Document number precedes entry. #1564 - Henry Bray of Randolph County, North Carolina and Joel Moody of the State of Georgia 5/18/1820. #1566 - At the house of Thomas Moody in Upson County, Georgia, I will take the deposition of Charles Willett, 7/27/1835. #1567 - Randolph County, North Carolina. William Moody late of the county aforesaid departed this life sometime in the month of December A. D. 1818 intestate, …the said William Moody dec'd. was in his lifetime and at the time of his death was (illegible word) and possessed of several tracts of land being in the county aforesaid and also in the county of Chatham Chatham - (to wit) The tract of land on which the intestate lived at the time of his death lying and being in the County of Randolph on the waters of Polecat adjoining the lands of Vestal Burson, William Burson & others containing two hundred and seventy two acres ------- One other tract of land lying and being in the County last aforesaid on the waters of Polecat adjoining the lands of William Burson and others containing seventy acres -------- One other tract of land lying and being in the County last aforesaid on the waters of Sandy Creek and adjoining Col. Isaac lane, Jonathan Burns and others containing one hundred and twenty acres all of which may more fully appear by referring to the several deeds of conveyance now in the possession of your petitioners ----- Your petitioners further showeth that the said William Moody decd was in his lifetime and at the time of his death held? and possessed of several tracts of land lying and being in the County of Chatham and state aforesaid (to wit) one tract of land lying and being on the waters of Tick Creek adjoining the lands of Thomas Ragland and Terrell Brooks and others containing six hundred and forty acres. An other tract adjoining the lands of Nathan Bray, Thomas Craven and others & lying and being on the waters of Flat Creek containing six hundred acres --------- An other tract lying and being on the waters of Bear Creek adjoining the lands of James? Carter? And William Glass and containing forty acres all of which will more fully appear by referring to the Deeds of Conveyance now in possession of your petitioners. Your petitioners further show to Your Honor that the defendants Thomas Moody, Joel Moody, and Thomas Elliott are not inhabitants of this state and that the defendant William Moody now lives in the County of Chatham and state aforesaid. Spring Term 1819 #1596 - At the post office in the town of Cull's Den in the County of Monroe and the State of Georgia I shall take the deposition of Anderson Moody & others. 2/3/1836 #1618 - Court order concerning Henry Bray: He is now residing as this appliant is informed in the State of Alabama. March 25, 1834 #1619 - Joseph Brooks states (among other information) that he knew John Moody and Anderson Moody and that they went to Georgia some years ago and that he saw John living in Georgia last November. March 30, 1836 #1630 - Schedule of the property of Henry Bray. An interest in a tract of land on the waters of Dry Creek in Chatham County… sold in the interest of Elijah Foshee about the year of 1829, An interest by my wife Patsy Bray in a lot of land in the county of Randolph which belonged to her brother John Moody who is dead. #1637-38 - From deposition of Emsley Myrick: Did you rent some land of Frances Elliott the present complainant the first year after your Grandfather William Moody died and on the plantation where he died? Answer: I did and paid the rent to her. 7/7/1832 #1642 - John Wood guard. Of John Moody, Money paid for John Moody - $9.60, Clothing and hat for John Moody - $2.25. 2/17/1819 #1693 - That Frances Elliott until lately was a married woman whose husband had abandoned her…and the complainants Peggy Moody and Rebecca Moody are infants under twenty one years of age and have no guardian. #1727 - From the court master's report regarding Frances Elliott: because it would be unjust to charge her with rent when several of the other heirs lived on the lands of the deceased without paying anything. Fall Term 1832 #1754 - Henry Bray Jun. and his wife Patsy. 