Mystery Man of Pulaski

Somewhere in the bible it says "By the deeds ye shall know them" but of Sewell T Gates all that we know are the papers found in the top story of a barn at

7409 Bridge St, Pulaski, NY
by Dorothy Deans.

Landmarks of Oswego County published by D Mason and Co, Syracuse, NY states that Sewell T, one of the war supervisors of the town (Richland) was born in Herkimer Co in 1815- moved to Richland in 1820, settled in Pulaski in 1861 and died there August 21 1894. (pp 690 & 685)

In a brief explanation of these papers you learn that he was a very busy lawyer practicing in the village of Pulaski for many years, why then was there no obituary in the Pulaski Democrat, why was he not mentioned in the article "Lawyers of the town of Richland" on page 212 in the History of Oswego Co 1789-1877?

There is no phase of law in which he did not participate. He settled estates, made out deeds, land contracts, bonds, releases, notes, mortgages, soldiers affairs, railroad affairs, etc.  Among the estates that he settled were: Seymour Moody, John Jones, Lucy Jones, Heil Richards and many more.  Receipts were carefully recorded. I would think that he was very honest.  Deeds in those papers dated from 1828 to the time of his death. I trust that the papers will be historically imported (sic), and that more will be learned about Mr. Gates.

Aug 24, 1894 in Oswego Daily Times "Sewel T. Gates.  Pulaski, Aug 21-- Died, at his home in Pulaski, NY, August 21, Sewel T. Gates, aged 78 years and 11 months.  Funeral from his late residence Thursday at 2PM.  Interment in South Richland Cemetery.  Mr. Gates was a man well and favorably known and few men are known to possess such qualities of sterling integrity and straightforward honesty of purpose.  He was a man whose judgement was sought in matters of business, real estate and general finance.  He was born in the town of Winfield, Herkimer county, September 22, 1815 and removed to the town of Richland, Oswego county, with his parents at the age of 14, where he has since resided.  He was a prosperous farmer, but retired and moved into the village of Pulaski in 1861.  He served his town as supervisor three terms.  A considerable part of that time being in the stirring times of the rebellion, at which time he took a special interest and was particularly active in the recruiting of troops and filling the quotas of the town.  The last years of his life were passed in a quiet manner.  On March 10th of the present year he fell and broke his left arm near the shoulder and has been a most constant sufferer since that time, through that and other complications."

Notes for ELISHA W. GATES:

1850 Census has 13 yr old Elisha living with Calvin (43) and Dorothy Smith (41)in Mexico NY with Judson M. Smith (6) (1840 lists one male under 5-- is this Elisha after his mother's death in 1838?)

1855 Census lists him in home of Calvin and Dorothy Smith as adopted child. After speaking to Bonnie Shumway Mexico Historian , we believe after his mother's death, he may have been raised by Calvin and Dorothy, or he may have only moved there as a farm hand at age 18, in 1855. Either way we believe him to be the right Elisha as he is the only Elisha Gates in Prattham, NY during the time he is listed in Robert Gates's will.

1858 Elisha W. Gates is listed as a trustee of the Presbyterian Church of Mexico, NY.

1860 Census lists an Elisha Gates 23 yrs, farm laborer born NY living with Calvin Smith, 55 farmer b. NY, Calvin's wife Dorothy 53 and Judson Smith.  They are in Mexico NY, which is where he is in 1893.

1874, June 9th, Oswego Daily Times, Tuesday.  " Holmesville. Serious Accident-Fruit and Crops.  June 6- Mr. Elisha Gates was thrown from his wagon last evening near Lewis Tubbs and very badly hurt about the head and face and one knee is fractured in a way that will take a long time to recover if ever.  No one is allowed to see him, as he lies in critical condition."

Article from Mexico, 1916.

Death of Elisha W. Gates

Our community was greatly shocked last Thursday afternoon to learn of the sudden death of one of our esteemed citizens, Mr. Elisha W. Gates. He had not been able to be about town for some time but had seemed in usual health.  He had eaten dinner and his wife was helping him away from the table, as was her custom, when he became helpless and soon passed away. His funeral was held from his late home, at 2pm Saturday, Rev. D.L.Roberts, his pastor officiating. His widow has the sympathy of many friends in her bereavement.

