmondeley is now siezed of the reversion in fee of two several leasehold tenements situate in Marton in the County of Chester expectant on the death of one life only named in each respective lease thereof and called by the respective names of Ollyers and Youngs Tenements And whereas the said Thomas Cholmondeley for the consideration herein after mentioned hath agreed to grant several leases of the said respective tenements unto the said Thomas Slaughter his heirs and assigns from and immediately after the death of the life now subsisting in each respective lease To hold for the term of three several lives to be named by the said Thomas Slaughter his heirs or assigns in respect of each such lease and under such rent boon and reservations as are hereafter respectively mentioned Now the said Thomas Cholmondeley for himself his heirs executors administrators and assigns for the considerations aforesaid and of the sum of ten shillings to him now paid by the said Thomas Slaughter the receipt whereof is hereby acknowledged for the consideration thereafter mentioned Doth covenant promise and agree to and with the said Thomas Slaughter his heirs executors administrators and assigns by these presents that he the said Thomas Cholmondeley his heirs or assigns shall and will from and immediately after the death of each of the said several lives now being in the said respective leasehold tenements and as they shall severally die upon the request costs and charges of the said Thomas Slaughter his heirs or assigns and in consideration of the respective sums of money to be by him or them paid for each such lease as hereafter mentioned by good and sufficient scol. [abbrev.] leases well and sufficiently grant lease and demise unto the said Thomas Slaughter his heirs and assigns in possession and free from all incumberances each of those the said two several leasehold tenements in Marton aforesaid called Ollyers and Youngs tenements with their lands buildings and other appurtenances thereunto belonging and respectively enjoyed therewith To hold the same tenements respectively unto the said Thomas Slaughter his heirs and assigns from the date of each such respective lease thereof for the term of three several lives and the survivor of them to be by him or them named in respect of and inserted within each such lease under and subject as to the said Ollyers Tenement to the yearly rent boons and other reservations amounting to £1. 9s. 0.d and as to the said Youngs Tenement the yearly rent boons and other reservations amounting to £1. 11s. 0d. And also subject to an Herriot for every person dying Principal Tenant of each such tenement of the sum of £4. in money and not the best beast or good and subject also to such services and suits to the lessor and other covenants from the lessee (not altering the yearly reserved rents boons and herriots aforesais) as are contained in the leases now subsiting of the said respective tenements. And the said Thomas Slaughter for himself his heirs executors administrators and assigns doth covernant promise and agree to and with the said Thomas Cholmondeley his heirs and assigns by these presents that he the said Thomas Slaughter his heirs or assigns shall and will accept and take the said respective leases of the said respective tenements at the time aforesaid and shall and will immediately upon the execution of each such lease well and truly pay unto the said Thomas Cholmondeley his heirs or assigns for and in consideration of each such lease the full sum of £400. of lawfull money of Great Britain without any deductions or abatements whatsoeverIn Witness whereof the said parties to these presents have hereunto seat and put there hands "and seals " [crossed out] the day and year above written.
