    37. Joseph-5 Pendleton (Col. Joseph-4, Joseph-3), was born at Westerly, RI, 26 Oct 1724.
    As far as we know Joseph-5 Pendleton was the first of Brian's many descendants who have been lost at sea. He sailed in his father's ill fated brigantine which was never heard from after leaving Anquilla in August, 1749. When over a year had passed without bringing any news of the missing ship, arrangements were made to administer his estate and to care for his children.
    The Colonial records of Rhode Island show the following:
    "Colony of Rhode Island. To the Honable the General Assembly sitting at Providence by adjournment the first Monday in December AD 1750. The petition of Joseph Pendleton of Westerly in the county of Kings County, humbly sheweth, that your Petitioner's son Joseph Pendleton, being a married man with two children, in the month of May AD 1749 sailed a voyage to the West Indies Island and the last account your Petitioner or any other of his Friends had from him was August following, sailed Homeward bound; and is in all probability lost at Sea; since which Time, to wit, in the month of October last past, his Wife was taken away by Death, and left the two small children and some considerable personal estate in Money, Stock & Household Goods, and as he laft a power of Attorney to his Wife when he went away, she being now dead, no person has any power by Law to dispose of any part of said estate for the advantage of the children, and if it should be left in such condition til the Town Council has any Right by law to grant administration to any person, great part of said Estate maight be wasted, and lost to the great Disadvantage of the Children. Wherefore your petition of said Westerly to grant administration to some person to take an inventory & make disposition of such part of said Estate as may be thought proper, and the money put out for the advantage of the children and your petitioner shall as in Duty bound pray &e Joseph Pendleton"
    "December 7th 1750, To the House of Magrts. Gen. Resolved that this Petition be granted  Voted & Past P. Order I Lyndon Is the House of Magrts, Dec 8th, 1750 Read & Concurred with By Order Tho Ward, Secy. A true copy examined by Tho. Ward, Sec."
    On the 25th March 1751, Col. Joseph Pendleton and William Champlin, "the two grandfathers to the said orphans, Joseph & William Pendleton, sons of Joseph Pendleton, Jr., who is supposed to be lost at sea since which time his widow is Dead, ask that inventory be made of estate, the property divided, and eath grandfather take administration of half and care of one child." (West. C & P Rec., ii, 288)
    On the 1st of July 1751, inventory of the estate was presented amounting to 1515 pounds 10s., and administration given to the tow grandfathers (Ibid., pp. 251-2). On the same day Col. Joseph Pendleton as principal, with Benoni Smith and Joseph Champlin, gave bond to the town of Westerly in the sum of 1518 pounds 10s., for the proper administration by Col. Joseph of one half the personal property of Joseph Pendleton, Jr., supposed to be dead, and for the bringing up of the eldest of Joseph Junr's children, viz., Joseph Pendleton. This bond was not recorded until July 1769 (Westerly C & P Rec., iv. 118).

Joseph married Ann CHAMPLIN, daughter of William CHAMPLIN 3rd and Sarah THOMPSON, about 1746 in Westerly, Kings Co., Rhode Island. Ann was born 15 Jan 1729 in Westerly, Kings Co., Rhode Island. She died Oct 1750 in Westerly, Kings Co., Rhode Island.

    Joseph -5 Pendleton had married Anna Champlin, daughter of William and Sarah (Thompson) Champlin. She was born at Westerly, RI, 15 Jan (or June) 1729, and died there in October 1750.
    NOTE -- The entry of the births of these children was not made until after their father's loss at sea, as the record names them as children of Jsoeph Pendleton, Jr., dec., and Anne, and notes that they were grandchildren of William "Champlain" and Sarah his wife (Westerly Town Meeting Book, 1745-1778, page 97.

    39. Lois-5 Pendleton (Col. Joseph-4, Joseph-3), was born at Westerly, RI, 22 Aug 1728. She married at Westerly, 7 Sept 1746, Benajah Gavitt, born there, 11 Nov 1726, died prior to 1781, son of Ezckiel and Hannah (Wilcox) Gavitt. Lois was living as late as 1760, when she was mentioned in her father's will. No list of her children has been found of record, and we have been able to obtain the names of only two, with no evidence as to whether she had more or not.
    It is believed that Lois had a daughter who married a Loper.

Lois married Benjamin GAVITT, son of Deacon Ezekiel GAVITT and Hannah WILCOX, on 7 Sep 1746 in Westerly, Kings Co., Rhode Island. Benjamin was born 11 Nov 1726 in Westerly, Kings Co., Rhode Island. He died after 1751 in Westerly, Kings Co., Rhode Island.