Mr. Gates was a member of the Presbyterian Church and had served very acceptably as a member of the board of trustees.  He and Mrs. Gates formerly resided at Prattham, coming here to live when failing health obliged him to leave the farm which for so many years had been their home and where their friends were always welcome.  To give pleasure, to do kind and neighborly deeds, to be true to their friends was a creed they fully lived up to, and these acts of kindness linger in the minds of friends as a pleasant memory.  An estimable citizen, a kind husband and true friend, he has gone to his reward.

Aunt Jane was born October 26 1838 and had lived a full life of over 87 years. Dr. John H. Young, her pastor, officiated at the simple services held in the Miner Undertaking rooms at 10 o'clock, Sunday morning and the body placed in the receiving vault awaiting burial in the Mapleview Cemetery.

Mrs. O. D. Richardson of Elgin, ILL and Mrs. Ernest A Stone of Daysville, NY nieces are the nearest surviving relatives.

The passing of Mrs. Gates brings to mind quite a prominent family once resident in the adjoining town of Richland. It was a lively bunch of youngsters that came to the home of Stephen and Polly Wilson Tinker. The Tinker girls were famed for their high spirits and fun loving natures that were always ready for a good time in which the mother was ever ready to join.  This home became known as Tinker Tavern and was a hostelry so famous for its good cheer and cordial hospitality that travelers on the old

Salt Road
enjoyed stopping for the night. Mrs Gates and two of her older sisters became very successful teachers in the days when the pay was meagre and boarding around part of the contract. The married life of Mrs Gates was a happy venture. The young couple went to work on a rented farm in the vicinity of the Ira Halsey home.  After a few years, however, they moved on the farm they bought near Prattham which was their very pleasant home for many years.  The Gates' lived well and Aunt Jane developed a wonderful knack at cooking so there were many a social event besides Thanksgiving feasts which friends and relatives gathered.

This good pair delighted in doing kind acts and many were the homes into which they went in times of trouble or sickness, giving of their time and strength in an unstinted way. Aunt Jane could play the melodeon and both were good singers.  Is it any wonder they were actively engaged in the well being of the little church?

Aunt Jane had a great love for children that drew them to her.  Perhaps the loss of their only child a little girl, brought this part of her nature out the stronger.  Many men and women remember her influence exerted in their childhood and trace many an impulse toward good to that association.

Funeral of Hon. Willis E. Heaton held Yesterday Afternoon at Methodist Church

Death Came to Hoosick Falls Dean of Legal Fraternity Tuesday Morning - Former Surrogate and Supervisor Beloved by People in All Walks of Life; Had Distinguished Career at Bar

The Hon. Willis Edgar Heaton, dean of the legal profession of Hoosick Falls, and outstanding and beloved citizen and one of the most distinguished attorneys of which Rensselaer county could boast, who died Tuesday morning was laid at rest in Maple Grove cemetery at 3 o’clock yesterday afternoon. The funeral, held at 2 o’clock from the home on

Abbott Street
and at 2:30 o’clock in the Methodist Episcopal Church, was attended by people from every walk of life. Bertram C. Cavanaugh of Troy, president of the Rensselaer County Bar Association, headed a large delegation of lawyers who paid final tribute to the man who was a friend of humanity and enemy of non, an upright, honest public official, a scholar and an author, but above all a Christian gentleman.

The funeral services were conducted by the Rev. William Goodman, pastor of the Methodist Church, who was assisted by the Rev. David Hughes, a former pastor. The bearers...

Judge Heaton, for 12 years Surrogate of Rensselaer County, four years Supervisor of the Town of Hoosick and for two years chairman of the Board of Supervisors, died about 7:10 o’clock Tuesday morning. Since an accident several years ago when he was struck by an automobile while crossing the street, the judge had not been in the best of health. He had failed gradually during the Summer months but managed to continue his law practice here until last Saturday when his physician ordered him to bed. His condition became increasingly more critical and early Monday evening he told those about his bedside that he felt he could not recover, adding that he would meet the end cheerfully. He faced death confidently and like a soldier of the King. At 1 o’clock Tuesday morning he dropped into a coma from which he never awoke.

