inheritency
Nisbet generations may have had many sons but oldest living son would inherit property and if the oldest son had children before he died it would pass on to them as inheritency descends

If there was only daughters they became heir portioners and property was divided between them-usually their husbands could not inherit but their children did

If there were no children it would pass back to his brothers with his next youngest brother 1st in line and down to youngest then up to oldest and if no brothers to his sisters (inheritency descends)

What then became of the other sons--
when the property they owned was extensive the oldest got the main property and the other sons got some of the other properties that the father purchased or inherited-
I have found some in Burgess and Brethern records as tradesmen or ministers-
joined the army-
married to property-
etc etc

 

Dalzell

POSSIBLY 2 different lines

John Nesbit, with consent of his wife, conveyed on 16th August 1514 to "consanguineo meo Georgio Nesbit filio Philippi Nesbit de eodem," the lands of the half barony of Dalzell, reserving portions in Flemington, Hole, and Parkhed.

(consanguineo meo=kinsman  or blood relative not necessarily through their paternal ancestors)

These may be related through a female on their lines not necessarly even a Nisbet

could this 1st line be DNA 3 although there are many in DNA 3 that mean they are from Greenholm so may be one of the Greenholm lines as so many believe thay came from Greenholm branch including mine?

Original Line

1305 sir Robert de Nesebith paid to Edward I. of England for relief of his lands of Daliel at Martinmas the sum of five merks.

I. John Nesbit 14-- receives sasine of the half barony of Dalziell.

II. Herbert Neisbit
1468
receives sasine of one half of the lands of Dalziel.
   In a resignation of the lands in favour of his
son John in 1477 he is described as "Lord of the half barrony of Dalzell."

III.John Nesbit, son and heir-apparent of Herbert,
received a crown charter 28th April 1477.
He appears as a witness 13th December 1485 and 22nd March 1495. On 23rd October 1495 he entered protestation before the lords to an action raised against him by Thomas Somervale of Braxfield.  
(heir apparent= will become heir after predecessor dies)

Quhytlaw, Alex. Malvill, David Hennyrsoun. Wm. Russell, John Nesbit of Rawynscrag, and Patrick Cleland, finding John Hay heir to his father um. Sir David Hay of Zestir knt. In the lands of Athkermure held in chief of the abbot of Arbroath, in whose hands they had been for 2 months since the death of Sir D. IV. John Nesbit of Dalzell and Margarete Somervell
1508 John Nesbit of Dalzell and Margarete Somervell, his spouse, daughter of Lord Somervell, received a crown charter of the lands, 20th November 1508.
1514  John Nesbit, with consent of his wife, conveyed on 16th August 1514 to "consanguineo meo Georgio Nesbit filio Philippi Nesbit de eodem," the lands of the half barony of Dalzell,
reserving portions in Flemington, Hole, and Parkhed