    40. Sylvester-5 Pendleton (Col. Joseph-4, Joseph-3), was born at Westerly, RI, 5 Aug 1730. The Westerly records show that in 1757, he paid taxes of .2s 4d. in that town, and that he was made freeman there, 1 May 1760. He was evidently a privateersman in the French and Indian War, as the records of the Court of Common Pleas of Washington County (then King's County), RI [Book F, p. 307], show that "Sylvester Pendleton of Westerly, mariner, late master of said schooner, Thomas Hazard, John Ross and Henry Wall of Newport, to recover 5000 pounds, and judgment for 1800 pounds and costs was given in his favor at the sitting of the Court held in August 1763.
    What became of him subsequently we have not been able to learn. His name does not appear in either the Rhode Island Census of 1774 or the US Census of 1790, and neither his will nor any administration upon his estate is to be found.
    The will of his father, Col. Joseph-4 Pendleton, shows that by Freelove-5, daughter of Col. William-4 Pendleton, Sylvester-5 had a son, Sylvester-6, born about 1749. married Eunice Cobb.
    Sylvester-5 afterwards married at Westerly, RI, 16 Jan 1751, Sarah Champlin, daughter of William (3rd) and Sarah (Thompson) Champlin. She was born 5 March 1725, (Westerly Records).

Sylvester was not married (1) to Freelove PENDLETON, daughter of Col. William PENDLETON Sr. and Lydia BURROWS. Freelove was born 30 Oct 1731 in Westerly, Kings Co., Rhode Island. She died in Stonington, New London Co., Connecticut.

PENDLETON GENEALOGY, page 91 & 92.
    The will of Col. Joseph-4 Pendleton shows that by her cousin, Sylvester-5 Pendleton, Freelove had a son Sylvester-6. b. 1748; m. Eunice Cobb.
    She afterwards married at Westerly, RI Capt. Isaac Sheffield (3rd). He d. 1797. The Probate records of Stonington show that on the 4th August in that year there "Appeared in this Court Isaac Sheffield & refused to take Letters of Administration on the Intestate Estate of his father, Capt. Isaac Sheffield, later of Stonington, dec. This Court hath appointed William Sheffield and Amos Sheffield Administration on the Intestate Estate of their father, Capt. Isaac Sheffield."
    In the division of his property, 20 April, 1799, receipts for 207P 11s. 4 1/2d. were given by Reuben and Deborah Cheseborough, Edward and Sarah Hancox, Isaac Sheffield, "eldest son of the dec'd," Samuel and Polly Breed, Zebulon and Freelove Hancox, Zebulon Hancox for children of his first wife, Lydia, and by William Sheffield for the "heirs of James Sheffield, fourth son of deceased" (Stonington Prob. Rec., vi, 228).

164. Simeon PENDLETON (Joseph , Joseph , James , Brian ) was born about 1733 in Westerly, Kings Co., Rhode Island. He died 1819 in Westerly, Washington Co., Rhode Island.

    42. Simeon-5 Pendleton (Col. Joseph-4, Joseph-3), was born about 1733, at Westerly, RI, and died there in October 1819. Simeon Pendleton was a farmer and lived at Westerly nearly all his life. The Westerly Tax List of 1757 shows that he was assessed two shillings there in that year. On the 24th of February, 1766, the Town Council gave him and his family a certificate of residence to the Selectmen of Stonington, Conn., but it is unlikely that Simeon remained there long, as all his children are recorded at Westerly and no reference appears stating that any of them were born elsewhere.
    He was in all probability the Simeon Pendleton who served as private in Capt. Joseph Pendleton's Co., Westerly militia, in 1776, and was appointed Ensign of the 1st Westerly Co., 1st Regt. King's County Militia, in 1777 and 1778, as the other Simeon Pendleton who also lived at Westerly in those years --[221] Simeon-6 -- would more likely be the one who was enrolled in the 3rd Westerly Co., in which were also enlisted a brother and other near relatives of that Simeon.
    Simeon-5 Pendleton was one of the executors of the will of his father-in-law, Walter Palmer of Stonington (dated 5 Oct, 1785, proved 3 Jan 1785), and received therefrom the house at Westerly that Palmer bought of Simeon'[s mother. His own will, dated at Westerly, 12 Oct 1819, proved 25 October 1819 (C & P Rec., Vol. 2, p. 331), names daughters Mercy, wife of Joseph Lawton; Bathsheba Babcock; Sally, wife of David Pendleton; Lucretia, wife of Libbeus Pendleton; and son Ethan Pendleton.
    Simeon married at Westerly, RI, 15 Jan 1760 (10 January in Stonington Ch. Records.), Mary Palmer, daughter of Walter and Mercy (Hinckley) Palmer. She was baptized at Stonington, 21 March 1742 (Westerly Rec. and "Palmer Groups," page 162).