Judge Heaton was born at Cicero, Onondaga County, September 15, 1861, the son of Charles Edgar and Sarah Ann [Gates] Heaton. His father was a medical student in Philadelphia at the time and family moved to Black river in Jefferson County where the father started practicing medicine.

Mrs. Heaton, the judge’s mother, was descended from the Gates family of Revolutionary War fame and seven years after the judge’s parents settled in Black River, they moved to Mexico, Oswego County, the old home of the Gates family.

There the judge, a youth, entered the Mexico Academy and was graduated in 1877 as salutatorian of his class. He entered the offices of the Mexico Independent under H. Clark Plumley, later editor of the Fargo, N.D. Daily Argus. Influenced by this contact with a journalistic career although he specialized in printing, he later became a writer of poetry, submitting many offerings to the press.

Had the Judge so desired, he might have followed the art of making verses with profit. Some of his works, know only to his intimate friends, are little gems and some day it is hoped they will come to light for publication. A large portion of his poetry was written in a humorous vein, scribbled off, at odd times such as when riding to Troy on the train. These works are deliciously amusing and well worthy of public recognition.

In Newspaper Work

Following an apprenticeship in the newspaper office, young Heaton entered Madison, now Colgate University, where he was chosen for the Delta Upsilon Fraternity. The loss of part of the sight in his right eye just before the conclusion of the first year in college caused him to give up his course and rest for six months. At the end of that period he started the study of Law with George G. French, prominent lawyer in Oswego County. Later he became clerk for the Surrogate’s Court there.

In 1882 he entered the Albany Law School and passed the bar examination in January of 1883. He was offered a position both as a legal advisor and as assistant editor of the Fargo Daily Argus to which his former employer had gone, but he chose the legal profession and, hearing that Hoosick Falls needed a lawyer, came to this county to settle.

He became village attorney in Hoosick Falls and was elected supervisor in 1898 being re-elected two years later and appointed chairman of the board. As such he secured the passage of a ruling that all county supplies be purchased by a special committee.

In 1901 he was elected Surrogate and was re-elected to that office in 1907 serving a total of 12 years. A book on the duties of executors and administrators and the law and practice in

Surrogate Court
which he wrote during his last term in that office has become standard authority in the state.

This treatise, under the title "Surrogates Courts" originally published in two volumes has run now into several editions and is complete in seven volumes. It is considered the most accurate and reliable of all publications on the subject by surrogates throughout the state and may be found on the shelves of most attorneys who practice in such courts.

As a surrogate he won the confidence, respect and even, love of all with whom he came in contact because of his kindly, fatherly disposition. He always was ready to lend his ear to the questions of those who sought service in his court and always ready with advice to all.

He was considered one of the most efficient and careful surrogates ever to hold the office in the county and very few reversals of this decisions ever were returned by the higher courts during his 12 years of tenure of office.

First Association Head

Judge Heaton became the first president of the Surrogates Association which he helped form. He was appointed by the legislature to draft a new Surrogate code in connection with the committee from the association. This code was enacted into law in 1914 and re-enacted in 1921 when important changes in legal practice were made.

Judge Heaton from his first partnership with Edward W. Douglas under the name of Douglas and Heaton with offices in Troy. This partnership later was dissolved and became co-partner with C. O. Pratt of Cambridge, maintaining offices in that village and in Hoosick Falls. Later a co-partnership was formed with Alvin E. Mambert in Troy.

…….. He was a trustee in the Methodist Church of this village, president of the Hoosick Falls Free Library, vice president of the Hoosick Falls Cemetery Association, member of the Hoosick Falls Elks and of the Republican Club of Troy. He was a member to the constitutional convention to revise the constitution of the state in 1915.

His wife, whom he married Dec. 27, 1888, was Mrs. Mary [Harper] Skinner of this village, who died about two years ago. He is survived by his five step-children, Mr. Genevieve Marvin of Hoosick Falls, Sister M. Immaculee of Holy Cross Order, Alexandria, Va., Dr. Charles R. Skinner of Hoosick Falls, and Rev. Robert Skinner, C.S.P. of Winchester, Tenn. And a brother, Dr. Earl G. Heaton of Baldwinsville.”