4th Monday of September, 1827 #1799 - Emsley Myrick was duly sworn and sayeth on oath: Questions by the plaintiff 1 - What did William Moody say on his death bed in regard to a horse that he let Henry Bray have? He said that he let Henry Bray have a horse and a note on man by the name of Johnson of forty dollars and twenty dollars of said note was to make the said Henry Bray … to the rest of the legatees. 2 - Do you believe that William Moody was of sound mind and memory at the time of the conversation with you? Yes, I do. 3 - Do you recall what length of time that I kept John Moody before there was a guardian? Three years and a month or two. 4 - Do you recall what was given for keeping John Moody a year after a guardian was appointed for him? I heard in a conversation with the legatees that their(sic) was allowed twenty or twenty four dollars a year. #1801 - A Schedule of the property of Henry Bray A tract of land on the waters of Dry Creek in the County of Chatham and state aforesaid adjoining the lands of Richard W? and others number of acres not known now in the now in possession of the widow Promilar? Fooshe which interest was executed and sold in the interest of Elijah Foshee by Horace P. Bridges, sheriff of Chatham County at the court house in Pittsboro about the year 1829. Also interest by my wife Patsy Bray in a lot of land in the County of Randolph which belonged to her brother John Moody who is now dead. Also a claim of $50 which is due to Joel Moody in the division of the lands of his father William Moody dec. which money is due from the lots number four, five, and eight on judgment against Riley Moody for seventy six dollars, fifty eight, and a half cents and interest Randolph Supperior(sic) Court September term 1832. 9/5/1835 #1818 - To John Willet and Gilley his wife. Fall term 1832 #1823 - John Wood desposeth & sayeth that after the death of William Moody, the legatees of said estate met at the house of Elizabeth Miles. 7/17/1829 #1830 -Have caused Anderson S. Moody personally to appear before us at the dwelling house of James Gaines the 15th Sept. 1832. #1831 - On the third Saturday in September 1832 at the house of James Gaines in Moore County, I shall take the depositions of Anderson S. Moody and Phebe H. Moody. 8/13/1832 #1833 - Deposition of Robert Marsh: What amount did you receive from Henry Bray on the estate of George Blalock and what amount as guardian of the heirs of McCaslin I received on the Blalock's estate forty nine dollars and I think on the McCaslin's estate thirty five dollars. #1862-64 - Benjamin Moody…duly sworn desposeth and sayeth as follows to wit, Question - 1st. by Clerk & Master. Did you and the defendant H. Bray rent the plantation on which William Moody decd. Resided at the time of his death to Frances Elliott? Answer. I had no hand in renting it to her nor do I know that he rented it to her. We talked of renting out the lands of the deceased but concluded, as several of the children lived on the lands of the intestate, that we would not rent any of it out, except the mill tract. Question - 3. Do you know whether your father let her have thirty dollars at two different times? Question by Clerk & Master. What would have been a fair price for rent of the plantation on which your father died for one year? Ans. The plantation was out of repair…Perhaps it would have rented for $10 a year. Question by Clerk & Master. How long did Frances Elliott live on the tract before partition was made among the heirs? Ans. I think she lived on it a little more than one year before it was divided. 9/1/1832 #1906 - I find that the intestate had eleven children 1. Thomas, 2. Benjamin, 3. William, 4. Joel, 5. Riley, 6. John, 7. Betsey, 8. Gilley, 9. Patsy, 10. Frances, 11. Ezekiel who died in the lifetime of his father leaving the following 1. John, 2. Anderson, 3. Frances. 4. Patsey, 5. Rebecca, 6. Margaret, Polly. Fall Term 1831 #1954 - Rec'd $14.18 my claim in behalf of my wife Rebecca in a decree and judgment in our favor for that sum in the Court of Equity in the County of Randolph State of N Carolina against the said Henry Bray and Benjamin Moody. Witness: Nathan Edwards Jr. 8/17/1833 #1956 - Rec'd $12.41 my claim in behalf of my wife Margaret in a decree and judgment in our favor for that sum in the Court of Equity in the County of Randolph State of North Carolina against the said Henry Bray and Benjamin Moody.
