The Will of Joseph Ollier, Flax Dresser of Middlewich Cheshire (Dated 1802)

This is the last Will and Tesament of me Joseph Ollier of Middlewich in the County of Chester aforsaid and Shopkeeper made and published the ninteenth day of November in the year of our lord one thousand eight hundred and two First I will and direct that all my debts legacies and funeral expenses and also the probate of this my will shall be paid and satisfied by and out of my personal estate I give and devise unto Timothy Deane the younger of Sutton in the parish of Middlewich aforsaid Yeoman and George Daniels the younger of Middlewich aforesaid Shopkeeper their heirs and assigns. all and singular that my messuages and dwelling house situate and being in Middlewich aforsaid wherein I now inhabit and dwell together with the shops warehouses hereditments and appurtances whatsoever thereunto belonging or appurtaining now also in any possesion or occupation and also the pew and seat in Middlewich Church now also in my possesion and also all that my mesuage and other dwelling house now divided into two dwellings with the hereditments and apputances thereunto belonging or appurtaining situate and being in Middlewich aforsaid adjoining or near the aforsaid messuage and dwelling house in my possesion or occupation and now in the several holdings or occupation of Thomas Buckley Taylor and Henry Thompson Boatman [...?...] And all my estate rights tithes interest claims and demand whatsoever either in law or equity of in to or out of all or any of the aforesaid hereditments and premises or any part thereof to hold the same to and to the use of the said Timothy Deane and George Daniels their heirs and assigns to for and upon the several uses trusts interests and purposes hereinafter mentioned expresed and declared of or concerning the same that is to say to the use and behoof of Hestor Hodgkinson my servant who now lives with me and her assigns for and during term of her natural life without improachment of mark and from and from and immediately after her decease as to for and concerning the said messuages and dwelling house with the shops warehouses hereditments and appurtenances whereunto belonging or appertaining and now in my possesion or occupation together with the said pew and seat in Middlewich Church aforesaid to the use and behoof of my cousin Ann Ollier of Nether Knutsford in the said County of Chester Spinster (who now lives in the service of Lady Jane Stanley) her heirs and assigns forever And as for concerning the two other houses or dwellings in Thomas Buckley's and Henry Thompson's holding or occupation with their appurenances to the use and behoof of my cousin Elizabeth ------------- now the wife of -------------- and sister of the said Ann Ollier her heirs and assigns. forever I give and devise and bequeath unto my relation James Ollier of Castle Northwich in the said County of Chester Gentleman his heirs, executors administrators and assigns all my estate right tithe share and interest claim and demand whatsoever either in law or equity of in or unto all that messuage farm and tenement with the appurtenances, situate lying and being in Wharton otherwise Waverton in the Parish of Davenham in the said County of Chester heretoformentioned in the possesion of my late uncle Joseph Newall late of Middlewich aforsaid Shopkeeper deceased and now or later in the holding or occupation of Charles Heppard or his [...?...] tenant or [...?...] tenants as tenants or farmers thereof I give and bequeath unto Samuel Kent of Croxton in the Parish of Middlewich aforesaid Yeoman the sum of one hundred pounds to be paid within six months after my decease and in case the said Samuel Kent shall happen to die before the said sum of one hundred pounds shall become payable then I will and direct that the same shall be paid to his executors and administators I give and bequeath to William Carter of Leighs otherwise Lees in the Parish of Sandbach in the said County of Chester Yeoman and to the executors of Thomas Carter late of Leighton in the said County of Chester Yeoman deceased (brother of the said William Carter) the sum of twenty five pounds to be equally divided between them (to wit.) one half to the said William Carter and the other half to the executors of the said Thomas Carter and to be paid within six months after my decease And I do hereby declare that the said two several legacies of one hundred pounds and twenty five pounds are by me voluntarily given and bequeathed in satisfaction and discharge of two several debts for the like sums owing by my said late uncle Joseph Newall [Nowall ?] to the said Samuel Kent and Thomas Carter late of Leftwich in the Parish of Davenham aforesaid Yeoman deceased (late farther of the said Thomas Carter and William Carter) I give and bequeath unto the said Hestor Hodgkinson my servant all my stock in trade of all sorts and kinds whatsoever and wheresoever and also all my household goods and furniture plate linen and china and also all other my personal estate of what nature kind or quality soever and wheresoever to and for her own use and disposal or reward as recompence for her faithfull sevices to me subject [...?...] to the payment of my debts legacies and funeral expenses and the probate of this my will and I do revoke all former wills by me at any time heretofor made, and do publish and declare this my to be my last Will and Testament and thereof do name and appoint the said Timothy Deane the younger and George Daniels the younger executors and do hereby will and declare that my said executors shall not be answerable or accountable one for the other or for the reciepts payments acts deeds or defaults the one for the other and that they shall and may retain and deduct out of the money which shall come to their or either of their hands by virtue of the trusts aforesaid, all such costs, charges, damages and expenses as they or either of them shall or may pay bear sustain or be part unto for or by reason of all or any the trusts aforesaid In witness whereof I have hereunto set and put my hand and seal the said nineteenth day of November one thousand eight hundred and two.

Signed sealed published and declared by the said Joseph Ollier the testator as and for his last Will and Testament being contained in this and the two proceeding sheets of paper to the said two preceeding sheets he hath set his hand and to this last his hand and seal in the sight and presence of us who have subscribed our names as witnesses in the sight and presence of the said testator and of each other.

Note: From this will it can be seen that Joseph was most likely one of the grandson's of Joseph Ollier the Yeoman who's will was written in 1725, in that will he only names Thomas & Joseph as his sons, therefore it is almost certain that Joseph was the son of Thomas.
