The Will of James Ollier, Attorney of Witton (Dated 1824)

This is the last Will and Testament of me James Ollier of Witton in the County of Chester Attorney at Law First I order and direct the payment of all my debts, funeral expenses and the charge of the probate of this my will I give and bequeath unto my sisters Elizabeth Thoms and Ann Ollier each the sum of two guinies for the purchase of a morning ring I give and bequeath unto my grand neice Jane Partington my gold lockett and unto my grand neice Mary Partington the sum of five pounds the same to be paid to my neice Anne Partington to be paid out at her discretion for her daughters benefit I give and bequeath unto my nephew James Alsager Ollier my gold watch chain and seal with initials J. O. impressed thereon and to my nephew Thomas Ollier my law books and my other gold seal attatched to the said gold chain And as to the rest residue and remainder of my real and personal estate of what nature and kind soever and wheresoever I give and devise the same unto my nephews John Whalley and the said Thomas Ollier their heirs executors and administrators recording to the nature and quality thereof upon trust that they the said John Whalley and Thomas Ollier and the survivors of them and the hiers, executors and administrators of such survivor do and shall as soon as convieniently may be after my decease sell and convert into money all such part as shall not consist of monies or securities for money and do and shall divide the same equally amongst all my nephews and neices viz. the sons and daughters of my brother Charles Ollier and my late brother Thomas Ollier and my sister Jane Locke and Alice Whalley in equal shares and proportions and I direct that the share and shares of such of my neices as shall be married shall be paid to them free from the control of any present or future husband and that their receipts alone shall be a good and sufficient discharge to my said trustees And hereby revoking all former wills by me at any time hereby made I nominate constitute and appoint the said John Whalley and Thomas Ollier executors of this my last will and testament In witness whereof I the said testator James Ollier have to this my will contained on this and the proceeding sheet set my hand to such proceeding sheet and my hand and seal to this last sheet this twenty second day of January in the year of our Lord one thousand eight hundred and twenty four.

Signed sealed published and declared by the said testator James Ollier as and for his last will and testament in the presence of us who have hereunto subscribed our names as witnesses thereto in the presence of the said testator and in the presence of each other, the word "estate" being first interlined in the first page.

Codicil Dated 1824

Whereas I James Ollier of Witton in the County of Chester Attorney at Law have made and duly executed my last will and testament in writing bearing date the twenty second day of January Inst. Now I do hereby declare this present writing to be as a codicil to my said will and direct the same to be annexed thereto and taken as part thereof and I do hereby give and bequeath unto my servant John Vernon a sum of money not exceeding twenty pounds nor less than ten pounds which I have at the discretion of my executors And I do hereby revoke the bequest of the distributary part or share of my property made by me in favour of my nephew Thomas Ollier conceiving that he will have an equal share in having any books and gold seal bequeathed by me to him In witness whereof I have to this my codicil put my hand and seal this thirteenth day of April one thousand eight hundred and twenty four.