Ed. Note: there was stepchild still living, not mentioned above: Mary Lindsay Skinner, of Hoosick Falls. "

Notes for LUCIA E. GATES:

Mexico Independent Oct 22, 1879. Wednesday

Died at her home at the Stone Quarry, Mrs. Lucia  Gates Myers, wife of Byron A. Myers, aged 25 years.

Mrs. Myers was happily the daughter of pious parents, from whom from early childhood she received religious influences.  At the age of fifteen, under the labors of Rev. J. W. Simpson, she was converted, and soon after united with the M.E. Church at Holmesville, where she remained an active and useful member until her death. Her sickness was short but very severe.  Under the most acute suffering her light was clear and her faith assuring.  For herself she had no wish to live, but longed to go; but for her the sake of her husband, whom she highly prized, and her little girl, she would pefer to recover; yet she was enabled to overcome every trial, and had complete victory at the last.  Exhorting her friends to be faithful, and so live as to meet her in the "bright forever," she fell asleep in Jesus.  It was a beautiful ending of a brief but happy and useful life.

He was a traveling salesman, who apparently did very well.  Oliver spoke of his father coming home with money falling out of his pockets, but never leaving any for the family... It wasn't long after "A.C." left that Russell went into the service, and "Pete" (Oliver) quit school to help raise money for the family.

Asa(A.C.) was not well known by Russell or Oliver.  What we do know is that Myrtle would not let him see the kids when he came home from traveling, because, he would only come home to have laundry done and get a meal... He never gave Myrtle a dime to help raise the boys.  This caused a lot of tension within the family.

After leaving Myrtle, he  lived in Hastings for a while, followed by Prairieville, MI and then had a farm implement/hardware store in Delton.  He died on Crooked Lake in Delton.

He smoked a pipe, and cigars.

His adopted son, James thought the world of him... still does.

May have been married to a Clarissa Wilcox as well..

1880 Census he is listed as 2 years old...

Found Grand Rapids Airplane Co, Id that lists him as Arthur Gates.

Grover and Joyce Gates believe he may have died in Nevada in the late 1950's or early 1960's.  They recall receiving $180 as Grover's descendants. They think it was a drunk priest who hit and killed Asa while he was out there, so we would guess if Neva, Bert, Grover and all siblings were contacted that he was not married at the time. I will have to verify this story. (Know now, of course, this was not Asa but very well could have been Merril, son of William, brother of Asa)

THE GRAND RAPIDS PRESS ARTICLE on June 14th of 1920 had this article: (pg 13)

  Two Local Boys Drowned Sunday

Deward Porter, 17, and Orley Gates, 15, Lose Lives in River and Canal.

  Brother Sees Tragedy

Lured by cooling waters during Sunday's heat two Grand Rapids boys, Deward Porter, 17year-old son of Mr. and Mrs. Dell Porter 1800 Taylor Ave, and Orley Gates, 15, son of Mrs. Myrtle Gates 448 First St, were drowned.  The Porter youth lost his life in the river north of the filtration plant and the other was drowned in the west side canal Sunday evening.

"I'm going down, " Porter shouted, according to two companions, Russell Lewis,

24 Colfax St
, and Alvin West,
7 Matthews Ct.
When they looked they saw only the youth's hands protruding from the water.  Special Officer Dezra Sharon recovered the body an hour after the police had been called.  Coroner J.B. Hilnker ordered the body removed to Van Strien's morgue. Porter is believed to have been seized by cramps.

Surviving beside the parents are three brothers, James, Carl, and Kenneth, and five sisters, Thelma, Pearl, and Bertha Porter and Mrs. Margaret Hunt and Mrs. Mable Dean.

  Norman Eddy, 15 of

744 Broadway Ave
, was pulled down twice when he sought to aid Orley Gates to the canal bank according to the story told the police.  "He said he was all tired out and couldn't make shore" Eddy said.  " I couldn't find a rope so I jumped in but when I got to him he couldn't stay up and sank fast pulling me with him.  After going down twice I had to let go."

Russell Gates, brother of the drowned boy witnessed the tragedy.  Albert Erherdt,

623 Front Ave
, recovered the body in a few minutes.  Police officers meanwhile were draining water from the canal.  The parents and two brothers, Russell and Oliver, survive the boy.
